HEARING VISITORS PRESENT:
Any person is invited to attend meetings of your City Council to
discuss matters of individual concern, to present and discuss
proposals, to participate in public hearings, or to be a visitor.
If you are present to appear before the City Council for any item
on the agenda, please advise the City Clerk and you will be heard
at the earliest convenience. Should you have an item you want to
appear on the agenda, please make your request known in writing
to the Mayor or City Manager at least one week in advance of the
regular City Council meetings held on the second and fourth Tuesday
o~each month. Your presence is appreciated and you are invited
to attend any part or all of the City Council meetings.
ArtiCle 6252-17, V.T.C.S., the Open Meeting Law, was revised effect-
ive September 1, 1975, to require: (1) Notice of any meeting to be
posted in a public place readily accessible to the general public
at all times; the City Council of the City of Plainview has authorized
the posting to be in the Plainview City Hall and the Plainview Police
Department reception area, which is readily accessible to the general
public at all times, and (2) any additional subject not previously
included on the published and posted agenda shall be accompanied by a
statement describing the nature of the urgent public necessity re-
quiring their addition to the agenda. The policy of ~he City Council
of the City of Plaihview, is that no additional items will be included
on the published agenda later than 4:00 p.m., Thursday preceding the
Council Meeting unless accompanied by a statement describing the
nature of the urgent public necessity, requi~ing the addition to the
agenda.

and recommendations made by the Mayor on various authorities, boards,

1. Recommendations for appointments to the Community and Neighborhood
Improvement Committees as recommended by the Mayor and City Council.

Development by-laws prohibit any appointees from succeeding

commended by Mr Bob Ratcliff, concerning no parking on Quincy
Street, from 19th to 24th Street.

Quincy Street, located between State Highway 194 and U. S.

Zoning Ordinance, an ordinance by the provisions of Article 1011a
revised Civil Statutes of Texas establishing zoning regulations
and districts in accordance with a comprehensive plan and within
such districts regulating the use of land, building and structures;
the height, bulk and locations of buildings; establishing minimum
requirements for off-street parking; regulating the erection, re-
pair and alternation ofall building and structures; providing for
specific use permits for certain uses; reco.gnizing non-conforming
uses and structures and rules for the regulation thereof; creating
a board of adjustment and providing rules and regulations for its
organization, proceedu~e, jurisdiction and powers; setting forth
the requirements for building sites and the manner of their crea-
tion; providing for a certificate of occupancy and compliance; de-
fining certain terms; adopting a zoning district map and making it
part of this ordinance, making all figures, letters, m'arkings,
symbols and charts contained in said ordinance or shown on the map
a part of such ordinance; providing a method for amending such
ordinance; providing a penalty for violation of the provisions
of such ordinance not to exceed $200.00 for each violation; also
providinginjunctive relief to persons affected by the violations
of samd Ordinance; and providing a saving clause.

An ordinance prescribing rules and regulations governing plats,
plans and sub-divisions of land within the incorporated area of
PZainview, Texas, herein defined as the "City"; containing cer-
tain definitions; providing for a preliminary plat, a final plat,
and providing for final approval of sub-divisions by sections;
prescribing regulations for streets, sidewalks, alleys, sanitary
utilities, and co~unity facilities.
Providing for a penalty of not more than two~undred ($200.00)
dollars for each violation thereof; repeal, ingall conflicting
ordinances; providing a validity clause; and providing an ef-
fective date.
Whereas, under the provisions of the Constitution and laws of
the State of Texas, including particularly Chapters 231, Acts
of the 40th~Legislature, Regular Session, 1927, as heretofore

