VARIANCE FINDINGS
APPELLANT: Alfredo Regaldo Cruz BA 1590 DATE OF HEARING: April 26, 2010
The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things,
the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working
In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the
following findings:
1. There are special circumstances or conditions applying to the land or building for which the variance is
sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to
lands or buildings in the same zone or neighborhood, and that said circumstances or conditions are such that the
strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such
land or buildings, and,
2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently
Injurious to the property or improvements in such zone or neighborhood in which the property is located; and,
3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance
as granted by the Board is the minimum variance that will accomplish this purpose; and,
4. The literal enforcement and strict application of the provisions of the Zoning Ordinance will result in
unnecessary hardship inconsistent with the general provisions and intent of such ordinance and that in granting
such variance the spirit of the ordinance will be preserved and substantial justice done.
5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning
Ordinance:
a) BA Case # 1590 The request of Alfredo Regaldo Cruz for a variance of twenty -one (21) feet of
the required twenty -five (25) foot front setback and 5 (five) feet of the required 5 (five) foot side
setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 20' X
21' carport in the front setback in a Single Family Residential (R -2) Zoning District, and being
Shepard -Couch Addition, Block 2 Lot 14, Plainview, Hale County, Texas the same being 913
W. 26
b) All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within 6
months of approval of the variance.

The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things,

required twenty -five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning
Ordinance to construct a 24' X 24' carport in the front setback in a Single Family Residential (R -2)
Zoning District, and being OT Addition, Block 21 S35' Lot 5 N40' Lot 6, Plainview, Hale County,

Unit 1, Plainview, Hale County, Texas the same being 1111 W. 28`

a) All carports /canopies must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway
within 6 months of approval of the variance.
b) BA Case # 1593 The request of Francisco Crus for a variance of two (2) feet of the required five (5) foot
side setback to build a 17' X 27' canopy as stated in Section 34 of the City of Plainview Zoning
Ordinance in a Single Family Residential (CBD) Zoning District and being OT Addition Block 2 Lot 11,
Plainview, Hale County, Texas the same being 704 Cedar .
