CITY COUNCIL MINUTES
The City Council of the City of Plainview met in regular session at 7:30 p.m.,
in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding
and the following Alderman present: Jeane Browning, Place One; Lloyd C. Woods, Place
Three; Tom Almon, Place Four; and wm. SoRelle, Place Five.
Also present were City staff: Marshall Pharr, City Manager; Bruce Byron, Admin-
istrative Assistant; Joe Sharp, City Attorney; M. L. Rea, City Clerk; Harold Gladman,
Director~'of Planning; Wm. R, Hogge, Director of Public Works; Norman Huggins, Director
of Finance; Johnnie Ballew, Director of Public Safety; Billy Rogers, Supervisor of
Parks; Tom Stephens, Municipal Judge; Robert Ratcliff, Traffic Safety Coordinator; and
Emma Quintanilla, AdministratiVe Secretary.

Invocation was given by Tom Almon.
The fOllowing people were present to receive their Certificates of Appointments

It was moved by Alderman Browning, seconded by Alderman Almon, to award the bid
for the purchase of one dump truck for the Street Department to McGavock GMC in the
amount of $6,518.82 with 45-60 days delivery on a 24000 #GVW. Four bids were received.
Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to award the bid
for the purchase of a service and tow truck for the Service Center to Gardner Chevrolet
in the amount of $4,84t .18 on-.a 9000 #GVW. Four bids were received. Motion carried
unanimous ly.

It was moved by Alderman Woods, seconded by Alderman Almon, to award the bid for
the construction of multi-purpose courts (2 each) for Sixteenth Street Park and Running
Water Draw Park to Arrtco Tennis Systems of Lubbock in the amount of $44,683.00. Five
bids were received. Motion carried unanimously.
R~minder of bid lettings for the purchase of the following items:
1) Sprinkler system at Seventh Street Park and Sixteenth Street Park. Bids to be
received March 22, 1977, estimated cost $50,000.
2) Construction of bleachers into berms at Running Water Draw Park. Bids to be
received March 8, 1977, estimated cost $30,000.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve the
specifications and authorize advertising for bids on the construction of miscellaneous
water and s~wer improvements for Villa West, Unit #2, Western Meadows, Unit #2, West-
gate, Unit #2, Ridgecrest, Unit #1, and Westridge Park No. 3. T~otal estimated cost
$195,560.00 (pro-rata payments $97,807.44 and city cost $97,752.56). Motion carried
unanimous ly.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to approve the
specifications and authorize the advertising for bids for the purchase of seventeen
(17) three (3) cubic yard containers with Revenue Sharing Funds. Each-S175.00 for
a total of $2,975.00. MOtion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to open the public
hearing before the City Council, where all interested persons were provided with an
opportunity to be heard on the proposed annexation of the described territory as ad-
vertised, containing 30.85 acres out of the Southwest quarter of Section 28, Block JK-2
Hale County, Texas. There being no discussion, it was moved by Alderman Woods, seconded
by Alderman SoRelle, to close the public hearing.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance
No. 77-2046, an ordinance providing for the extension of certain boundary limits of
the City of Plainview, Texas, and the annexation of certain t6r~$tory consisting of

30.85 acres of lan~, which said territory lies adjacent to and adjoins the present
boundary limit of the City of Plainview, Texas. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to approve Zone
Case No. 323, the request of Michael Smith for rezoning the following described pro-
perty: Tract l: A Tract of land out of Section 29, Block JK-2, Hale County, Texas,
containing 1.71 acres, more or less; Tract 2: A Tract of land out of Section 57,
BlOck A-l, Hale County, Texas, containing approximately 3.0 acres, from an R-1 Zone
to a C-2 Zone for Commercial Use, located at 1400 Block, South Interstate 27~for the
following reasons:
l) Use conforms to established land use pattern in the area,
2) Use contributes to planned development in the area, and
3) Use represents best use of land.
Motion carried unanimously.
It was moved by Alderman Woods, seconded, by Alderman Almon, to adopt Ordinance
No. 77-203.9., an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 323. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Zone
Case No. 324, the request of Randy Kidd for rezoning of Lots I thru 5, Block l, Ridge-
crest Addition No. l, from an R-1 to a R-3 Zone, located in 200 Block of South Ennis
for the following reasons:
l) Use promotes public wet fare of the community,
2) Use contributes to planned development of community, and
3) Use conforms to best use of land.
Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No.
77-2040, an ordinance amending the zoning map of the City of Plainv}~w for Zone Case
No. 324. Motion carried unanimously.
It was moved by A~derman Almon, seconded by Alderman Woods, to approve the Zone
Case No. 325, the request of Jim Dickerson for rezoning a 0.47 acre tract of land out
of Northeast part of Section 34, Block JK-2, Hale County, Texas, from a R-1 Zone to
a C-1 Zone for Commercial Use, located at 2103 Dimmitt Road for the following reasons:

