BOARD OF ADJUSTMENT
VARIANCE FINDINGS
APPELLANT: Freddy Cate BA 1598 DATE OF HEARING: July 26, 2010
The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things,
the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working
In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the
following findings:
1. There are special circumstances or conditions applying to the land or building for which the variance is
sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to
lands or buildings in the same zone or neighborhood, and that said circumstances or conditions are such that the
strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such
land or buildings; and,
2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently
Injurious to the property or improvements in such zone or neighborhood in which the property is located; and,
3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance
as granted by the Board is the minimum variance that will accomplish this purpose; and,
4. The literal enforcement and strict application of the provisions of the Zoning Ordinance will result in
unnecessary hardship inconsistent with the general provisions and intent of such ordinance and that in granting
such variance the spirit of the ordinance will be preserved and substantial justice done.
5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning
Ordinance:
a) BA Case # 1589 The request of Freddy Cate for a variance of twenty -four (24) feet of the required
twenty -five (25) foot front setback and five (5) feet of the required five (5) foot side setback to build a
19'X 24' carport as stated in Section 34 of the City of Plainview Zoning Ordinance in a (R -2) Single
Family Zoning District and being Montrose Addition Block 3, Lot 16, Plainview, Hale County, Texas,
the same being 604 W. 22 "
b) All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within
6 months of approval of the variance.

12'X 21' carport as stated in Section 34 of the City of Plainview Zoning Ordinance in a (R -2) Single
Family Zoning District and being Highland Addition Block 74, Lot 1, Plainview, Hale County, Texas, t
he same being 1507 Milwaukee.
b) All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within
6 months of approval of the variance.

required thirty (30) foot front setback and eight (8) feet of the required eight (8) foot side setback to
build a 24' X 24' carport as stated in Section 34 of the City of Plainview Zoning Ordinance in an (R -1)
Single Family Zoning District and being Brandes Addition Block 4, S 40' Lot 12, N 20' Lot 13,
Plainview, Hale County, Texas, the same being 807 Borger.
b) All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within
6 months of approval of the variance.
