Any person is invited to attend meetings of your City Council to discuss matters of individual concern, to present and dis- cuss proposals, to participate in public hearings or to be a visitor. If you are present to appear before the City Council for any item on the agenda, please advise the City Clerk and you will be heard at the earliest convenience. Should you have an item you want to appear on the agenda, please make your re- quest known iN writing to the Mayor.or City Manager at least one week in advance of the regular City Council meetings held on the second and fourth Tuesday of each month, Your presence is appreciated and you are invited to attend any part or all of the City Council meetings. Article 6252-17, V.T.C.S., the Open Meetings Law, was revised September 1, 1975 to require: (1) Notice of any meeting to be posted in a public place readily accessible to the general pub- lic at all times; the City Council of the. City of Plainview has authorized the posting to be in the Plainview City Hall and the Plainview Police Department reception area, which is readily accessible to the. general public at all times, (2) any additional subject not previously included on the published and posted agenda shall be accompanied by a statement describing the nature of the urgent public necessity requiring their additi~on to the agenda. The policy of the City Council of the City of Plainview is that no additional items will be included on the published agenda later than 4:00 p.m., Thursday, preceding the Council Meeting unless accompanied by a statement describing the nature of the urgent public necessity requiring the addition to the agenda. Ordinance No. 76-19§0, an ordinance approvin_g and adopting the written statement and report of the City Engineer, showing the estimates of the total costs of all the improvements, the esti- ma es of the costs per front foot proposed to be assessed against th abutting property, and the real and true owners thereof, and th estimates of various other costs for the improving of portions of Sundry streets in the City of Plainview, T~xas, within the linits hereinbetow described, and of-other matters relating there- of; determining and fixing the portion of said costs and the rate thereof proposed to be assessed against and paid by the abutting property, and the real and true owners thereof; and determining the amount of cost to be paid by railways using, occupying or crossing any portion of a specific unit to be improved; and assessing the entire cost of such improvement in the area between said railways or railroad companies rails and tracks, double tracks, turnouts and switches and two feet on each side Shereof; and determining that said amount shall be paid by said railway using, occupyin-g or crossing said~portion of a specific unit to be improved; determining the necessity of levying an assessment against said abutting property, and the real and true owners thereof for the portion of said costs apport~ioned to them; de~ termining the necessity of levying as assessment against railways using any portion of said streets to be improved the entire cost of such improvement in the area between their rails and tracks, double tracks, turnouts and switches and two feet on each side thereof; ordering and setting a hearing at 10:00 A.M. on the 15th day of July, 1976, in the Council Chambers of the~Ci~ty of Plainview, Texas, as the time and place for the hearing of the real and true owners of said abutting property and all others interested in said abutting property or in any of the proceedings and contract con- cerning said assessments, proceedings and improvements; directing the City Clerk of the City of Plainview, Texas, to give notice of said hearing as required by the laws of the State of Texas'and the Charter of the City of Plainview; declaring and providing that this ordinance shall take effect immediately upon its passage'. MINUTES CITY COUNCIL REGULAR MEETING The City Council of the City of Plainview met in regular session at 7:30 p.m., in the Council Chambers of the City Hall with Mayor J. Robert Wayland presiding~and the following Councilman present: Jeane Browning, Medlin Car- penter, Lloyd Woods, Bill SoRelle and Tom Almon. Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney, M. L. Rea-City Clerk, Harold Gladman-Director of Planning, Norman Huggins-Dir- ectdr of Finance, Johnnie Ballew~Director of Public Safety, Billy Rogers-Super- visor of P~rks, Mike McGregor-Administrative Assistant and Emma Quintanilla-Admin- istrative Secretary. Also present were Richard Orr-Plainview Dai.!y Hemald, Jim Davis-Plainview Reporter News, Bill Bruder-KKYN Radio, Charles Bechtold-KAMR in Amarillo~ Mr. & Mrs. C. W. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Ordinance No. 76'1954, amendin~g the Zoning Map of the City of Ptainview with the request of Mr. C. W. Rousser for rezoning of South 30 ft. of Lot 13, all of Lot 14, 15 and 16, Block 4, High School Addition, from an R-3 Zone to a C-1 Zone for commercial use, located at 1901-05 N. Quincy with the stipulation of a fence being built in the back. Motion carried unanimouslv. June 22, 1976 Page 2 MINUTES CITY COUNCIL REGULAR MEETING Reminder of the 1976 Assessment Paving Public Hearing on Thursday, July 15th, at City Hall, at 10:00 a.m.. It was moved by Alderman Carpenter, seconded byAlderman SoRelle, to award the bid of sale to Mr. and Mrs. Finch in the amount of $300.00 for the house located 'at 920 Austin Street. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to deny the request of Mrs. Jean Ola Williams, declaring surplus of Lot 2, N. 15' of Lot 3, Block 8, Wye Addition, and authorize the City to negotiate on buying land within the area. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to ap- prove the minutes of ~the regular City Council meeting held on June 8th. Motion carried unanimously. Received for filing, cop~es of the following minutes: Plainview Housing Authority~ Plainview/Hate County Airport Baard, Planning & Zoning Commission. The study and authorization of the City Attorney to prepare an ordinances and/or contract designating anindustrial park at the Plainview/Hale County Air- port is still under study~ The City Attorney has resubmitted information to SPAG. The study and authorization of the Cit~Attorney to prepare an ordinances and/or contract designating an industrial park as recommended by the Plainview I~ndustrial Foundation and approved by the City Council for the Gebo Company ware- house is still under study. The City Attorney and Mayor amc to meet.with the Charitable Solicitations Commissionto further discuss the ordinance sometime this week. Discussion was held on the ordinance establishing maximum noise control. Jeane Browning that the City Council check into the muffet of the bikes. The City Attorney will continue the study. An ordinance prescribing the rules and regulations governing plats, plans and subdivisions of land within the incorporated area of Plainview, Texas herein defined as the "City", etc., is Still under study. It was moved by Aldemman Almon, seconded by Alderman Woods, to accept the Ordinance No. 76-1950, on its seconded reading. Motion carried unanimously. It was moved by Alderman Browning, seconded by' Alderman Carpenter, to adopt Appropriation Ordinance No. 76-1952, from the City of Plainview Pro-rata con- struction fund 434, in the amount of $337.50, payable to Bond. Excavating Co. for payment of excavating sewer main trench to serve Westridge Unit No. 5. Motion carried unanimously. TUesday~ June 29th and Thursday, July 1st was set as dates :for the City Council to study the budget. / It was. moved by Aldemman SoRelle, seconded by Alderman Browning, to approve the revised Compliance Schedule as requried by the Texas Water Quality Board and Enforcement Order No. 75-37. Motion carried unanimously. It ~s moved by Alderman Almon, seconded by Alderman SoRelle, to authorize the City Attormey to prepare a rate ordinance, changing the charge of sewer rates from $3~50 to $4,50. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by-Alderman Woods, to appoint Parkhill, Smith. g Cooper as oum consulting engineers and make a study. Motion carried unanimously. _. Received for filing~ letter from Federal-Aviation Administration excepting the Airport Master Plan and recommending its adoption. A joint meeting between the City, County and Airport Board is being scheduled so as to discuss this. Motion carried tmanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve the request of the Downtown Merchants for a sidewalk sale scheduled for July 29, 1976. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to authorize the City Attorney to study the request of Wayland for street use per- mit and paving cutting permit for installation of underground sprinkler system for Wayland Baptist College campus. Motion carried unanimously. Status reports: 1. A. Curry Lake Project - received a letter from Faye Curr~ and Luther Bain accepting the proposed $29,000.00 for the property. It was moved by Alderman Browning, seconded by Alderman SoRelle, to approve the amendment to Resolution No. R74-015A, a resolution authorizing the City Man- ager to sign amended grant application for the Traffic Engineer to be shared 50% by the City of Plainview, 25% by the City of Brownfietd, and 25% by the City of Lamesa. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to accept the monthly report for filing and to adjoumn the meeting. Motion carried unanimous- ly.
