CITY COUNCIL MINUTES The City Council of the City of Plainview met in regular session at 7:30 p.m., in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Councilmen present: Jeane Browni'ng, Place One, Medlin Carpenter, Place Two, Lloyd Woods, Place Three, Tom Almon, Place Four, and Wm. SoRelle, Place Five. Also present were City staff: Marshall Pharr-City Manager, Bruce Byron-Administra- tive Assistant, Joe Sharp-City Attorney, M. L. Rea-City Clerk, Harold Gladman-Director of Planning, Johnnie Ballew-Director of Public Safety, Wm. R. Hogge-Director of Public Works, Norman Huggins-Director of Finance, and Emma Quintanilla and Debbie Hall-Admin- istrative Secretaries, and Jerry Austin-Assistant Chief of Police. Also present were the following visitors- Gary Ott-Plainview Daily Herald, Charles Bechtold-KAMR in Amarillo, Tut Tawwater-KVOP Radio, Dovie Gilleland, F. F. Calhoun,. Emmit Green, Herman E. Nelson, Lon D. Cartwright, Jim Yoakum, Richard Knowtes, Jim Higdon, and Jerry Gutheinz. Invocation was given by Wm. R. Hogge. I~t was moved by Alderman Carpenter, seconded by Alderman Browning, to authorize the Mayor to sign the certification papers on the land rights of the final inspection on Site three of the lower Running Water Draw Watershed. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to award the bid for the material and installation of a sprinkler system at the 7th Street Park and 16th Street Park to the low bidder of Howard Mechanical Inc., from Amarillo, Texas, in the amount of $25,433.42. Motion carried unanimously. (6 bids were received.) It was moved by Alderman Carpenter, and seconded by Alderman SoRelle, to award the bid for the construction of miscellaneous water and sewer improvements to the low bidder of H. W. Taylor Construction Co. of Canyon, Texas, in the amount of $164,348.50. Motion carried unanimously. (7 bids were received.) Reminder of bid letting for the purchase of the following i~ems: 1) Community Center facility for Running Water Draw Park. Bids to be received April 7, 1977, 10:00 am, estimated cost $40,000. 2) The purchase of police uniforms, Bids to be received on April 7, 7977, estimated cost $5~600. 3) Annual uniform rental contract, estimated cost $135.00 per year employee. Bids to be received April 7, 1977. It was moved by Atiderman Woods, seconded by Alderman SoRelle, to approve specifi- cations and authorize advertising for aluminum bleachers and aluminum park benches for Running Water Draw Regional Park, with an estimated cost of $15,000. Motion carried unanimously. Bids are to be received on April 7, 1977. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve specifi- cations and authorize advertising for one pressbox-concession stand for Broadway Street Park, with an estimated cost of $5,000. Motion carried unanimously. Bids are to be received on April 7, 1977. A reminder of the notice of Public Hearing on the proposed zoning ordinance change of the hearing to be held at 7:30 pm. April 19, 1977. It was moved by Alderman SoRelle, seconded by Alderman Woods, to approve Zone Case No. 328, request of J. Bassett Smith for rezoning of the following property: A 3.245 acre tract out of the S part of Sec 29, Blk JK-2, Hale County, Texas; Beginning at the SW corner of Sec 29, Blk JK-2; Thence S 88o44', E along the S line of Sec 29, 2678,7' to the W ROW line of US Hwy 87; Thence N 5°15' W, 831.11' along the W ROW line of US Hwy 87, to the Beginning corner of this tract; Thence N 5°15' W, 432.78' to a steel rod; Thence S 84o45' W 336.34' to a steel rod; Thence S 7o48'55'' E, 433.21' to a steel rod; Thence N 84045' E 316.95' to the Place of Beginning and containing 3.245 acres; from an R-1 Zone to a C-2 Zone for Commercial Use, located on S 1-27. The..Planning and Zoning Commission approved the Zone Case for the following reasons: 1) Change is not contrary to established land use pattern. 2) There are substantial reasons why the property cannot be used in accord with existing zoning. 3) Change would not alter the population density pattern. 4) Ghange will not adversely affect property values in adjacent area. It was moved Alderman Browning, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2049, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 328. The motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Zone Case No. 329, request of Herman E. Nelson for rezoning Lots 19 and 20, Blk 1, Watson Addition to City ofl Plainview, Hale County, Texas, from an R-2 Zone to a C-2 Zone for commercial use, located 2312 and 2314 Independence. The motion carried unanimously. The Planning and Zoning Commission approved the Zone Case for the following reasons: 1) Change is ~not contrary to established land use pattern. 2) Change willl not be a deterrent to the improvement or development of adjacent area. 3) There are substantial reasons why the property cannot be used in accord with existing Zoning. 4) Change would not alter population density pattern. Also, the stipulation of a 6' solid screen fence along the South property line will be built. It was moved by Alderman Woods, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2050, an-ordinance amending the zoning map of the City of Plainview for Zone Case No. 329. The motion carried unanimouSly. It was moved by Alderman Browning, seconded by_Alderman Woods, to approve Zone Case No. 330, request of Dovie Ann Gilleland for rezoning N 20' Lot 30, all of Lots 31 and 32, Blk 4, Brandes Subdivision to City of Plainview, Hale County, Texas, from an R-1 Zone to a C-1 Zone for commercial use, located at 912 Canyon. There are substantial reasons why the property cannot be used in accord with existing zoning. Change will not seriously reduce the light and air to adjacent areas. Also, the stipulation of a deed restricting it to a beauty parlor