The City Council of the City of Plainvi~ew met in regular session at 7:30 P. M., in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presSding and the following Council men present: Medlin Carpenter, Place Two; Lloyd Woods, Place Three; Tom Almon, Place Four; and Wm. SoRelle, Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Bruce Byron-Administrative Assistant, Joe Sharp-City Attorney, Bill Hogge-Director of Public Works, M. L. Rea-City Clerk, Norman Huggins-Director of Finance, Alan Stewart-Police Chief, Woody Sevison-Fire Chief, Bob Richards-Building Inspector, Tom Stephens-Municipal Judge and Debbie Hall-Admini;Strative Secretary. Also present were the following visitors: Chuck Martin-KVOP Radio, Gary Ott- Plainview Daily Herald, Betty Jackson, Edith M. Dunn, Angie Lee Goss, Pauline Brown, Betty Nails, Lelon M. Robert Wayland stated that there was some interest being shown in paper recycling, so the Paper Recycling Advisory Committee consisting of the following members is being reconvened: B.O. Cooper-Chairman, Mrs. Harry I'go, Mrs. Sam Kendall, Mrs. R. S. Kiester, R. E. McDonald and Mrs. M. L. Watkins,. ~. A Public Hearing was opened to discuss the possible cancellation of the High Plains Elks Lodge, located at 811 8 Broadway'. BiJi Austin, of the Texas Alcoholic July 12, 1977 Page 2 CITY COUNCIL M~NUTES Beverage Commission, appeared to discuss the reasons why it is felt that the license of the High Plains Elks Lodge should be cancelled. He explained that there had been violations of the law, along with numerous stabbings and shootings. Alan Stewart, Plain- view Police Chief, appeared to verify that there had been several violations as stated by Bill Austin. There followed a general discussion between members~of the Council and members of the audience of whether or not the club should be closed. There being no further discussion, it was moved by Alderman Carpenter, seconded by Alderman Woods, to authorize the Mayor to write a letter to the Texas Alcoholic Beverage Commission requesting that the permit of the High Plains Elks Club be cancelled. It was also moved to authorize the Mayor, along with the County Attorney, District Attorney, Sheriff and City Police Chief, to sign a petition asking the~TABC for action on the violations found in the lodge as soon as possible. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ord~inance No. GO 387-77 from GO Park Bond Fund Account 403-803 in the amount of $182.50 payable to McDonald Trading Post, Inc. for P.A. System for Babe Ruth Pressbox. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. GO 388-77 from GO Park Bond Fund Account 403-812 in the amount of $5,301.00 payable to Arrtco Tennis Systems for final draw multi-purpose courts. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. GO 390-77 from GO Park Bond Fund Account 403-812 in the amount of $1,745.00 payable to Billy Mauldin Fencing for fence installation at Running Water Draw Regional Park. Motion carriedunanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. CD2-036 from Community Development Fund Account 409 in the amount of July 12, 1977 Page 3 CITY COUNCIL MINUTES $404.83 payable to Thomas E. Barber for Planning and Management Consultant Services pursuant to Jan. 28, 1975. Motion carried unanimously~ It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 77-2083 from Sewer Revenue Bonds 426-810 in the amount of $9,916.03 payable to H. W. Taylor Construction, Inc. for Construction Est. No. 4, Water & Sewer Extension Project. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 77-2084 from Revenue Sharing Fund Account 427-701 in the amount of $185.61 payable to Plainview Plumbing for plumbing for air conditioner at Central Fire Station. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Al'derman Almon, to adopt Appropriation Ordinance No. 77-2085 from Revenue Sharing Fund Account 472-701 in the amount of $139.60 payable to Vic's Electric for electrical wiring to air conditioner at Central Fire Station. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 77-2086 from Revenue ShaPing Fund Account 427-701 in the amount of $2,520.00 payable to King Heating & Cooling for air conditioner at Central Fire Station and Sub-Station. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 77-2087 from Revenue Sharing Fund Account 427 in the amount of $425.00 payable to The Camera Shop for 35mm Kodak Karosel Projector & Accessories and 35mm pro- jector-cassette tape synchronizer. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 77-2088 from Revenue Sharing Fund Account 427 in the amount of $212.00 payable to Audio Visual Specialties for purchase of 6 months supply of cassette tapes with adequate' storage and filing cabinets. Motion carried unanimously. It was moved by Aldenman Carpenter, seconded by Alderman Woods, to authorize the advertising for sale of a.certain tract of land on the airport. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by A~derman Woods, to approve the request of Downtown Merchants for a city-wide sidewalk sale for the week-end of July 28-29-30, 1977. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to approve the housing demolition and debris clearance of the following properties: 1108 & 1110 N. Grove 1214 Yokum 1307 Frisco 305 Elm 1209 Yokum Motion carried unanimously. It was moved by Alderman Woods, seconded by.Alderman SoRelle, to approve.the recommended speed from llth Street North on Quincy and authorize further study on Quincy Street from 8th to llth Street on Quincy he,made durin§schOol-year. Motion carried unani- mously. It was moved by Alderman Ca~,penter, seconded by Alderman Woods, to approve the weed mowing assessments for the following:properties: Marina Juarez - $25.00 Walter Jack Couch - ll.O0 Manuel Ramos - 20.00 Flora Lamb Estate - 28.00 Jose Ramos - 12.00 Mrs. Zora F. July 12, 1977 Page 5 CITY COUNCIL MINUTES A discussion was held about the upcoming Baseball Tournament to be held August 7-13, 1977. Received for filing, Pioneer. Natural Gas Cost of Gas Pass-through on its West Texas System for the month of May, 1977. Received for filing, the Recreation Survey conducted by the City of Plainview Park and Recreation Department. A-!discussion was held about the proposed 1977-78 Budget. Work session meeting have been set up for July 14, 15, 19 and 20, 1977. A Public Hearing has been set for July 26, 1977. It was moved by Alderman Capenter, seconded by Alderman~Almon, to approve the recommendations as made by the Planning and Zoning Advisory Committee as read. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to approve the introduction of Ordinance No. 77-2090, an ordinance by the provisions of Article lOlla, revised Civil Statutes of Texas, establishing zoning regulations and districts in accordance with a comprehensive plan and within such districts regulating the use of land, buildings and structures; the height, bulk and locations of buildings; establish- ing minimum requirements for off-street parking, regulating the erection, repair and alterations'of all buildings and structures; providing for specific use permits for certain uses; recognizing non-conforming uses and structures and rules for the regula- tions for its organization procedure, jurisdiction and powers; setting forth the requirements for building sites and the manner of their creation providing for a certi- ficate of occupancy and compliance; defining certain terms; adopting a zoning district map and making it part of this ordinance; making all figures, letters, markings, sym- bols and charts containing in said ordinance or shown on the map a part of this ordi- nance; providing a penalty for violation of the provisions of such ordinance not to July 12, 1977 Page 6 CITY COUNCIL MINUTES exceed $200 for each violation; also providing injunctive relief to persons affected by the provisions of said ordinance and providing a saving clause.
