Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was
posted in City Hall at 2:40 p.m. on July 24, 2015. Mayor Wendell Dunlap presided.
Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2,
Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, and Eric
Hastey-District 7. Councilmember Lionel Garcia -District 6 was absent.
Staff members present were: Jeffrey Snyder -City Manager, Andrew Freeman -Assistant
City Manager, Leslie Spear Schmidt -City Attorney, Tim Crosswhite-Interim Director of
Public Works, Sarianne Beversdorf-Director of Finance, Rusty Powers -Fire Chief, Ken
Coughlin -Police Chief, Isauro Gutierrez -Information Technology Specialist, and Belinda
Hinojosa-City Secretary.

Councilmember Norma Juarez delivered the invocation and led in the pledge of
allegiance.
Mayor Pro Tem King moved to approve the consent calendar. The motion was duly
seconded by Councilmember Juarez and carried by unanimous vote. Items approved on
the consent calendar included the granting of an excused absence to Councilmember
Garcia; approval of the minutes of July 9, 2015 and July 14, 2015; and approval of the
financial reports.
Jeffrey Snyder, City Manager presented for consideration on first reading Ordinance No.
15-3622, an Ordinance Amending Chapter 8, Offenses and Nuisances, Article 8.02,
Nuisances Generally, Section 8.02.002, Illustrative Enumeration, of the City of Plainview,
Hale County, Texas; Cumulativeness Clause; Conflict Clause; Severability Clause; and
Effective Date. After reviewing the City's Code of Ordinance, staff believes it would be
best to clarify the Code and set forth the criteria defining illegal dumping within the city
limits of Plainview.
With this ordinance, illegal dumping is defined as the discarding or unloading of items that
constitute a nuisance at any place within the City limits except at a state permitted or
approved landfill or at such other place as may be designated by the City or the State.
With the newly installed cameras at the Columbia site, our Police Department has
stepped up efforts to slow the illegal dumping at this site. So far we have had some
success, but it is going to take some time to educate people not to use this site to discard
material other than recyclables and grass clippings. This Ordinance will assist our officers
in their enforcement of a no tolerance policy on the use of this site other than recycling.
Staff does recommend approval of Ordinance 15-3622 on first reading.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Blackerby moved to accept Ordinance No. 15-3622 on first reading. The
motion was duly seconded by Councilmember Hastey. Mayor Dunlap, Councilmembers
Williams, Juarez, King, Blackerby and Hastey voted "for" the motion. Councilmember
Starnes voted "against" the motion. The motion carried by unanimous vote.

Councilmember Williams moved to go into closed session to deliberate the appointment,
employment, evaluation, reassignment, duties, discipline or dismissal of a public officer
or employee, or to hear a complaint or charge against an officer or employee. [Tex. Gov't.
Code, Section 551.074]. Appointments to the following boards and commissions:
Runningwater Draw Retired & Senior Volunteer Program Community Advisory Group,
Building Trades/Fire Code Board of Appeals, and Canadian River Municipal Water
Authority Board. The motion was duly seconded by Councilmember Blackerby and
carried by unanimous vote.
Mayor Dunlap recessed the meeting at 7:35 p.m.
Mayor Dunlap called the meeting back in open session at 7:50 p.m.
Councilmember Starnes moved to adopt Resolution R15-341 naming Tyke Dipprey, a
qualified voter and a property owning taxpayer of the City of Plainview, who is not a
member of the governing body or an employee of said City, be and is hereby elected to
the Board of Directors of the Canadian River Municipal Water Authority for the term
beginning August 1, 2015 and ending July 31, 2017. The motion was duly seconded by
Councilmember Blackerby. Mayor Dunlap asked for public comment. There was no
public comment. The motion carried by unanimous vote.
Councilmember Starnes moved to appoint Sally Phillips to complete the unexpired term
of Minnie Ruth Rigler with said term to expire on December 2016 and to appoint Jeremy
Searsy to the Building Trades and Fire Code Board of Appeals with said term to expire
on January 1, 2019. The motion was duly seconded by Councilmember Williams. Mayor
Dunlap asked for public comment. There was no public comment. The motion carried
by unanimous vote.
There being no further business, Mayor Dunlap adjourned the meeting at 7:48 p.m.
