CITY COUNCIL MINUTES
K-Bobs Steak House

The City Council of the City of Plainview met in a special session at 7:30, at K-Bobs
Steak Housewith Mayor J, Robert Wayland presiding and the following Councilmeni~present:
Jeane Browning, Place One; Medlin Carpenter, Place Two; Lloyd Woods, Place Three; Tom
Almon, Place Four; and Wm. SoRelle, Place Five.
Also present were City Staff: Marshall Pharr-City Manager, Bruce Byron-Administrative
Assistant, Joe Sharp-City Attorney, and Wm. R. Hogge-Director of Public Works.
At, so present were the following visitors: Ray Rampy and his Attorney, Elgin Connor.
~e~spec!_al meeting was called to discuss contract terms between ERA, INC~ of Lubbock,
and the City of Plainview. Items discussed were the size and type of pipeline, who was to
build the pipeline, how much the pipeline was to cost, and where the pipeline was to be
laid. Two contracts were discussed, both the last contract prepared by the City Attorney,
Joe Sharp, and ERA's proposal of April 10, 1977.
It was agreed to retain the language of the City Attorney's last contract with the
following corrections: (l)i.~.Under 10, By Products, paragraph 1, the phrase "... or there-
after..." was deleted. (2) Also motified was section 11, which was changed to read 8~1/4
cents.vise 7-1/2 cents, and the second~sentence was deleted and replaced by the following
language, "Such rate of payment shall be adjusted annually so as to refl~ect the same per-
centage change as does the domestic water production expenditures, excluding capital cost,
as stated in the City of Plainview Annual Audit Report or those expenses as reported in
the Texas Municipal Reports compiled and published by the Municipal Advisory Council of
Texas the Water Works and Sewer Operating Statement showing total expenditures excluding
all capital costs and those funds availabl'.e for debt service as based on the published rates
effective October 1, 1976, whichever is less."
A motion was made by Lloyd Woods to accept this phraseology and the change~ made in the
contract. The motion was seconded and voted for unanimously. Ray Rampy said he would take
this modified contract and attempt to get financing. When such financing became available

he Would advise the City. There being no further business, the meeting adjourned at 9:00
P. M.