and provisions of Section 4 of the Municipal Annexation Act
(compiled as Article 970a), as heretofore or hereafter amended,
hereafter every owner of any tract of land situated within the
the City of Plainview; who may hereafter divide the same in
two (2) or more tracts described by metes and bounds or other-
wise for the purpose of laying out ~ny subdivision or such tract
of land or any addition to and purchasers or owners of lots
f~ronting thereon or adjacent thereto, are required to submit
a plat of such sub-division or addition for approval by the
Planning Commission of the City of Plainview; and
Whereas, the rules and regulations of the City established by
Ordinance, governing plats and sub-divisions of the land, be
and the same are hereby extended to and shall apply to all of
the area under the extraterritorial jurisdiction of said city,
as p~ovided for in the Municipal Annexation Act, enacted by
the State of Texas and which appears as Article 970a, Vernon's
Annotated Civil Statutes.
NOW THEREFORE, BY IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF PLAINVIEW, TEXAS,
On and after the passage of this Ordinance, any person, firm or
corporation seeking approval of any plat, plan or replat of any
sub-division of land within the City of Plainview, Texas, and its
legally established extraterritorial jurisdiction shall be required
to comply with the requirements of this Ordinance .before such
approval may be granted, to-wit:
Ordinance No. 76- , an ordinance~amending schedule of rates
approved by the'City Council of the City of Plainview; approving
and ~establishing rates for electric energy to be supplied for a
Municipal street lighting service to the City of Plainview.
Receive for consideration, discussion and adoption of ordinances pre-
viously introduced:
Ordinance No. 76-1913, an ordinance calling and setting the Mun-
icipal Election for the City of Plainview, to be held on the 1st
Saturday, April 3, 1976, for election of Mayor and Councilman for
Place 1:3 and 5.
Ordinance No. 76-1912, an ordinance providing for standards and
quality of effluent water, entitled "City of Plainview Industrial
Waste Ordinance."
Ordinance No. 76-1910, an ordinance amending Ordinance No. 65-865
of the. City of Plainview, by deleting from said Ordinance the
definition of "at large" as contained in Section I of said Ordi-
nance.

MINUTES CITY COUNCIL REGULAR MEETING
The City Council of the City of Plainview met in special session at 7:30
p.m. in the Council Chambers of the City Hall with Mayor John D. Stoneham pre-
siding and the following Alderman present: Keltz Garrison, Medlin Carpenter,
Neal Williams, Jeane Browning and Tom Almon.
Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney,
M. L. Rea-City Clerk, Wm. R. Hogge-Director of Public Works, Harold Gladman-
Director of Planning, Johnnie Baltew-Direc~Or of Public Safety, Norman Huggins-
Director of Finance, Bill Rogers-Park Supervisor, Robert Ratcliff-Area Traffic
Specialist, Thomas Stephens-Municipal Judge and Emma Quintanilla-Administrative
Secretary.
Also present were Richard Orr~Plainview Daily'Hemald, Bill Bruder-KKYN Radio,

Mayor Stoneham presented the certificate of appointment to Mrs. Martha
Pitts, who was appointed to.the Board of City Development.
It was moved by Alderman Garrison, seconded by Alderman Williams, to
accept the resignation of Mr. Bob Voelker:from the Planning and Zoning Com-
mission. Motion carried unanimously.
It was moved by Alderman Bro~ing, seconded by Alderman Carpenter, to
reappoint to the Planning and Zoning Commission, Mr. Bill Dillard and Mr. H.
C. Weaver. Motion carried unanimously.
Mr. Jess West, Chairman of the Central District Business Advisory Com-
mittee, recommended to enlarge the committee for a wider distribution of
talents by appointing David Wilder, Dan Stovall, Clee Meharg, Jimmy Sherman
and Vernon Clem to the committee. It was moved by Alderman Williams, seconded

by Alderman Almon, to accept these recommendations to the Central District
Business Advisory Committee. Motion camried unanimously.
It was moved by Alderman Garrison~_seconded by Alderman Browning, to
reJ.ect the bi.d of The Rohan Company, for 2" cast iron pipe, Item la of Sec-
tion i as being too costly. Motion carried unanimously.
The staff recommendation was that the bid on the Community Development
Program, in the amount of $30, 838.95, be awarded to Industrial International
and that the City's inventory and stock be awarded to Industrial International
, in the amount of $15,803.62. Also, the bid for fire hydrants on the Com-
munity Development Program, in the amount of $3~049.20 be awarded to Clowe $
Cowan and that the City's inventory and stock be awarded to Clowe g Cowan, in
the amount of $2,494.80. This making a total award of $52,186.57 of which
$33,888.15 on the Community Development Prog~amand $18,298.42 on the City's
inventory and stock. It was moved by Alderman Carpenter, seconded by Alderman
Garrison, that we approve this recommendation and that all items except fire
hydrants be awarded to Industrial International Inc. based upon its net total
low bid price of $46, 642.57 and that Item 12 of Section IV, fire hydrants,
be awarded to Clowe & Cowan, Inc. based upon their best bid of $5,544.00 for
M g H Fire Hydrants. Motion carried unanimously.
It was moved by Alderman Williams, seconded by Aldemman Browning, to award
thebidl to' MOsquito Control of the Southwest,.Plainview, Texas, for vector con-
trol, aerial spray for 1976 and 4 (four) I year options at 14.4 cents per acre.
Motion carried unanimously.

