HEARING VISITORS PRESENT:

Any person is invited to attend meetings of your City Council
to discuss matters of individual concern, to present and dis-
cuss proposals, to participate in public hearings or to be a
visitor. If you are present to appear before the City Council
for any item on the agenda, please advise the City Clerk and
you will be heard at the earliest convenience. Should you
have an item you want to appear on the agenda, please make
your request known in writing to the Mayor or City Manager at
least one week in advance of the regular City council meetings,
held on the second and fourth Tuesday of each month. Your
presence is appreciated and you are invited to attend any part
or all of the City Council meetings.
Article 6252-17, V·T.C.S., the Open Meetings Law, was revised
effective September 1, 1975~.to require: (1) Notice of any
meeting to be posted in a public place readily accessible to
the general public at all times; the City Council of the City
of Plainview has authorized the posting to be in the Plainview
City Hall and the Plainview Police Department reception area,
which is readily accessible to the general public at all times,
and (2) Any additional subject not previously included on the
published and posted agenda shall be accompanied by a statement
describing the nature of the urgent public necessity requiring
their addition to the agenda. The policy of the City Council
of the City of Plainview is that no additional items will be
included on the published agenda later than 4:00 p.m., Thursday,
preceding the Council meeting unless accompanied by a statement
describing the nature of the urgent public necessity requiring
the addition to the agenda.

AUTHORIZATION FOR STUDY, PREPARATION, INTRODUCTION AND ADOPTION OF
ORDINANCES, RESOLUTIONS AND PROCLAMATIONS:
A, Discuss proposed ordinances and continue study or authorize the
City Attorney to prepare:

and/or contracts designating an industrial park at the;

Zoning Ordinance, an ordinance by the provisions of Article
lOlla, revised Civil Statutes of Texas, establishing zoning
regulations and districts in accordance with a comprehensive
plan and within such districts regulating the use of land,
building and structures;' the height, bulk and locations of
bui~ldings; establishing minimum requirements for off-street
parking, regulating the erection, repair and alternation of
all building and structures; providing for specific use .per-
mits for certain uses-; recognizing non-conforming uses and
str~c.tures and rules for the regulation thereof; creating a
board of'adj?stment and providing rules and regulations for
its organization procedure, jurisdiction and powers; setting
forth the re~uirement~s fOr building sites and the manner of
their creation providing for a certificate of occupancy and
compliance; defining certain terms; adOpting a zoning district
map and making-it part of this ordinance; making all figures,
letters, markings, symbOls and charts containing in said or-
dinance or shown on the map a part of this ordinance; pro-
viding a penalty for violation' of the provisions of such or-
dinance not to exceed $200 for each violation; also providing
injunctive relief to persons, affected by the violations of
said ordinance; and providing a saving' clause.
An ordinance prescribing rules and regulations governing
plats, plans and subdivisions of land wi.thin the incorpor-
ated area of Plainview, Texas, herein defined as the "City";
containing certain definitions providing fo.r final approval
of subdivisions by sections; prescribing regulations for

streets, sidewalks, alleys, sanitary utilities and community
facilities.
Providing for a penalty Of not more than $200 for each vio-
lation thereof, repealing all conflicting ordinances; pro-

MINUTES CITY COUNCIL REGULAR MEETING
The City Council of the City of Plainview met in regular session at 7:30 p.m., in
the Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the
following Alderman present: Medlin Carpenter, Jeane Browning, Tom Almon, Lloyd Woods-
and William SoRelle.
Also present were B~uce Byron-Administrative Assistant, M. L. Rea-City Clerk, Joe
Sharp-City Attorney, W~iltiam R. Hogge-Director of Public Works, Johnnie Ballew-Director
of Public Safety, Norman Huggins-Director of Finance, Harold Gladman-Director of Plan-
ning, Billy Rogers-Park Supervisor, Mike McGregor-Administrative Assistant and Emma
Quintanilla-Administrative Secretar%~ ~nd Bob Richards-Ass't. Building Inspector.
Also present were Gary Ott~Plainview Rally Herald, Jim Davis-Plainview Reporter
News, Chuck Martin-KVOP Radio, Bill Bruder-KKYN Radio, Charles Bechtold-KAMR in Amarillo,
Elmer Lee Criswell, Dan McMillon, Bill McBride, David Driskell, Bob Harder, Bill Bar-
nett, Mark Warren, Thomas Barnett, Dr. Donald Moore, Douglas McDonough, Jim Higdon,
Charles Ikard, Jack Kuntz and D. L. Williams.
Invocation was given by Lloyd C. Woods.
It was moved by Alderman Almon, seconded by Aldemman Woods, to approve the Mayor's
recommendation to the following committees: Civil Defense Committee: Frank Cumry and
Charles Cypert, Traffic Safety Committee: Doc Cross, Alfred Henderson and Temmy Teague,
Motion carried ~animously.
The following members were present to receive their certificate of appointment by
the Mayor: Plainvlew/Hale County Health Board - Dr. Donald'M. Moore; Board of Electrical
Examiners - Don McMillon; Plm~ing Board of AppeaLs - Bill McBride and Delvin Williams;
Community Improvement Committee - David Driskill.
It was moved by Aldemman SoRelle, seconded by Alderman Browning, to award the bids
rom the purchase of fonm one-half ton pick-ups to Bob Gardner Chevrolet. Motion carried
unanimously. (Jack Morris Ford was the best bidder, but due to the time it would take
fop delivery, it was not a~rarded.)

