City Council Chambers 901 Broadway Plainview, Texas CITY COUNCIL AGENDA INVOCATION: Billy Rogers HEARING VISITORS PRESENT: Any person is invited to attend meetings of your City Council to discuss matters of individual concern, to present and discuss proposals, to participate in public hearings or to be a visitor. If you are present to appear before the City Council for any item on the agenda, please advise the City Clerk and you will be heard at the earliest convenience. Should you have an item you want to appear on the agenda, please make your request known in wmiting to the Mayor or City Manager at least one week in advance of the regular City Council meetings held on the second and fourth Tues- day of each month. Your presence is appreciated and you are in- vited to attend any part or all of the City Council meetings. Article 6252-17, V.T.C.S., the Open Meeting Law, was revised Sept- ember 1, 1975, to require: (1) Notice of any meeting to be posted in a public place readily accessible to the general public at all times; the CiTy Council of the City of Plainview has authorized the posting to be in the Plainview City Hall and the Plainview Police Department reception area, which is readily accessible to the gen- eral public at all times, and (2) any additional subject not pre- viously included on the published and posted agenda shall be ac- companied by a statement describing the nature of the urgent pub- lic necessity requiring their addition to the agenda. The policy of the City Council of the City of Plainview, is that no additional items will be included on the published agenda later than 4:00 p.m., Thursday preceding the Council Meeting unless accompanied by a state- ment describing the nature of the urgent public necessity, requiring the addition to the agenda. VII. AUTHORIZATION FOR STUDY, PREPARATION, INTRODUCTION AND ADOPTION OF OR- DINANCES, RESOLUTIONS AND PROCLAMATIONS: A. ADOPTION June 1976 Zoning Ordinance, an ordinance by the provisions of Article 101la, revised Civil Statutes of Texas establishing zoning regulations and districts in accordance with a comprehensive plan and within March 9, 1976 Page STUDY FOR 2. ADOPTION July 1976 De PLAINVIEW CITY COUNCIL REGULAR MEETING such districts regulating the use of land, building and structures; the height, 'bulk and locations of bui'ldings; establishing minimum requirements for off-street parking; regulating the erection, re- pair and alternation of all building and structures; providing for specific use permits for certain uses; recognizing non-conforming uses and structures and rules for the regulation thereof; creating a board of adjustment and providing rules and regulations for its organization, preceedure, jurisdiction and powers; setting forth the requirements for building sites and the manner of their creation; providing for a cemtificate of occupancy and compliance; defining certain terms;'adopting a zoning district map and making it part of this ordinance, making all figures, letters, markings, symbols and charts contained in said ordinance or shown on the map a part of such ordinance; providing a method for amending such ordinance; pro- viding a penalty for violation of the provisions of such ordinance not to exceed $200 for each violation; also providing injunctive re- lief to persons affected by the violations of said ordinance; and providing a saving clause. An ordinance Df, scribing rules and regulations governing plats, plans, and sub-divisiens of land within the incorporated area-of Plainview, Texas, herein defined as the "City"; containing certain~definiti~ns providing for a preliminary plat, a final plat, and providing for final approval of sub-divisions by sections; prescribing regulations for streets, sidewalks, alleys, sanitary utilities and community facil- ities. Providing for a penalty ofnot more than $200 for each violation thereof; repealing all conflicting ordinances; providing a validity clause; and providing an effective date. MINUTES CITY COUNCIL REGULAR MEETING The City Council of the City of Plainview met in special session at 7:30 p.m., in the Council Chambers of the City Hall with. Mayor John D. Stoneham presiding and the following Alderman present: Keltz Garrison, Medlin Carpenter, Neal Williams, Jeane Browning and Tom Almon. Also present were Marshall Pharr-City Manager, M. L. Rea-City Clerk, Harold Gt~Lm~Director-of Planning, William