only. It was moved by Alderman Carpenter, seconded by~ Alderman Al~mon, to adopt Ordinance No. 7.7-2051, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 330. The motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman B~,mowning, to approve Zone Case No. 331, the request of Lon D. Cartwright for rezoning of a 0.99 acre tract out of Lots A and D, Blk 89, College Hill Addition to City of Plainview, Hale County, Texas, described as follows: BEGINNING at a point in the N line and 172.5' E of NW corner of Lot D, Btk 89, College Hill Addition to the City of Plainview, Hale County, Texas; THENCE E 220.0' to a point; THENCE S 120.0'; THENCE W 200.0'~ THENCE N 120.0' to the place of Beginning, from a C-1 Zone to a C~-2 Zone for Commercial Use, located 3011 W lOth. The Planning and Zoning Commission approved the Zone Case for the following reasons: 1) Change will not adversely influence living conditions in the neighborhood 2) There are substantial reasons why the property cannot be used in accord with existing zoning. 3) Change will not be a deterrent to the improvement or development of adjacent area. 4) Change will not adversely affect property values in adjacent area. It was moved by Alderman Browning, seconded by Alderman SoRelle, to adopt Ordinance No~ 77-2052, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 331. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Ordinance No. 77-2048, an ordinance amending Section 14 of ordinance No. 795 of the City of Plainview as subsequently amended by ordinances of the City of Plainview, so as to provide that there shall be paid to the City each year during the life of the privil- ege and all renewals thereof, an annual payment consisting of a sum of money equal to three percent of the annual gross receipts received by the grantee, for the rendition of tetewision signal service within the City of Plainview. The motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. C~D1-028, from Community Development Fund 429-809 in the amount of $425.00 payabl, e to Morton Irrigation for ditching for water main extension in Frisco Addition. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. CD1-029 , from Community Development Fund 429-680 in the amount of $1996.80 payable to the City of Plainview General Fund for Code enforcement-demolition: Lots 5, 6, Block 6, Frisco; Lots 17, 18, 19, 20, 21, 22, Block 6 Frisco; Public Service March 22, 1977 Page 6 CITY COUNCIL MINUTES Building adjacent to Curry Lake Project. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Appro- priation Ordinance No. GO 350-77 from G.O. Park Bond Fund Account 403-812 in the amount of $2,840.00 payaB}e Southwestern Public Service Co. for installation of underground conductor for lighting system at Running Water Draw Regional Park. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Woods, to adopt Approp~ priation Ordinance No. 77-2054 from Revenue Sharing Fund 427-681 in the amount of $2,100.00 payable to Ebeling Manufacturing Co. for 12 solid waste containers @ $175.00. Motion carried unanimously. A meeting is to be scheduled to discuss the contract agreement between the City of Plainview, Hale County, Plainview/Hale County Airport Board and Parkhill, Smith and Cooper, for engineering services. A meeting between Southwestern Public Service Company and the Mayor is to be scheduled to discuss franchise in regard to gross receipts tax and street use permit as previously requested. Joe Sharp, the City Attorney, is working on a draft of the agreement between the City of Plainview and ERA INCORPORATED. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve the 1977 Vector Control Program at the net price of 14.4¢ per acre. Motion carried unanimously. Received for filing and notice letter from Texas Department of Health Resources dated March 8, 1977, publishing notice of solid waste p~rmit application #252 and 253 City of Plainview, Hale County, Texas to be held at the City Council Chambers, City Hall, City of Plainview, Texas, 901 Broadway, Tuesday, April 12, 1977 at 9~00 am as issued by John P. Richardson, Hearing Examiner, Texas Department of Health Resources. March 22, 1977 Page 7 CITY COUNCIL MINUTES Status reports on the following items: (2) Community Development Grant Application 1976-77 - have received applications from Tom Barber. The City Clerk, M. L. Rea, has received for filing, the report and recommendation of the Planning and Zoning Commission. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Resolution No. R77-08.3, a resolution setting the date for a public hearing before the City Council on April 19, 1977. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to approve the advertising fo~ a public hearing before the City Council on April 19, 1977. Motion carried unanimously. I~t was moved by Alderman Woods, seconded by Alderman Browning, to adopt Resolution No. R77-084, a resolution of the City Council of the City of Plainview, Texas, authorizing the filing of a Community Development BlOck Grant Program application to the U. S. Department of Housing and Urban Development: and authorizing the Mayor to act as the City's Chief Executive Officer and authorized representative in-all matters pertaining to the City's participation in the Community Development Block Program. Motion carried unanimously, Also, Mayor to write to ~Housing and Urban Development. It was. moved by Alderman Almon~,~ seconded by Alderman SoRelle, to adopt Resolution No. R77-085, a resolution aUthorizing the i.ncurrence of costs in the planning and preparation of a final application for block grant funds under Title I of the Housing and Community Development Act of 1974, Public Law 93-383. Motion carried unanimously. The City Attorney, Joe Sharp, has received air easement papers from Norman Dulaney for study.