It was moved by Alderman Carpenter, seconded by Alderman Woods, to award the bid
for the purchase of an air compressor to Ingersoll Rand. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Carpenter, to deny the
bid of James Robinson at this time until the City Attorney prepares a deed and contract
and we receive the necessary papers from Mr. Robinson. Motion carried unanimously.
Notice of a public hearing on the Environmental Impact of the proposed 1976 Com-
munity Development Fund Project as recommended by the Mayor's Environmental Study Com-
mittee to be held at 7:30 p~m., October 12, 1976.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Zone Case

No.'76-i998, an ordinance amending the Zoning Map of the City of Plainview. Motion car-
ried unanimously.
It was moved by Alderman ~oods, seconded by Alderman Almon, to approve the minutes
of the City Council meeting held September 14, 1976. Motion carried unanimously.

seconded by Alderman Browning, to authorize the City Attorney to prepare a new ordinance
for charitable solicitations keeping in mind the recommendations of the commission.
Motion carried unanimously.
The City Council is continuing the study on the ordinance prescribing rules and
regulations governing plats, plans and subdivisions of land within the incorporated area
of Plainview, Texas.
A jointmeeting between the City Council and Planning Board and Zoning Commission
is scheduled for October 7th, Thursday, 7:00 p.m., at City Hall, to discuss the Zoning
Ordinance.
It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropria-
tion Ordinance No; 76~1995, from the Pro-rata construction Fund 4@4 in the amount of
$375.00 payable to Floyd Banister for backhoe work -sewer trench in Town West Addition.
Motion carried unanimously.
It was. moved by Alderman Almon, seconded by Alderman Woods, to adopt Appropriation
Ordinance No. 76~I996, from the Pro-rata construction Fund 434 in the amount of $625.00
payable to Floyd Banister for hackkoe work - sewer trench work in Villa West $ Town West
Additions. Motion carried unanimously.
It was moved by'Alderman SoRelle, seconded by Alderman Woods, to adopt Appropria-
tion Ordinance No. 76~1997, from Revenue Sharing Acct. 427-816 in the amount of $7,858.07
payable to General Fund Acct. 608-812 for Fire Department training field construction
project. Motion carried ~ananimously.
It was moved by Aldemman Campenter, seconded by Alderman SoRelle, to adopt Appro-
priation Ordinance No. GO 333-76 from the General Obligation Bond Fund 424-807 in the
amount of $1,721.28 payable to General Fund 620-815 for traffic improvements on Highway
194 Project. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Woods, to adopt Appropria-
tion Ordinance No. G0'334-76, from the GO Bond Fund 424 in the amount of $.3,812.05

Street Project. Motion carried unanimously.
Receive for consideration and discussion, letter from Plainview Cable TV, concern-
ing franchise tax. No action was taken at this tim~e.
It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to authorize the
City Attorney to prepare an ordinaqce prohibiting no parking on the West side of the
1000 Block of Portland Street between! the hours of 7:80 am to 4:30 pm on school days.
Motion carried unanimously.

Received for filing, City of Plainview Sales Tax Receipts for the fiscal year 1976.
Received for filing, Pioneer Natumal Gas Company's Cost of Gas on its West Texas
System for the month of August, 1R76.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to authorize the
Mayor to sign the release to the First National Bank of Plainview, securities pledged
to the City of Plainview for deposits in the amount of $25,000. Motion carried unan-.

It was moved by Alderman Browning, seconded by Alderman Woods, to authorize the

It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to authorize the
specifications and contract ~ocuments for installations of parking lots at Jaycee g
Babe Ruth ballparks for the Broadway Street Park in the City of Plainview~ Hale County,
Texas. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to table for further
discussion, the request of Sambo Corporation to close the alley located in the 1800
Block of West Fifth in exchange for a Utility Easement. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Woods, to file the reports
and adjourn the meeting. Motion carried unanimously.
Meeting adjourned at 9:40 p.m.
Mike McGregor'announced his resignation and the City Council congratulated him
