and structures; providing for specific use permits for certain uses; re-
cognizing non-conforming uses and structures and rules for the regulation
thereof; creating a board of adjustment and providing rules and regulations
for its organization, proceedure, jurisdiction and powers; setting forth
the requirements for building sites and the manner of their creation; pro-
viding for a certificate of occupancy and compliance; defining certain
terms; adopting a zoning district map and making it part of this or-
dinance~ 'making all figures, letters, markings, symbols and charts con-
tained in said ordinance or shown on the map a part of such ordinance;
providing a method for amending such ordinance; providing a penalty for
violation of the provisions of such ordinance not to exceed $200 for each
violation; also providing injunctive relief to persons affected by the
violations of said ordinance; and providing a saving clause.
An ordinance prescribing rules and regulations governing plats, plans-and
sub-divisions of land within the incorporated area of Plainview, Texas,.
herein defined as the "City"; containing certain definitions providing
for final approval of sub-divisions by sections; prescribing regulations
for streets, sidewalks, alleys, sanitary utilities and community facili-
ties.
Providing for a penalty of not more than $20.0 for each viblation thereof;
repealing all conflicting ordinances; providing a validity clause; and
providing an effective date.

The City Council of the City of Plainview met in regular session at 7:30 p.m., in
the Council Chambers of the City Hall with Mayor John D. Stoneham presidin~g 'and the fol-
lowing Alderman present: Keltz Garrison, Neal Williams, Medtin Carpenter, Jeane Browning.
and Tom Almon.
Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney,-M. L. Rea-

was present to discuss the proposed insurance coverage. It was moved by Alderman Almon,
seconded by Alderman Browning, to authorize continuation of meetings with the insurance
association. Motion carried unanimously.
Open Public Heaming on Zone Case No. 284, request of Bill Cookston for rezoning of
a tract of land 440.4 feet by 417.4 feet out of S.W. corner of Section No. 27, Block JK-2,
Hale County, Texas, containing 4.22 acres more or less, located in the 4600 Block of Olton
Road, from an R-1 Zone to a C-2 Zone for commercial use, After discussion, it was moved by
Alderman Carpenter, seconded by Alderman Williams, to close the public hearing. Motion car-
ried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Browning, to adopt Ordinance
No. 76-1940, amending the Zoning Map of the City of Plainview. Motion carried unanimously.

Open Public Hearing on Zone Case No. 2882 request of Lon Mitchell for rezoning of
Lots 14 and 15, Block 1, Allen Sub-division, located at 3010 Otton Road from a C-1 Zone to
a C-2 Zone, for commercial use. After discussion, it was moved by Alderman Carpenter, ~
seconded by Alderman Williams, to close the public hearing. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Garrison, to adopt Ordinance
No. 76-1941, amending the Zoning Map of the City of Plainview, with the restriction to be
placed on the property only the arcade in the C-2 Zone be permitted, any other use permitted
under a C-2 Zone would have to be approved by the Plainview Zoning & Planning Commission.
Motion carried unanimously.

It was moved by Alderman Almon, seconded by Alderman Carpenter, to adopt Ordinance
No. 76-1942, amending the Zoning Map of the City of Plainview. Motion carried unanimously.
Open Public Hearing on Zone Case No. 290, request of Earnest Ford for rezoning of
Lot 9, Block 1, Shepard-Couch Addition, located at 1006 W. 24th, from a R-2 Zone to a C-1
Zone for commercial use. After discussion, it was moved by Alderman Browning, seconded by
Alderman Garrison, to close the public hearing. Motion carried unanimously.
It was moved by Alderman Williams, seconded by Alderman Browning, to adopt Ordinance
No. 76-1943, amending the Zoning Map of the City of Plainview, with the following conditions:
that a six (6) foot solid screen fence be placed along the property line on the North and
East, that ingress and egress to the property, and shall comply to the requirements set out
by the City Engineer. Motion carried unanimously.

conded by Alderman Carpenter, to close the public hearing. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Williams, to reject the Zone
Change for the following reasons: (1) Change would influence living conditions in the neig-
borhood, (2) change would create excessive traffic in the neighborhood, (3) change would
create a public nuisance in the neighborhood, and (4) change would create an isolated dis-
~rict or spot zoning. Motion carried unanimously.
Open Public Hearing on Zone Case No. 293, request of Lonnie Allsup for rezoning a

It was moved by Alderman Browning, seconded by Alderman Williams, to adopt Ordinance
No. 76-1944, amending the Zoning Map of the City of Plainview, with the following stipula-
tion: a six (6) foot solid screen fence be placed along the South, West and North property.
Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Williams, to approve the
specifications for post fencing of the Fire Training Field. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Almon, to authorize the
award of bids for installation of indoor-outdoor carpet'~in the basement of the Service Cen-
ter. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Garrison, to approve spec-
ifications and authorize bidding of pneumatic traffic counters for traffic count studies.

The study on an industrial park, as recommended by the Plainview Industrial Founda-
tion, for the Gebo Company warehouse will continue. No action was taken at this time.
A meeting will be set up between the Mayor, City Manager, City Attorney, Keltz
Garrison, Bob Wayland and members of the Charitable Soliditations Commission, to go over the
proposed changes to the ordinance.
The Zoning Ordinance establishing zoning regulations and districts in accordance
with a comprehensive plan and within such districts regulating the use of land, buildings
and stmuctures, etc., will continue.
An ordinance prescribing rules and regulations governing plats, plans and subdivi-
sions of land within the incorporated amea of Plainview, Texas, herein defined as the "City"
etc., is still under study. An ordinance will be ready for introduction in July.

Receive for filing, a letter from the Department of Housing and Urban Development,
dated March 26th, inviting the City of Plainview to file a full application for Community
Development Grant Assistance in the amDunt of $250,000. There were 251 cities that made ap-
plication and only 91 were approved. The City of Plainview was number 51.

Mr. Bill Gouldy, president of the Plainview Cemetery Association, concerning the paving at
