HEARING VISITORS PRESENT:

Any person is invited to attend meetings of your City Council to
discuss matters of individual concern, to present and discuss
proposals, to participate in public hearings or to be a visitor.
If you are present to appear before the City Council for any item
on the agenda, please advise the City Clerk and you will be heard
at the earliest convenience. Should you have an item you want
to appear on the agenda, please make your request known in writing
to the Mayor or City Manager at least one week in advance of the
regular City Council meetings held on the second and fourth Tuesday
of each month. Your presence is appreciated and you are invited to
attend any part or all of the City Council meetings.
Artilce 6252-17, V.T.C.S., the Open Meetings Law, was revised
September 1, 1975 to require: (1) Notice of any meeting to be
posted in a public place readily accessible to the general public
at all times; the City Council of the City of Plainview has author-
ized the posting to be in the Plainview City Hall and the Plainview
Police Department reception area, which is readily accessible to the
general public at all times, and (2'~Any additio-n~l.subject not previously
included on the published an~d'posted agenda shall be accompanied by
a statement describing the nature of the urgent public necessity re-
quiring their addition to the agenda. The policy of the City Council
of the City of Plainview is that no additional items will be included
on the published agenda later than 4:00 p.m., Thursday, preceding the
Council Meeting unless accompanied by a statement describing the nature
of the urgent public necessity requiring the addition to the agenda.

This is an emergency meeting of the City Council to discuss the acquisition
of the right-of-way on FM Highway 400, between the FM Highway 2286 and 24th
Street. To discuss and obtain the project channel easement and paving re-
quest on the above project. Discuss authority for the Texas Department of
Highways and Transportation to preceedw~th the project as proposed.

MINUTES OF THE CITY COUNCIL EMERGENCY MEETING
The City'Council of the City of Plainview met in an emergency meeting
at 4:00 p.m., in the City 'Council Chambers, of the City Hall~ with Mayor John
D. Stoneham presiding and the following Alderman present: Neal Williams, Med-
lin Carpenter, Jeane Browning, Tom Almon_and Lloyd Woods.
Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney,
M. L. Rea-City Clerk, Bill Bruder-KKYN Radio, Jim Daviszptainview RepOrter News,
Tut Tawwater-KVOP Radio~ Bill SoRelle, Bob Wayland, Keltz Garrison, Pat Kimbrew
and George McYickers.
Invocation was given by Lloyd Woods.
This emergency meeting was called by Mayor Stoneham for the City Council
to discuss the acquisition of the might-of-way on FM Highway400, between FM
Highway 2286 and 24th Street. It had been proposed by the property owners
following cancellation of the project that they were willing to negotiation
for the curb and gutter requirement and the sto~ and water drainage easement
as required by the State Highway Department. Following the discussion, the
meeting was recessed by a motion by Alderman Carpenter, seconded by Alderman
Neal Williams. Motion carried unanimously. Recessed until 6:00 p.m..
At 6:00 p.m., Mayor Stoneham reconvened the emergency meeting to receive
the proposal as submitted by George Mc~ickers, representing the Mc~icker's
Estate with regard to the proposed curb and gutter improvements and storm drainage
easement. Alderman Williams moved that the City Council go into executive session
to discuss the proposed right-of~.way acquisition at 6:45 p.m.. This motion was
seconded by Alderman Woods a~d motion carried unanimously.
At 7:20 p,m., the City Council reconvened f~om executive session and presented
the following proposal: To exchange the cost and curb and gutter for an easement
120 feet in width, the-~center linebeing that proposed by the Texas State Highway
Depart-ment as indicated on the Highway Department map, I.P.E.341 (FM 400) dated
April 29, 1976

January 81, 1975. This offer to expire at 10:00 a.m., April 30, 1976. The
above proposal was moved by Alderman Carpenter, seconded by Alderman Browning
and approved unanimously.
Alderman BrOwning moved that the emergency meeting be recessed until 8:30
a.m., April 30, 1976 so as to receive their answer or a counter proposal. Motion
was seconded by Aldemman Almon .and motion carried unanimously.
At 8:30 a.m., April 30, 1976, Mayor Stoneham reconvened the emergency meeting
on a motion by Alderman Woods, and seconded by Alderman Almon. Motion carried
unanimously. Council was advised by Mayor Stoneham that Alderman Browning had. been
in contact with Mr. J. E. McVickers and Brad Bayers and were advised that the offer
was unaccepted and no counter proposals were submitted. The Mayor and Alderman
Browning were advised that Should the heirs of McVicker's Estate should decide
Otherwise, they would contact Mayor Stoneham, prio,m to 8:30 a.m., April 80, 1976.
There being no response to the 8:30 deadline, Mayor Stoneham was advised to notify
District Engineer, George Wall, of the withdrawn of this project at I0:00 a.m. this
morning.
There being no other business, Al~derman Carpenter moved that the meeting be
adjourned. Motion was seconded by Alderman Browning and the meeting was adjourned
at 8:50 a.m. with motion carrying unanimously.
