HEARING VISITORS PRESENT:
A. Any person is invited to attend meetings of your City Council
to discuss matters of individual concern, to present and dis-
cuss proposals, to participate in public hearings, or to be a
visitor. If you are present to apoear before the City Council
for any item on the agenda, please advise the City Clerk and
you will be heard at the earliest convenience. Should you have
an item you want to appear on the agenda, please make your re-
quest known in writing to the Mayor or City Manager at least
one week in advance of the regular City Council meetings held
on the second and fourth Tuesday of each month. Your presence
is appreciated and you are invited to attend any part or all
of the City Council meetings.
Article 6252-17, V.T.C.S., the Open Meeting Law, was revised
effective September 1, 1975, to require: (1) Notice of any
meeting to be posted in a public place readily accessible to
the general public at all times; the City Council of the City
of Plainview has authorized the posting to be in the Plainview
City Hall and the P!ainview Police Department reception area
which is readily accessible to the general Dub!ic at all times
and (2) any additional subject not previously included on the
published and posted agenda shall be accompanied by a statement
describing the nature of the urgent public necessity requiring
their~addition to the agenda. The policy of the City Council
of the City of Plainview is that no additional items will be
included on the published agenda later than 4:00 p.m., Thursday
preceding the Council Meeting unless accompanied by a statement
describing the nature of the urgent public necessity requiring
the addition to the agenda.
B. Receive for consideration, discussion and approval, the appoint-
ments and recommendations made by the Mayor on various authori-
ties, boards, commissions and committees:
1. Recommendations for appointments to the Community and Neigh-
borhood Improvement Committees as recommended by the Mayor
and City Council.
2. Recommendations for appointments to the City of Plainview
Board of City Development, for a term of 3 years. The Board
of City Development by-laws prohibit any appointees from suc-
ceeding themselves on the board.

Ordinance the definition of "at large" as contained in
Section I of said ordinance.
Ordinance No. 75-1912, an ordinance providing for standards
and quality of effluent water, entitled "City of Plainview
Industrial Waste Ordinance."
Zoning Ordinance, an ordinance by the provisions of Article
1011a revised Civil Statutes of Texas establishing zoning re-
gulations and districts in accordance with a comprehenaive~
plan and within such districts regulating the use of land,
building and structures; the height, bulk and locations of
buildings; establishing minimum requirements for off-street
parking; regulating the erection, repair and alternation of
all building and structures; providing for specific use per-
mits for certain uses; recognizing non-conforming uses and
structures and rules for the regulation there6f; creating a
board of adjustment and providing rules and regulations for
its organization, proceedure, jurisdic±ion and powers; set-
ting forth the requirements for building sites and the manner
of their creation; providing for a certificate of occupancy
and compliance; defining certain terms; adopting a zoning
district map and making it part of this ordinance, making all
figures, letters, markings, symbols and charts contained in
said ordinance or shown on the map a part of such ordinance;
providing a method for amending such ordinance; providing a
penalty for violation of the provisions of such ordinance not
to exceed $200.00 for each violation; also providing injunctive
relief to persons affected by the violations of said ordinance;
and providing a saving clause.
An ordinance prescribing rules and regulations governing plats,
plans and sub-divisions of land within the incorporated area
of Plainview, Texas, herein defined as the "City"; containing
certain definitions; providing for a preliminary plat, a final
plat, and providing for final approval of sub-divisions by
sections; prescribing regulations for streets, sidewalks, al-
leys, sanitary utilities, and community facilities:
Providing for a penalty of not more than two hundred ($200.00)
dollars for each vi61ation thereof; repealing all conflicting
ordinances; providing a validity clause; and providing an ef-
fective date.
Whereas, under the provisions of the Constitution and laws
of the State of Texas, including particularly Chapters 231,
Acts of the 40th Legislature, Regular Session, 1927, as here-
tofore or hereafter amended (compiled as Articles 974a and