R. Hogge-Director of Public Works, Norman Huggins~Director of Finance, Johnnie Ballew-Director of Public Safety, Bill Rogers~ Park-Supervisor~and Emma Quintanilla-Administrative Secretamy. Also present were Richard Orr-Plainview .DailyHerald, Don Richards-Plainview Reporter News, Chueh Martin-KVOP Radio, Bill BrudeP-KKYN Radio, Charles Bechtold- KAMR in Amarillo, Tut Tawwater-Chairman of Parks, Open Space g Recreation Committee, Dorothy TuWwater, Mary Garrison, Gina Garrison, Mr. & Mrs. Glen Johnson-State High- way Department, Charlotte Seay-Jaycees-ettes, Karon Rogers-Jaycees-ettes, Bob Landmy- Parks Committee, Mildred Walker-Hospital Auxiliary, Mms. Received recommendations for appointments to the City of Plainview Tax Equaliza- tion Board for 1976, which were the following: Ralph V. Graham, Joe Ed Sullivan, Jerry Wofford and Eldon Gouldy-Alternate. It was moved by Alderman Carpenter, seconded by Alderman Williams to approve these recommendations. Motion carried unanimously. Mr. Glen Johnson, representing the Texas State Highway and Transportation Depart- ment, was present to discuss and propose the City of Plainview's Urban System Map. This map was left for the City.~d~Plainview's consideration and discussion to be brought up at the next City Council meeting. Mr. Johnson requested that if it was considered for approval, that the Mayor send ~ letter stating that it was approved cooperatively. Motion carried unanimously. Received for filing, copies of the minutes of the Housing Authority meeting held February i7th, Charitable Solicitations Commission meeting held February 19th and re- cessed to February 20th, Parks, Open Space & Recreation Advisory Committee meeting held Febmuary 23rd, Board of Adjustment meeting held February 23rd and Planning Board and Zoning Commission meeting held February 26th. The study of Ordinance No. 74-i465, providing for the monthly adjustment in the rates charged for the sale of natural gas services will continue. No action was taken at this time. The study on an industrial park at the Plainview/Hale County Airport will contin- ue. No action was taken at this time. The study O~ an industrial park, as recommended by the Plainview Industrial Found- ation, for the Gebo Company warehouse will continue. No action was taken at this time. It was moved by Alderman Carpenter, seconded by Alderman Garrison, to remove from consideration, Item 4 (four), under Section VII (seven), which reads, "study or author- ize the City Attorney to prepare an ordinance regulating the use, installation and standards for burglar and fire alarm systems in Plainview." It is being removed be- cause work is b~ing done in other quarters of this Ghat will be helpful at a later date. Motion carried unanimously. A Zoning Ordinance, an ordinance by the provisions of Artilce 1Olla, revised Civil Statutes of Texas establishing zoning regulations and districts in accordance with a comprehensive plan and within such districts regulating the use of land, building~ and structures; etc., is still under study. An ordinance will be ready for introduc- tion in June, 1976. An ordinance will be ready for introduc- tion in Jitly, 1976. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appro- priation Ordinance No..76-1932~ from Revenue Sharing Account 427-816, in the amount of $1,536.75 payable to State Treasurer of Texas for City of Plainview's participation in automatic grade crossing device at intersection of 24th Street and Highway 194. Motimn carried unanimously. It was moved by Alderman Garrison, seconded by Alderman Browning, to adopt Appro- priation Ordinance No. 76,193--3, frDm Revenue Sharing Account ~27-816, in the amount of $1,301.00 payable to South Plains Association of Governments for payment in full for Item 86 & 88, Police radio equipment. Motion carried unanimously. It was moved by Alderman Williams, seconded by Alderman Garrison, to suspend any rule requiring Resolution and Order No. R76L063 to be read more than one time or at more than one meeting. Motion carried Unanimously. It was moved by Alderman AlmOn, seconded by Alderman Carpenter, to adopt Resolu- tion No. R76-063, a resolution calling for an election on April 3, 1976, for a Bond proposal in the amount of $550,000 for park purposes. Motion carried unanimously. (Original Resolution attached to Original Minutes) It was moved by Alderman Carpenter, seconded