MINUTES CITY COUNCIL REGULAR MEETING
The City Council of the City of Plainview met in regular session at 7:30 p.m.,
in the Council Chambers of the City Hall with Medlin.~arpenter-Mayorr~Pro Tem presiding
and .~h~ ~following'Coun¢ilme~ present: ~-~eane Browning--Place One, Lloyd C. Woods-Place
Three, Tom Almon-Place Four and William SoRelle-Place Five. Mayor J. Robert Wayland
was absent from the meeting.
Also present were City staff: Marshall Pharr-City Manager, Bruce Byron-Adminis-
trative Assistant, M. L. Rea-City Clerk, Joe Sharp-City Attorney, Harold Gladman-Director

Invocation was given by Lloyd C. Woods.
Mayor Pro Tem called for a moment of silence and meditation in honor of Maurice
Hanna who had served 'on the City Council from April, 1960 to April, 1966.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve for ap-
pointment to the Building Code Board of Appeals, Maurice Smith. Motion carried unani-
mously.

Mrs. Terry James appeared before the City Council to discuss the City of Plainview
Code, Chapter 4, Animals & Fowls, Article 8, Rabbits, Sections 21 thru 27. Mrs, James
did not see anything wrong with keeping rabbits inside the City limits as long as they
were kept clean and did not bother anyone. Mr. Wayne Ross, Presi~dent of the Rabbit
Association, also appeared before the City Council in favor of keeping'.rabbits inside
the City limits. After a lenghty discussion, it was moved by Alderman Woods, Seconded
by Alderman Almon, to table the discussion until some action to be taken at the next
regular City Council meeting, which will be January 25, 1977. Motion carried unani~'.

Mr. Randy Kidd and Mr. Barry Miller appeared before the City Council to discuss
proposals subdivision development of Ri dgecrest Addition to the City of Plainview.
After their presentation and Marshall Pharr's explana~ion~of C~ty"s cost, it was moved
by Alderman Woods, seconded by Alderman Browning, to approve the continuati-on of this
development and plat presented. Motion carried unanimously. (City's Cost: Paving-
$36,220.00; Water-S31,715.72; and Sewer-S12,050.72 : $79,986.44)._~
Mr. Bill LaFont appeared before the City Council to discuss installation of a four
way stop sign at the intersection of llth & Holiday Drive. After a lengthy discussion,
it was agreed-upon by the Council to ask Robert Ratcliff-Traffic Safety Engineer to
study the traffic count of the area.
Mr. Jack Oswald appeared before the City Council to present Mr. Bennett Reaves,
with Parkhill, Smith & Cooper, Inc. Mr. Reaves discuss an Engineering contract for
ai~nport improvements at the Plainview/Hale County Airport.
It was confirmed by the City Council that Wesley Electric Company of Plainv$~w,
Texas, was a. Warded the bid for Park lighting in the Water Running Draw Regional Park
in the amount of $50,000, at the work sess~ion on January 6, 1977.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve the
specifications for playgroung equipment to be installed in the 7th Street Park. Motion

carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to authorize the ad-
vertising of bids to be received on February 8, 1977, for the playground equipment for
7th Street Park. Motion carried unanimously.
Reminder of bid letting for the purchase of the following items:
1) Overhead doors for the Plainview Fire Department - bids to be received by 10:00 a.m.
Tuesday, January 25, 1977.
It was moved by Alderman Almon, seconded by Alderman Woods, to approve Zone Case
No. 320, request of Herman Nelson for rezoning of West 55" of Lot 8, all of Lot 9, Blk.
1, Titus Pillow Subdivision, from an R-2 Zone to a C-2 Zone, for Commercial use, located
at 806 W. 24th. Motion carried unanimously. The Planning & Zoning Commission approved
the Zone Case for the following reasons: 1) Change is not contrary to established land
use pattern, 2) The basic land use conditions have been changed, 3) There are sub-
stantial reasons why the property cannot be used in accord with existing zoning, and
4) Change will not alter the population density pattern. Also, the stipulation of a
masonry fence on North and East sides was included.
It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Ordinance No.
77-2029, an~]ordinance amending the zoning map of the City of Plainview in reference to
Zone Case No. 320. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Zone Case
No. 321, request of Ramona Mallow for rezoning the following described property:
Tract No. 1: 643.5' x 912.61' out of Section 57, Block A-l, Hale County Texas,'contain-~'
ing approximately 13.48 acres, more or less.
Tract No. 2: 643.5' x 86.34' x 643.5' x 26' out of Section 29, Block JK-2, Hale County,
Texas.
Tract No. 2 beginning at the NW corner of Tract No. 1; Thence West 86.34'; Thence South
643.5'; Thence East approximately 26'; Thence North to point of beginning. Containing
approximately one acre, more or less, from an R-1 Zone to a C-2 Zone for Commercial use,
located in the 1500 Block of South Interstate 27.
Motion carried unanimously. The Planning & Zoning CommissiOn'-approved the Zone Case for
the following reasons: 1) There are substantial reasons why the property cannot be used

