VARIANCE FINDINGS
APPELLANT: Jose Diaz BA 1578 DATE OF HEARING: July 27, 2009
The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things,
the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working
In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the
following findings:
1. There are special circumstances or conditions applying to the land or building for which the variance is
sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to
lands or buildings in the same zone or neighborhood, and that said circumstances or conditions are such that the
strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such
land or buildings; and,
2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently
Injurious to the property or improvements in such zone or neighborhood in which the property is located; and,
3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance
as granted by the Board is the minimum variance that will accomplish this purpose; and,
4. The literal enforcement and strict application of the provisions of the Zoning Ordinance will result in
unnecessary hardship inconsistent with the general provisions and intent of such ordinance and that in granting
such variance the spirit of the ordinance will be preserved and substantial justice done.
5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning
Ordinance:
BA Case # 1578 The request of Jose P. Diaz for a variance of twenty -four (24) feet of the required
twenty -five (25) foot front setback and one (1) foot of the required five (5) foot side setback as stated in
Section 34 of the City of Plainview Zoning Ordinance to construct a 24'X24' carport in the front
setback in a Single Family Residential (R -2) Zoning District, and being BLOCK 19 LOT 14,
HIGHLAND PLV Addition, Hale County, Texas the same being 1114 Milwaukee Street.

(25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 12'X20'
carport in the front setback in a Single Family Residential (R -2) Zoning District, and being BLOCK 15 LOT 33,
THUNDERBIRD PLV UNIT 7, Plainview, Hale County, Texas the same being 1103 W. 32nd.

In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the
following findings:

construct a 18'x21' carport in the front setback in a Single Family Residential (R -2) Zoning District,
and being BLOCK 17 E/2- 13 &14, HIGHLAND PLV , Plainview, Hale County, Texas the same being

twenty -five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to
construct a 35x7'x23'x25' oversized carport in the front setback in a Single Family Residential (R -2)
Zoning District, and being BLOCK 18 LOT 20 UNIT 4 THUNDERBIRD PLV , Plainview, Hale
County, Texas the same being 1404 Thunderbird.
