HomeMy WebLinkAbout01.29.1964 BA Minutes BOARD OF ADJUSTMENT VARIANCE FINDZNGS Appellant_?ours~,uare Gospel Church Case No. V- 037 The undersigned, as a member or the Zoning Board of Adjustment has taken into account, among other things, the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working in such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the follow- ing findings: 1. There are special circumstances or conditions applying to the land or building for which the variance is sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to lands or build- ings in the same zone or neighborhood~and that said circum- stances or conditions are such that the strict application of the provisions of this ordinance would deprive th~ appli- cant of the reasonable use of such land or buildings; and, 2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently injur- ious to the property or improvements in such zone or neighborhood in which the property is l~cated; and, 3. The granting of the variance is necessary for the reasona- ble use of the land or building and that the variance as granted by the Board is the minimum variance that will accomplish this prupose; and, ~. The literal enforcement and strict application of the pro- visions of the zoning ordinance will result in an unnecess- ary hardship inconsistent with the general provisions and intent of such ordinance and that in granting such varinace the spirit of the ordinance will be preserved and substantis justice done° BA-OO7 5.
