HomeMy WebLinkAbout06.22.2009 BA Variance Findings BOARD OF ADJUSTMENT VARIANCE FINDINGS APPELLANT: Joseph & Monica Sena BA 1573 DATE OF HEARING: June 22, 2009 The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things, the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the following findings: 1. There are special circumstances or conditions applying to the land or building for which the variance is sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to lands or buildings in the same zone or neighborhood, and that said circumstances or conditions are such that the strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such land or buildings; and, 2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently Injurious to the property or improvements in such zone or neighborhood in which the property is located; and, 3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance as granted by the Board is the minimum variance that will accomplish this purpose; and, 4. The literal enforcement and strict application of the provisions of the Zoning Ordinance will result in unnecessary hardship inconsistent with the general provisions and intent of such ordinance and that in granting such variance the spirit of the ordinance will be preserved and substantial justice done. 5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance: A. 1303 Quincy - Block 2, S4' -7 Lots 8 -9, Sunset Heights Addition: six (6) feet of the required thirty-five (35) foot front setback and eight (8) feet of the required eight (8) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 14' X 24' carport in the front setback and side set back. B. All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within 6 months of approval of the variance. All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within 6 months of approval of the variance. There are special circumstances or conditions applying to the land or building for which the variance is sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to lands or buildings in the same zone or neighborhood, and that said circumstances or conditions are such that the strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such land or buildings; and, 2. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance: A. 1008 Wayland - variance of thirty (30) feet of the required thirty (30) foot front setback and five (5) feet of the required five (5) foot side setback to construct a 26'X17' oversized carport in the front setback in a Single Family Residential (R -1) Zoning District, and being Lot 16 Block 2 of the Bain's Addition B. All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within 6 months of approval of the variance.
