HEARING VISITORS PRESENT: Ae Any person is invited to attend meetings of your City Council to discuss matters of individua~ concern, to present and dis- cuss proposals, to participate in public hearings or to be a visitor. If you are present to appear before the City Council for any item on the agenda, please advise the City Clerk and you will be heard at the earliest convenience. Should you have an item you want to appear on the agenda, please make your re- quest known in writing to the Mayor or City Manager at least one week in advance of the regular City Council meetings held on the second and fourth Tuesday of each month. Your presence is a-preeiated and you are invited to attend any part or all of the City Council meetings, Article 6252-17, V.T.C.S., the Open Meetings Law, was revised September 1~, 1975 to require: ~1) Notice of any meeting to be posted in a public place readily accessible to the general pub- lic at all times; the City Council of the City of Plainview has authorized the posting to be in the Plainview City Hall and the Plainview Police Department reception area, which is readily accessible to the general public at all times, (2) any additional subject not previously included on the published and posted agenda shall be accompanied by a statement describing the nature of the urgent public necessity requiring their addition to the agenda. The policy of the City Council 9f the City of Plainview is that no additional items Will be included on the published agenda later than 4:00 p.m., Thursday, preceding the Council Meeting unless accompanied by a statement describing the nature of the Urgent public necessity requi, ring the addition to the agenda. Receive for consideration, discussion and approval, the appointments and recommendations made by the Mayor on various authorities, boards, commissions and committees: Appoint representative to the City of Plainview Housing Authority to replace Bill SoRelle, upon his election to the City Council. Term to expire June, 1977. Receive for consideration, discussion-and acceptance, the resign- ation of Mr. Bob Henry to the Civil Defense Committee. Receive for consideration, discussion and approval, the Mayor's recommenda- tion to replace Mr. Henry with a term to expire in October, 1977. Receive for consideration, discussion and appointment, represent- atives to the City/County Health Board. These terms expire April, 1976. Those members whose terms expire are Dr2 C. M. AUTHORIZATION FOR STUDY, PREPARATION, INTRODUCTION AND ADOPTION OF ORDIN- ANCES, RESOLUTIONS AND PROCLAMATIONS: A. Discuss proposed ordinances and continue study or authorize the City Attorney to prepare: Study or authorize the City Attorney to prepare ordinances and/or contracts 'designating an industrial park at the Plainview/Hale County Airport. Study or authorize the City Attorney to prepare ordinances and/or contracts designating an industrial park as recommended by the Btainview Industrial Foundation and approved by the City Council for the Gebo Company Warehouse. Discuss recommendations of the City of Plainview Charitable Soli- citations Commission and authorize the City Attormey to prepare amendments as recommended and approved. Discuss recommendation and authorize City Attorney to prepare for introduction, an ordinance establishing maximum noise levels. B. Discuss and authorize introduction of the following ordinances: Zoning Ordinance, an ordinance by the provisions of Article 101la, revised Civil Statutes of Texas establishing zoning regulations and districts in accordance with a comprehensive plan and within such June 8, 1976 a~Page 8 STUDY FOR ADOPTION ON JULY 1976 Ce CITY COUNCIL AGENDA districts regulating the use of land, building and structures; the height, bulk and tocatinns of buildings; establishing minimum requirements for off-street parking; regulating the erection, repair and alternation of all building and structures; providing for specif$c use permits for certain uses; recognizing non-con- forming uses and stmuctures and rules for the regulation thereof; creating a board of adjustment and providing rules and regulations for its organization, proceedure, jurisdiction and powers; setting forth the requirements for building sites and the manner of their creation providing for a certificate of occupancy and compliance; ~efining certain terms; adopting a zoning district map and making it part of this ordinance; making all figures, letters, markings, symbols and~dharts contained in said ordinance or shown on the map a part of this ordinance; providing a penalty for violation of the provisions of such ordinance not to exceed $200 for each violation; also providing injunctive relief to persons affected by the viola- tions of said ordinance.; and providing a saving clause. An ordinance prescribing rules and regulations governing plats, plans and sub-divisions of land within the incorporated area of Plainview, Texas, herein defined as the "City"; containing certain definitions providing for final approval of sub-divisions by sec- tions; proscribing regulations for streets, sidewalks, alleys, san- itary utilities and community facilities. Providing for a penalty Of'not more than $200 for each violation thereof; repealing all conflicting ordinances; providing a validity clause; and providing an effective date. Receive for consideration, discussion and adoption, ordinances creating an emergency, first reading and second reading: Receive for consideration, discussion and adoption, Ordinance No. 76-1950, an ordinance setting the date,' time and place for a public hearing on the 1976 Assessment Paving Program and authorize the ad- vertisement of notice of same hearing; and declare an emergency. MINUTES CITY COUNCIL REGULAR MEETING The City Council of the City of Plainview met in regular session at 7:30 p.m., in the Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Alderman present: Jeane Browning, Tom Almon, Lloyd Woods and A. Wm. SoRelle, Jr.. Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney, M. L. Rea-City Clerk, William R. Hogge-Director of Public Works, Harold Gladman-Director of Planning, Johnnie Ba!lew-Director of Public Safety, Norman Huggins-Director of Finance, Mike McGregor-Administrative Assistant and Emma Quintanilla-Administrative Secretary. Also present were Richard Orr-Plainview Daily Herg~d, Jim Davis-Plainview Reporter News, Bill Bruder-KKYN Radio, Charles Bechtold-KAMR in Amarillo, Tut Tawwater-KVOP Radio, Mrs. George M. Smith, Jr. and Mrs. A. William SoRelte, Jr.. Invocation was given by J. Robert Wayland. It was moved by Alderman Browning, seconded by Alderman Woods, to appoint Joh~ Page, for a term to expire June, 1977, and replacing A. William SoRelle, Jr., upon his election to the City Council. Motion carried unanimously. (Housing Authority) It was moved by Alderman Browning, seconded by Alderman Woods, to reappoint Romey Fennell and Jack Payne to the Plainview Housing Authority. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to appoint Richard Watson to the Civil Defense Committee with a term to expire October, 1977. Motion carried unanimously. It was moved by Alderman SoRetle, seconded by Alderman Almon, to appoint Dr. Richamd Morgan to the City/County Health Board Motion carried unanimously. It was moved by Alderman SoRelle, Seconded by Alderman Almon, to reappoint Dr. C. M. Baldwin and Ray D. Blair~to the City/County Health Board. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Browning, to reappoint Mrs. Ruby Curry and David Willson to the Unger Memorial Library Advisory Board. It was moved by Alderman SoRelle, seconded by Alderman Browning, to r~appoint Jack Skaggs to the Canadian River Municipal Water Authority. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon to award the low bid to Diamond Shamrock Corporation in the amount of $11,894.40 for the asphalt bid. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman SoRelle to award the low bid to Hale Co.unty Sand & Gravel in the amount of $7,560.00 for gravel bid. Motion carried unanimously. It was moved by Alderman SoRelle~ seconded by Alderman Woods, to approve the minutes of the regular City Council meeting on May 25, 1976. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to receive for filing, copies of the following minutes: Parks, Open Space & Recreation Advisory Committee, Charitable Solicitations Commission, Board of Adjustment and the Planning Board & Zon- ing Commission. Motion carried unanimously. The study of an industrial park at the Plainview/Hale County Airport will continue. No action was taken at this time. The study of an industrial park, as recommended by the Plainview Industrial Founda- tion for the Gebo Company warehouse, will continue. No action was taken at this time. A date for a meeting between the Charitable Solicatat~onS Commission and the mem- bers appointed by the Mayor to study the solicitations ordinance is still pending. The study and preparation of establishing an ordinance on maximum noise levels is still under study. The Zoning Ordinance establishing zoning regulations and districts is accordance with a comprehensive plan and within such districts regulating the use of land, build- ings and structures, etc., is still under study and will be ready for adoption on August 19~ 1976. It was moved by Alderman Browning, seconded by Alderman Woods, to adopt Ordinance No. 76-1950, an ordinan'ce setting forth the date, time and place for a public hearing on the 1976 Assessment Paving Program and authorize the advertisement of notice of same hearing. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve of the Mayor's and Council,s assignments to the various authorities, boards, commissions and committees. Motion carried unanimously. A date was set for the special meeting to review and establish the City of Plain- view Priorities for the 70's, which is June 17, at 11:30 a.m., during the City Council's Work Session. Received for filing, a letter from the Texas Utility Commission concerning applica- tion for water and sewer operation. Received for filing, letter from the Fedemal Aviation Administration concerning the appraisals on 20 parcels of land for Clear zone acquisition. Received for consideration and discussion, notice of claim by Thomas Priolo for Alberto Resendes. Motion camried unanimously. Status Reports on the following items: 1. 701 Comprehensive Master Plan - extention till July 30th and we should have it prior to June 30th. 2. Community Development Grant Application - sent it in to HUD and public hearing on June 15th~. 3. Curry Lake Project - have appraisals and have notified owners. Next step is making them an offer. 4. 1976 Assessment Paving Program - July t3th Public Hearing. Section 8 Housing Application - talked to Jimmy Wilson, saw a film and Marshall Pharr read a letter from them. 6. ERA Inc. Negotiations - want a joint meeting with TWQB. 7. State Highway 194 - curb $ gutter 8. Zoning Ordinance - Sam Wyse submitted a proposal. 9. 16th Street Playa Lake - up for consideration in our sub-division regulation. It was moved by Alderman Browning~ seconded by Alderman Woods, to invite a repre- sentative o~f Parkhill, Smith g Cooper to attend the Friday morning meeting. Motion car- tied.
