VARIANCE FINDINGS
APPELLANT: Helen Fields CASE NO: BA 1423
DATE OF HEARING: October 28, 2001
The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things, the character
and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon
such land and traffic conditions in the vicinity of such property, and makes the following findings:
1. There are special circumstances or conditions applying to the land or building for which the variance is sought, which
circumstances or conditions are peculiar to such land or buildings and do not apply generally to lands or buildings in the same
zone or neighborhood, and that said circumstances or conditions are such that the strict application of the provisions of this
ordinance would deprive the applicant of the reasonable use of such land or buildings; and,
2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently Injurious to the
property or improvements In such zone or neighborhood In which the property Is located; and,
3. The granting of the variance Is necessary for the reasonable use of the land or building and that the variance as granted
by the Board Is the minimum variance that will accomplish this purpose; and,
4. The literal enforcement and strict application of the provisions of the zoning ordinance will result in unnecessary hardship
inconsistent with the general provisions and intent of such ordinance and that in granting such variance the spirit of the
ordinance will be preserved and substantial justice done.
5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance.
The request of Helen Fields for a variance of twenty -two (22) feet of the required twenty -five (25) foot front
setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 10'X20' carport in a
Single - family Residential (R -2) Zoning District, and being Block 3, Lot 3, Shepard -Couch Addition, Plainview,
Hale County, Texas the same being 910 W. 26th Street.

The application for Building Permit was denied due to the provisions of the Zoning Orainance

and the appellant request the Board to vary or adapt the strict application of such provisions of the
Zoning Ordinance in this particular case as a strict, literal enforcement of such provisions would result
in unnecessary hardship inconsistent with the general provisions and intent of such ordinance. Such
hardship is described as:

WHEREFORE, it is requested that a hearing be had in such matter in which the appellant may
appear in person or by agent or by attorney, and present to the Board sufficient evidence upon which
the Board may make the findings uire by such Zoning Ordinance in the granting of such variance.

such land and traffic conditions in the vicinity of such property, and makes the following findings:

The request of Cary Eaves for a variance of twenty -eight (28) feet five (5) inches of the required thirty (30) foot
front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct an 18'X21' carport in
a Single - family Residential (R -1) Zoning District, and being Block 18, Lot 4, Country Club Addition, Plainview,
Hale County, Texas the same being 312 Aileen Street.