prove the minutes of the regular City Council meeting held on January 13, 1976.

ordinance establishing election precincts for Municipal Elections in the City

It was moved by Alderman Browning, seconded by Alderman Williams, to adopt
Ordinance No. 76-1921, an ordinancecalling and setting the regular Municipal
Election for the City of Plainview to be h61d on the first Saturday in April of
1976, the same being the third day of said month, for the Election of (i) Mayor
for the City of Plainview; (2) for the election of one Alderman for Place One on
the City Council of the City of Plainview; (3) for the election of one ~!derman
for Place-Three on the City Council of the City of Plainview; and (4) for the
election of one Alderman for Place Five on the City Council of the City of Plain-
view; designating the place Where said election is to be held; and appointing pre-
siding officials thereof. Motion carried unanimously.

Received for filing, letter from Canadian River Municipal Water
Authority, showing adjustments to fixed cost to operation and maintenance
of the Authority's facilities for the fiscal year ended September 30, 1975,
showing adjustments for fiscal year 1974-75.
It was mo~zed by Alderman Garrison, seconded by Alderman Carpenter, to
decline the offer of Mr. J. D. Spann, for the metal clad warehouse building
located at Frisco Park. The City Tax Department appraised the property at
$700 (seven hundred dollars) and Mr. Spann's offer was $350 (three hundred
dollars). Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Williams, to
authorize the City Manager to notify Woods $ Davenport Agency, that the City
does not wish to declare any part of Lot 8 g 9, Block 20, McClelland Addition
surplus, Motion carried unanimously.
Discussion was held on a date for Service Center Open House. A day in
May was discussed, giving the weather conSideration.
It was moved by Alderman Browning, sleconded by Alderman Williams, to
accept the proposed rate amendment of BlUe-Cross Blue Shield for increased
premium. Motion carried unanimously.
It was moved by Alderman Garrison, sieconded by Alderman Almon, to accept
for filing, the City Of Plainview Audit ~or the fiscal year ending September
30, 1975, and authorize publication of the consolidatedfinanciaI statement.
Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Garrison, to
accept proposed assessment paving program for 1976, declaring such streets a
necessity and authorizing the Engineer to prepare the plans and specifications;
and authorizing the City Attorney to prepare an ordinance. Motion carried un-
animously.

January 31, 1975.
It was moved by Alderman Williams, seconded by Alderman Carpenter, to
authorize the filing of the 2~%' Weed Assessment for the year 1975, in the
amount of $680.50. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Garrison, to
appmove the Annual pemmlt for loading zones for 1976. Motion carried unan-
imously.
Continued for study is the proposed Firemen's Training Coumse.
The Administrative and Supervisory Training Course will be every Wednesday
from 4:00 p.m. to 6:00 p.m. until March 31st.
A reminder of the 'City of Plainview's 9th Annual Employees Banquet, 8:00

granted an extension of 8 (three) to 4 (four) weeks.

It was moved by Alderman Carpenter, seconded by Alderman Almon, to accept
for filing, the departmental reports. Motion carried unanimously.

The meeting was called to order by Mayor Stoneham at 9~40 p.m..
It was moved by Alderman Almon, seconded by Alderman Browning, that the
application from the Community Action Program, which the Mayor is to sign, be
tabled for further study and discussion. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Almon, that the
meeting be adjourned. Motion carried unanimously. Meeting over at 10:15 p.m..