1) Use conforms to existing land use patterns,
2) Use promotes the public welfare of the community, and
3) Use represents best use of land.
Motion carried unanimously.
It was moved by A'lderman Browning, seconded by Alderman SoRelle, to adopt Ordinance
No. 77-2041, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 325. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Z~ne 'Case
No. 326, the request of Estella England for rezoning of Lots 11 thru 14, Block 27,
Highland Addition from an R-2 Zone to a Specific Use Zone, to be used as a day care
center, located at 511 W 12th Street, Plainview, Tex.as for the following reasons:
1) Use would provided needed facilitY,es without determent to the neighborhood, and
2) Literal 6nforcement of ordinance would deprive community of needed day care facil-
ities to the det,riment of the entire community.
Motion carried unanimously.
It was moved by Allderman SoRelle, seconded by Alderman Almon, to adopt Ordinance
No. 77-2042, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 326. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to approve Zone Case
No~ 327, the request of E.B. Noel for rezoning a tract of land containing 3.23 acres
oUt of the Southeast part of Section 35, Block JK-2, Hale County, Texas, from an R~I
Zone to a C-2 Zone for Commercial Use, located at' 2401 Quincy.for the following reasons:
1) Use conforms to established land uses in the area,
2) Use promotes planned growth in the area, and
3) Use conforms to best use of land.
Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Ordinance
No. 77-2043, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 327. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Browning, to adopt the City

Council Minutes of the regular meeting held February 8, 1977. Motion carried unani~
mously.

After a lengthy discussion between the City Council and Mr. Lancaster of Plainview
Cable TV, no action was taken at this time concerning the ordinance amending the fran-
chise of Plainview Cable TV to increase from 2% to 3%. However, Mr. Lancaster saw no
problems concerning this. A meeting is to be set up to discuss this further.
No action was taken on the Zoning Ordinance or Sub-division ordinance at this
time.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to introduce
Ordinance No. 77-2038, an ordinance amending Section 7 of Ordinance No. 71-115~, pro-
viding for notices issued for overparking and information to be contained thereon;
and amending Section 12 of said ordinance, providing that any person who receives said
notice may pay two dollars in United States money and forward same in the United States
mail or deliver to the Clerk of the Corporation Court within ten days after receiving
such notice or in like manner pay four dollars to the City of Plainvi~ew if paid within
ten to twenty days after receiving such notice, or in a like manner pay ten dollars to
the City of Plain~iew if payment is made over thirty days after receiving such notice,
and further providing that whenever such person has paid said amounts as a charge for
overparking, such compliance shall constitute a defense for the particular offense of
overparking for which he receives said notice and that he shall not then be required
to appear before the Corporation Court. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance

No. 77-2045., an ordinance setting a date, time and place for a public hearing on the
proposed annexation of certain property by the City of Plainvi~w, Texas, authorizing
and directing the Mayor to publish notice of said public hearing. Motion carried un-
animously.
It was moVed by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropria-
tion Ordinance No. 77-204.4, from Revenue Sharing Fund[Account 427-816 in the amount of
$1,440.94 payable to City of Plainview General Fund Account 607-701 for final payment
of improvements made to the Police Building. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropria-
tion Ordinance No. GO 344-77, f. rom GO Park Bond Fund Accou~t~-~403-812 in the amount of
$30,350.00 payabt~ to Wesley Electric for final payment for lighting ~systems at Broad-
way Park. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Appropria-
tion Ordinance No. GO 345-77, from GO Park Bond Fund Account 403-812 in the amount of
$51,448.45 payable to Texas Sprinkl~'r Company, Inc., for 80% completion on Section A
and materials on site for completion of Section A and B for Broadway Park sprinkler
system. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Resolution
No. R77-081, a resoluti~on endorsing the Texas 3 by 80 Traffic Safety Program as recom-
mended by the Governor's Office of Traffic Safety and the Citizens Advisory Traffic
Safety Committee. Motion carried~unanimously.
No action was taken at this time on the contract agreement between the City of
Plainview, Hale County, Plainview/Hale County Airport Board and Parkhill, Smith & ~
Cooper, Inc. for engineering services.~'~' ~.~
No action was taken at this time on the request of Mr. J. William Mason, repre-
senting the American Association of Retired Persons.

franchise in regard to gross receipts tax and street use permit. Mayor is to set up
meeting with SWPS officials.
Discussion was held on the agreement between the City of Plainvi.-ew and ERA INCOR-
PORATED. Marshall Pharr, City Manager, announced a meeting he was planning to attend
in Austin on Ihu~sday, February 24th, with Texas Water Quality Board, EPA, ERA and
Texas State of Health Resources. He is to report on this later.
It was moved by Alderman SoRelle, seconded by Alderman Woods, to grant the request
for debris clearance of property located at 104 South Date for Arthur Garcia; 820 Beech
for Ben Tye; and 1710 West 5th for Glen Day. Motion carried unanimously.
Received~'~for filing, letter from the State Department of Highways and Public
Transportation concerning the highway traffic signal recommendation a% the intersectiOn
of State Highway 194 and Quincy Street intersection with Seventh Street. They stated
that no light was War~anted at this time.
Received for filing, letter from the Texas Water Development Board, pertaining
to the economic impact of implementation of Public Law 93-523, the Federal "Safe
Drinking Water Act of 1975".
It was moved by Alderman SoRelle, seconded by Alderman Browning, to contact
Washington D. C. representatives and let them know that the City of Plainview was in-
terested in the implementation of Phase One of the Running Water Draw Watershed Flood]!
Protection Plan for Plainview, Tfxas. Motion carried unanimously.
A status report of 1976 Park Bond Fund~Issue as of February 11, 1977 was given,
show~ihg that: total spent or under contract ($239,713,15) and estimated cost ($245,140)