by Alderman Almon, to bring up for discussion or untable, the accoua~ing practic~ ~for the Community Action Program. Motion carried unanimously. After a lengthy discussion, it was moved by Alderman Williams, seconded by Alder- man Garrison, to send in the application signed by the Mayor. MOtion carried 3 (three) for and 2 (two) against. Motion carried unanimously. It was moved by Alderm~n Carpenter, seconded by Alderman Williams, to approve for filing, the City of PlainView's Schedule of Compliance to the Texas Water Quality Board Enforcement Hearing Order for improvements to the sewage treatment plan. Motion car- ried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to acknowledge the application to the U.S~ Attorney General for election authorization for the April 3rd Municipal Election for Mayor, three Alderman and Park Bond Issue ElectiOn. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Williams, to authorize the City Manager to sign the application received for membership and electric service for the MBPXL building. Motion carried unanimously. Receivedfor consideration and discussion, request of the Plainview/Hale County Health Department for capital impmovements to the facility, as requested by Dr. Gerald W. Wagner, M.D. Director. It was moved by Alderman Carpenter, seconded by Alderman Garmison, to approve the making of an Appropriaton Ordinance in the amount of $60.00 since the County will pay the other half or $60.00. Motion carried unanimously. It was moved by Alderman Garmison, seconded by Alderman Browning, to authorize the Mayor to sign the application, approving a safe ksepings~contract for depository guarantee in the amount of $60,000. Motion carried unanimously. (2) Community Development Grant Application - same (3) Community Devet6pm~n~-'~Grant Progress A. Cumry Lake Project - are in agreement with Bob Road, an appraiser from Ama~itlo who did' the work on the Land Acquisition Act of 1969, and he has been in contact with Luther Bain.on the project. He is ~lso doing the Land Acquisition on the airport. This is a time con- sumingproject. B. 1976 Assessment Paving Program - April. 20, 1976 Will be the bid letting. The bid document is abbut 3 lbs. more. C. Utility Extensions - materials have been received and are proceed- ing with ihstallations. (4) Running Water Draw Flood Control Project - met with two engineers,'Mayor, MarShall and Bill Hogge. Assured of federal funding. (5) Section 8 Housing Application - same (6) Texas Water Quality Board Applicat~'on- has been reviewed and has been accepted at this meeting earlier. (7) ERA Inc. Negotiations - set up meeting with Bob Fleming of the Texas Water Quality Board. (~8) State Highway 194 - April 5 is ~he bid letting. Lyn Hughes is helping with the project. (9) Interstate 27 -..working on primarily appraisals. (10) U. S. Highway 70 - still funded and approved. (11) Codification of Ordinances - no change (12) Flood Insurance - no change (13) Economic DevelOpment Application - still attempting to get the Governor to sign the letter. Talked to Bill Clayton but no action taken yet. (14) MBPXL Building - transfering electrical services to us. Service Center OPen House - around the 10th or 11th of April, 1976. It will be after the new Alderman and Mayor are elected and the old officials leave. (16) 1976-77 Budget - drawing up the format and guidelines. (18) Voting Rights Act - has gone in (i9) Zoning Ordinance Adoption P~oceedure - are waiting on Joe Sharp to prepare the adoption proceedures. A new item to be added on is the EOC, which will meet at $:00 p.m., on March 11, 1976. It was recommended that Norman Huggins-Director of Finance, furnish a report on the fund activity to each bank. It was moved by Alderman Carpentem, seconded by Alderman Williams, to accept the Departmental Reports for filing. Motion carried unanimously. It was moved by Alderman Garrison, seconded by Alderman Browning, to canvas the votes on the Municipal Election at the Regular Work Session on April 8, 1976. Motion carried unanimously. Keltz Garrison-Mayor Pro Tem took over the meeting at 8:10 p.m., while the Mayor signed the necessary papers on the election for Joe Smith to take back to Lubbock with him tonight. The Mayor presided over the meeting again at 8:35 p.m.. It was moved by Alderman Carpenter, seconded by Alderman Williams., to adjoumn the meeting there being no further business.