6626, V.T.S.C., and the provisions of Section 4 of the Mun-
icipal Annexation Act (compiled as Article 970a), as hereto-
fore or hereafter amended, hereafter every owner of any tract
of land sitnated within the City of Plainview; who may hereafter
divide the same in two (2) or more tracts described by metes and
bounds or otherwise for the purpose of laying out any subdivision
or such tract of land or any addition to and purchasers or owners
of lots fronting thereon or adjacent thereto, are required to
submit a plat of such sub-division or addition for approval by
the Planning Commission of the City of Plainview; and
Whereas, the rules and regulations of the City established by
ordinance, governing plats and sub-divisions of the land, be
and the same are hereby extended to and shall apply to all of
the~area under the extraterritorial jurisdiction of said city,
as provided for in the Municipal Annexation Act, enacted by
· ~the State of Texas and which appears as Article 970a, V6rnon's
Annotated Civil Statutes.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF PLAINVIEW, TEXAS,
On and after the passage of this Ordinance, any person, firm or
corporation seeking approval of any plat, plan or replat of any
sub-division of land within the City ~f Plainview, Texas, and
its legally established extraterritorial jurisdiction shall be
required to comply with the requirements of this Ordinance be-
fore such approval may be granted, to-wit:

65-900 as amended by subsequent amendments; repealing Ordinance
No. 65-904 which limited the parking time of vehicles on the
North side of Sixteenth Street between Quincy Street and smythe
Street in the City of Plainview, Texas.
Ordinance No. 75-1907, an ordinance repealing Ordinance No.
70-1081 which said ordinance provided for two hour parking
on that portion of 14th Street lying between Smvthe Street
and Travis Street in the City of Plainview, Texas.

MINUTES CITY COUNCIL REGULAR MEETING
The City Council of the City of Plainview met in special session at 7:30
p.m. in .the Council Chambers of the City Hall with Mayor John D. Stoneham pre-
siding and the following Alderman present: Keltz Garrison, Medlin Carpenter,
Neal Williams, Jeane Browning and Tom Almon.
Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney,
M. L. Rea-City Clerk, Wm. R. Hogge-Director of Public Works, Harold Gladman-
Director of Planning, Johnnie Ballew-Director of Public Safety, Norman Huggins-
Director of Finance, Bill Rogers-Park Supervisor, Robert Ratcliff-Area Traffic
Specialist, Mike McGregor-Administrative Assistant and Emma Quintanil!a-Admin-
istrative Secretary. Also presen~ were Richard Orr-Plainview Daily Herald,
Chuck Martin-KVOP .Radio, Charles Bechtold-KAMR in Amarillo, Robert D. Barnett-
Central Plains Community Action, D. W. Henry, Ron Stoneham, Bill Dillar, Hugh
V. Smith, Cheryl Dickerson, Kent Akin and Richard E. Cross.
Invocation was given by Medlin Carpenter.
The Mayor presented certificates of appointments to Mr. Richard Cross and
Mr. Kent Akin, who were appointed to the City of Plainview's Board of City De-
velopment. A third appointee, announced by Mayor Stoneham, was Mrs. Martha Pitts.
It was moved by Alderman Williams, seconded by Aider~nan BroWning, to accept these
appointees. Motion carried unanimously.
Open Public Hearing on Zone Case No. 280, request of D. W. Henry for rezoning
a tract of land 120 feet x 863 feet out of Section 28, Block JK-2, from an R-1
Zone to a R-3 Zone for Multi-family use, located at 405 Ennis. After discussion,
Public Hearing was closed. It was moved by Alderman Carpenter, seconded by Alderman
Garrison, to adopt Ordinance No. 76-19.15, amending the Zoning Map of the City of
Plainview. Motion carried unanimously.

