VARIANCE FINDINGS
APPELLANT: Elias Alex Martinez CASE NO: BA 1517
DATE OF HEARING: May 22, 2006
The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things, the character
and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon
such and and traffic conditions in the vicinity of such property, and makes the following findings:
1. There are special circumstances or conditions applying to the land or building for which the variance is sought, which
circumstances or conditions are peculiar to such land or buildings and do not apply generally to lands or buildings in the same
zone or neighborhood, and that said circumstances or conditions are such that the strict application of the provisions of this
ordinance would deprive the applicant of the reasonable use of such land or buildings; and,
2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently Injurious to the
property or improvements in such zone or neighborhood in which the property Is located; and,
3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance as granted
by the Board Is the minimum variance that will accomplish this purpose; and,
4. The literal enforcement and strict application of the provisions of the zoning ordinance will result in unnecessary hardship
inconsistent with the general provisions and intent of such ordinance and that in granting such variance the spirit of the
ordinance will be preserved and substantial justice done.
5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance.
BA Case # 1517 The request of Elias Alex Martinez on behalf of Lionor B. Rodriguez for a
variance of fifteen (15) feet of the required thirty -five (35) foot front setback and four (4) feet six
(6) inches of the required ten (10) foot side setback as stated in Section 34 of the City of
Plainview Zoning Ordinance to construct a 12'X21' carport in a Single Family (R -2) Zoning
District, and being Block 1, Lot 10, Highland Addition, Plainview, Hale County, Texas the same
being 413 W. 11 Street.

The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things, the character
and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon
such land and traffic conditions in the vicinity of such property, and makes the following findings:

BA Case # 1518 The request of Roberto Sigala for a variance of fifteen (15) feet of the required
twenty -five (25) foot front setback and four (4) foot of the required five (5) foot side setback as
stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 20'X20' carport in
a Single Family (R -2) Zoning District, and being Block 75, East 45 feet of Lots 5 & 6 and the East
45 feet out of the South 45 feet of Lot 7 except for the railroad right of way, Highland Addition,
Plainview, Hale County, Texas the same being 1310 W. 15 Street.