in accord with existing zoning, 2) Change is not contrary to estab~lished land use pat-
tern, 3) Change will not adversely affect property values in adjacent area, and 4)
Change will not be a deterrent to the improvement or development of adjacent area.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance No.
77-2030, an ordinance amending the zoning map of the City of Plainview in reference to
Zone Case No. 321. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Zone
Case No. 322, request of Darrell Brown for rezoning the following described property:
A 2.35 acre tract of land approximately 200' x 516' out of Section 26, Block JK-2, Hale
County, Texas, from an R-1 Zone to a C-2 ZOne for Commercial use, located in the 3600
Block, Dimmitt Road.
Motion carried unanimous!,'y. The Planning & Zoning Commission approved the Zone Case for
the following reasons: 1) Change will not alter the population density pattern, 2)
Change will not adversely influence living conditions in the neighborhood, 3) Change
will not adversely affect property values in adjacent area, and 4) Change will not
be a deterrent to the improvement or development of the adjacent area.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to adopt Ordinance
No. 77-2031, an ordinance amending the zoning map of the City of Plainwi,.ew in reference
to Zone Case No. 322. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve the minutes
of the regular City Council Meeting held December 14, 1976. Motion carried unanimously.
Received for filing, copies of the following: Parks, Open Space & Recreation Ad-
visory Committee, November 8th; Building Code Board of Appeals, December 13th; Planning
& Zoning Commission, December 16th; Board of Adjustment, December 20th; and Electrical
Board of Examiners, December 21st.
The City Council is stiqll studying for adoption, the Zoning Ordinance and the sub-
division ordinance.
It was moved by Alderman Almon, seconded by SoRelle, to approve for introduction

and first reading, Ordinance No. 77-2034, an ordinance fixing the charge for copies of
the City of Plainview Flood Hazard Boundary Map. Motion carried unanimously. ($5.00)
It was moved by Alderman Browning, seconded by Alderman Woods, to approve the second
reading of Ordinance No. 76-2027, an ordinance closing hearing given to real and true
owners of all of those certain tracts or parcels of land lying and being situated in the
Cii~y of Plainview, Hale County, Texas. Motion carried unanimously. (Read caption only)
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance No.
77-2032, from Pro-rata construction fund 434 in the amount of $792.50 payable to Morton
Irrigation Pipe Co., for water main ditch for Westridge Park, Unit #2, and Townwest.
Motion 'carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Browning, to adopt Ordinance No.
7.7.~2033, from Revenue Sharing Fund 427 in the amount of ~!800 payable to W.F. Moore for
removal of debris and cleaning of lot at 311 Fir, Lot 5, Block 9, McClelland AdditiOn.
Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Ordinance No.
GO 337-77, from GO Park Bond Fund 812 in the amount of $10,250 payable to Central Texas
Iron Works, Inc. for payment"~for bleachers as bid for Broadway Park. Motion carried unan-
imously.
It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No.
GO 338-77, from GO Park Bond Fund 812 in the amount of $30,350 payable to Wesley Electric
for 1/2 draw payment for §0% of work done on lights,rat Babe Ruth and Jaycee ballparks.
Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance
No. CDI-021, from the Community Development Fund Account 429-807 in the amount of
$12,128.76 payable to High Plains Pavers, Inc. for 1976 Assessment Paving Project
B-75-DN-48-O015, Construction Estimate No. 2. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve and

adopt Plan II of the City Engineer's Study concerning the specifications and cost
estimates for the installation of curb/gutter and recessed parallel pa~king in the
1600 & 1700 Block of the West side of Ennis Street adjacent to the 16th Street Park.
Motion carried unanimousiy. This plan was recessed parking, leave the curb/gutter
in, build a sidewal~( around the parking area, space for 27 cars to park and the cost
would be $4,150.
Received for filing., sales tax comparison report.
Received for filing, City of Plainview's Annual Revenue Sharing Use Report and
it is to be published in the Plainview_Dai.ly He_raid on Friday, January 14, 1977.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to recommend the
request of Mr. J. William Mason, representing the American Association of Retired Per-
sons to the Parks, Open Space & Recreation Advisory Committee and to have the Committee
pick an architect. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to approve a permit
for an alley in the alley between Canyon and Dallas, South of Olton Road, .as requested
by Frontier Savings & Loan Association, with the stipulation of a fence, as Mr. Harold
Gladman advised. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to authorize for con-
clusion in the code enforcement debris clearance program, 311 Baltimore. Mr. Clifford
Holt is clearing this property. Motion carried unanimously.
Received for consideration and filing, the Engineering Report on Waste Water Re-
clamation Plant as presented by Parkhill, Smith & Cooper, Inc. from Lubbock. A meeting
has been set up for the final presentation and adoption, Thursday, January 13th at 11:30
a.m., in the Mayor's Office of City Hall..
It was moved by Alderman Browning, seconded by Alderman Woods, to authorize the
City ~Attorney to prepare a street use permit to cross public road on Joliet Street, as
requested by the Plainview Cemetery Association, Inc. Motion carried unanimously.

Received for filing, cost of gas adjustment on the West Texas Transmission System,
as presented by Pioneer Natural Gas Company for the month of November, 1976.
Received for filing and reminder of the City of Plainvi~-w Annual Employee's Award
Banquet to be held January 28, 1977.
The discussion on the proceedure and schedule for selection of Chief of Police will
be at the Thursday, January 13th meeting at 11:30 a.m., in the Mayor's Office of City
Hall.
It was moved by Alderman SoRelle, seconded by Alderman Browning, after some discus-
sion, to refer back to the Parks, Open Space & Recreation Advisory Committee, the mail
out survey of the Committee. Motion carried unanimously. The Council felt that some of
the quest'ions on the survey might be considered personal.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to authorize the City
Attorney to take care of the necessary papers concerning the petition for the adoption
of the Firemens! and Policemens' Civil Service Act. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Woods, that the reports be
filed and the meeting be adjourned. Motion carried unanimously. Meeting adjourned at
10:45 p.m.