After some~discussion, Public Hearing was closed. It was moved by Alderman Gar-
rison, seconded by Alderman Williams, to adopt Ordinance No. 76-1916, amending
the Zoning Map of the City of Plainview. Motion carried unanimously.
Open Public Hearing on 1976 Community Development Act for funding for 1976.
After some discussion on the grant application, the Public Hearing was closed.
It was moved by Alderman Garrison, seconded by Alderman Carpenter, to submit the
application along with a resolution. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Almon, to award the
bid to Unistrut Texas, Inc., Lubbock, Texas, for the purchase of 400 - 10 foot
traffic sign poles, 400 - 18 inch anchor poles, 400 - 30 inch poles, 1,000 - 3/8"
x 7/16" rivetts and 1,000 8/8" x 1/2" rivetts. Motion carried unanimously.
A reminder of bids to be received on water works materials for Community
,Development Grant and inventory on the 20th of January, 1976.
A reminder of the aerial spray contract for-Vector Control for 1976 and four

It was moved by Alderman Williams, seconded by Alderman Browning, to approve
the minutes of the regular City Council meeting held on December 28, 1975. Motion
carried unanimously.

The study of Ordinance No. 74-1465, providing for the monthly adjustment in

was taken.
NO action was'taken at this time on an industrial park at the Plainview/
Hale County Airport. Will continue the study.
No action was taken at this time -for an industrial park as recommended by
the Plainview Industrial Foundation for the Gebo Company warehouse.

March 1st.
It was moved by Alderman Garrison, seconded by Alderman Browning, to continue
the study of ordinances and/or contracts, recommended by Mr. Bob Ratctiff, con-
cerning no parking on Quincy Street, from 19th to 24th Street; and establishing
speed zones on Quincy Street located between State Highway 194 and U. S. Highway
87. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Carpenter, to approve
introduction of Ordinance No. 75-1910, an ordinance amending Ordinance No. 65-865
of the City of P.lainview, by deleting from said Ordinance the definition of "at

It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve
introduction of Ordinance No. 76-19~2, an ordinance providing for standards and

tion to be held on April 3, 1976, for election of a ~ayor and Aldemman for Place
1, 3 and 5. Motion carried unanimously.
It was moved by Alderman Browning, seconded by AldermanAlmon, to adopt
Ordinance No. 75-1906, an ordinance amending Ordinance No. 65-900 as amended by

It was moved by Alderman Garrison, seconded by Alderman Carpenter, to adopt
Ordinance No~ 75~1908, an ordinance repealing Ordinance No. 69-1035 which said

Portland and Quincy Streets in the City of Plainview~ Texas. Motion carried un-

It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt
Ordinance No. 75,1909, an ordinance repealing 0rdinanee No. 74-1626 which said
Ordinance provided for two hour parking on the West Side of that portion of Smythe
Street lying between West 13th and West 16th Streets in the City of Plainview,
Texas. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Garrison, to adopt

It was moved by Alderman Williams~ seconded by Alderman Garrison, to approve

Motion carried 2 in favor and 2 against and 1 abstained. Mayor Stoneham voted in
favor.

The Annual Audit report on the Canadian River Municipal Water Authority
is still a hold item until the City's questions are answered.
It was moved by Alderman Garrison, seconded by Alderman Almon, to
aufthorize the City Attorney to prepare a rate Ordinance, similar to Amarillo's
Ordinance 4444, concerningstreet lighting rates~. Motion~ carried unanimous-
ly. ~
It was moved by Alderman Almon, seconded by Alderman Browning, to acceU~
the resignation of Mr. Cliff Tuttle, as a representative of the Traffic Safety
committee and appoint Mr. Melvin Raines, as nominated by the Committee. Motion
carried unanimously.

It was moved by Alderman Almon, seconded byAlderman_'Williams, to decline
the mequest from the Plainview Bulldog Booster Club for use of City's equipment,
since the request was also declined of the Plainview Municipal Country Club to
donate the City's employees and equipment. Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Williams, to authomize
Joe Sharp, City Attorney, to .acquire information from the U. S..Attorney General's
Office regarding the election and voting rights of the City of Plainview. Motion
