Providing for a penalty of not more than $200 for each vi61ation thereof; repealing all conflictin~ordinances; providing a validity clause; and providing an effective date. MINUTES CITY COUNCIL REGULAR MEETING The City Council of the City of Ptainview met in special session at 7:30 p.m., in the Council Chambers of the City Hall with Mayor John D. Stoneham presiding and the fol- lowing Alderman present: Keltz Garrison, Medlin Carpenter, Neal Williams, Jeane Brown- ing and Tom Almon. Also present were Marshall Pharr-City Manager, M. L. Rea-City Clerk, Joe Sharp- City Attorney, Hamold Gtadman-Director of Planning, William R. Hogge-Director of Public Works, Norman Huggins-Rirector of Finance, Johnnie Ballew-Director of Public Safety, Bill Rogers-Park Supervisor, Mike McGregor~Administrative Assistant and Emma Quintanilla- Administrative Secretary. Also present were Chuck Martin-KVOP Radio, Bill Bruder-KKYN Radio, Charles Bechtold- KAMR in Amarillo, David McDonald-Plainview William SoRelle, Ralph V. Graham, Joe Ed Su Stoneham, Ron Stoneham, Charles Couch~ Clee Service Company, Ed Self and Joe Michalik-C Invocation was given by Bill Hogge. Ed Self, representing the Charitable Solicitations Commission in place of Bruce Campbell-Chairman (had conflicting appointment) was present to discuss the recommended changes in the solicitations ordinance. Mayor Stoneham complimented the commission on the fine work they have done. Open'Public Hearing on Znne Case No. 285, request of Jesse R. Kidwell for rezoning of Lots 1 thru 5, Block A, Highway Addition, located in the 2700 Block of N. Columbia, from an R-2 Zone to a C-2 Zone for commercial use. It was moved by Alderman Carpenter, seconded by.Alderman Garrison, to close the Public Hearing. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Williams, to adopt Ordi- nance No. 76-1935, ~n ordinance amending the Zoning Map of t.he City of Plainview. Mo- tion carried unanimously. It was moved by Alderman Williams, seconded by Alderman Carpenter, to approve the minutes from the City Council regular meeting on March 9, 1976. Motion carried unani- moulsy. Receive for filing, copies of the minutes of the Plainview/H~e County Airport Board, Unger Memorial L~rary Advisory Committee, Housing Authority, Traffic Safety Com- mittee and C~ivit Defense Committee, The study of Ordinance No. 74-1465, providing for the monthly adjustment in the rates charged for the sale of natural gas services will continue. The study on an industrail park, as recommended by the Ptainview Industrial Found- ation, for the Gebo Company warehouse~will continue. No action was taken at this time. It was moved by Alderman Williams, seconded by Alderman Browning, to authorize the City Attorney to prepare amendments, as recommended, to the solicitations ordinance. Motion carried unanimously. March 23, 1976 Page 3 MINUTES CITY COUNCIL REGULAR MEETING It was moved by Alderman ~arrison, seconded by Alderman Browning, to authorize the City Manager to negotiate!on the Zoning Ordinance, establishing zoning regulation~ and districts in accordance with a comprehensive plan and within such districts regula- ting the use of land, buildings and structures, etc.. Motion carried unanimously. An ordinance prescribing rules and regulatimns governing plats, plans and subdiv- isions of land within the incorporated area of Plainview, Texas, herein defined as the "City"; etc., is still under study. An ordinance will be ready for introduction in July 1976. It was moved by ALderman Garrison, seconded by Alderman Carpenter, to adopt Appro- priation Ordinance No. 76-1934 from General Fund Unappropriated Surplus Account 611-652 in the amount of $60.00 t-ransferred to Health Department Account 652-803 for handwashing facilities. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Appropria- tion Ordinance No. UR225-76 from Sewer Revenue Bond Fund Account 426-8i0 in the amount of $2290.65 payable to Collie Electric for sewer lift stations and Water Reclamation Plant electrical improvements. Motion carried unanimously. Discussion on the request of City Attorney's opinion concerning accounting practices for the Community Action Program was.held. The City Attorney is waiting for further in- formation. Discussion was held on information received at the hearing between Hereford's City Council and Pioneer Natural Gas Company. Mayor Stoneham read a letter from Mr. Bill McMorries, P. E., in Amarillo, Texas. There will be a meeting in Austin and the City of Plainview will be represented. It was moved by Alderman Garrison, seconded by Alderman Williams, to authorize the agreement for miscellaneous services between the City of P.lainview and Mayor to sign an Parkhill, Smit~ & Cooper, Inc.. Motion carried unanimously. March 23, 1976 Page 4 MINUTES CITY COUNCIL REGULAR MEETING It was moved by Alderman Williams, seconded by Alderman Carpenter, to approve the agreement between the City of Plainview, Texas and Parkhill, Smith & Cooper, Inc. for engineering and planning services as set forth in the contract, dated November 1, 1975 and bearing designation CDB-1144-56 with the Texas Department of Community Affairs and the City of Ptainview in the form of contract as approved by Texas Department of Com- munity Affairs, letter dated March 9, 1976. Motion carried unanimously. The following traffic safety requests are still under study: (1) parallel parking, Austin Street, 700 & 800 Block (2) four way stop sign installation at Yonkers & llth, Joliet g llth (8) no parking - 1000 Block, west side, of Portahd Street (4) no parking - Ennis Street betWeen 1400 & 1800 Blocks Discussed information received from various citizens on the billing process of Plain- view Cable TV. Will study further as to the legality. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the request for installing a street light in the 8000 Block of West 10th. Motion carried unanimously. Received for filing, a copy of the Civil Defense information as submitted in the Civil Defense Simulation on March it, 1976. It was moved by Alderman Carpenter, secondedby Adlerman Garrison, to approve a policy concerning payroll deductions for group life policy. It was moved by Alderman Williams, seconded by Alderman Garrison, to approve the proposed City of Ptainview Urban System's Map~.and authorize the Mayor to sign it. Motion carried unanimously. It was moved-by Alderman Browning, seconded by Alderman Garrison, to approve the Street Lighting Contract as proposed by Southwestern Public Service Company. Motion carried unanimously. March 28, 1976 Page MINUTES CITY COUNCIL REGULAR MEETING Status reports on the following items: (1) 701 Comprehensive Master Plan - have begun (2) Community Development Grant Application - in consideration (3) Community Development Grant Process - A. Curry Lake Project - are pre- s~ding - Bob Rhodes B. 1976 Assessment Paving Program - same C. Utility Extensions - tied up on Quincy, (4) Running Water Draw Flood Control Project - have met with the Corp. of En- gineers - are getting outside engineers to come in and do the primarily engineering plan.. Published in the"Commerce Daily" paper. (5) Section 8 Housing Application - is complete - contract on hand - ready for signing by the Housing Authority (6) Texas Water Quality Board Application same (7) ERA Inc. Negotiations - Mayor and City Manager met with Bob Fleming, Grants Division on March 17, 1976 - along with Dr. Bob Farmer - President of ERA - discussed the funding and arc-assured of it. (8) State Highway 194 - construction should start on about April 5th, Turner Construction got the bid - appears that Hi-Plains might get the bid on the curb gutters and sidewalks. (9) Interstate 27 - same (10) U. S. Highway 70 - still a project (tl) Codification of Ordinances - same (12) Flood Insurance - got a 30 day extension (18) Economic Development Application - talked to John Jonak, from the Governor's Office and he is to call back~ (14) MBPXL Building - only change is that we are now receiving their electric bills. Service Center Open House - same (16) 1976-77 BudEet - have a schedule and first meeiing is MarCh 24th - com- pleted in June and ready for adoption in July (17) Housing Demolition Program - same (18) Voting Rights Act - same (19) Zoning Ordinance Adoption Proceedure - ready on April 9th.
