The City Council of the City of Plainview met in regular session at 7:30 P. M., in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Councilmen present: Jeane Browning, Place One; Medlin Carpenter, Place Two; Tom Almon, Place Four; Wm. SoRelle, Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Bruce Byron-Administrative Assistant, Joe Sharp-City Attorney, Bill Hogge-Director of Public Works, Bob Richards-Building Inspector, M. L. Rea-City Clerk, Johnnie Ballew-Director of Public Safety, Norman Huggins-Director of Finance, Woody Sevison-Fire Chief, Jerry Austin- Assistant Police Chief and Debbie Hall-Administrative Secretary. Also present were the following visitors: Gary Ott-Plainview Daily Herald, Chuch Martin-KVOP Radio, Charles Bechtold, Robert McGinnis-Canadian River Authority, Archie Gallinoi, Timothy Sansom, Jr., Romey Fennell, Jr., Clarice Fennell, Bessie Goodson, Dillmon Jackson, R. L. Clark, A. D. Shellman, Joe Smith, Barbara Curry, Danny Owen, Ann Hawkins, Christine Sansom, Terrie Hawkins, Mike Coffin, Lela Bradic, Darlene Johnson, Pauline Brown and Katherin Hoarch. Invocation was given by Tom Almon. It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt the Resolution naming R. V. Payne as representative to the Board of Directors of the Canadian River Municipal Water Authority. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the appointments of Roy Fennell, Bob Landry and Isauro Gutierrenz to the Park, Open Space & Recreation Advisory Committee. Motion carried unanimously. Bruce Byron appeared to discuss the Curry Lake Park Project and~evi~w status'of conr ~truction~of'~Park. He explained that we have $50,000 now to work with, but are working toward a grant of $80,0.00 from the Texas Parks & Wildlife Dept., with a reply due around late September or October. Romey Fennell expressed his views about the progress of the park. July 26, 1977 Page 2 CITY COUNCIL MINUTES It was moved by Alderman Almon, seconded by Alderman Carpenter, to approve the speci- fications and authorize advertising for bid on one 4-in-1 Front-end Loader to be purchased with Revenue Sharing Funds 1978, for use in the Environmental Code Enforcement function with an estimated cost of $48,900'. Bids to be received on August 11, 1977. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRell, to approve the specifica- tions and authorize advertising for bids on one 2-1/2 Ton Dump Truck (minimum GVW Rating 27,500 lbs.) to be purchased with Revenue Sharing Funds 1978, for use in the Environmental Code Enforcement function with an estimated cost of $14,500. Bids to be received August 11, 1977. Motion carried unanimously. Mayor J. Robert WaYland opened a Public Hearing for discussion On the proposed use of Revenue Sharing Funds for the Fiscal Year 1978. Marshall Pharr, City Manager, outlined the use of the Revenue Sharing Funds. It was moved by-Alderman Carpenter, seconded by Alderman SoRelle, to close the Public Hearing. Motion carried unanimously. Mayor J. Robert Wayland opened a Public Hearing for discussion on the proposed Annual Budget for the City of Plainview for Fiscal Year 1978. Marshall Pharr, City Manager, read the Letter of Transmittal to the City Council. Public Hearing closed. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve Zone Case No. 335, the request of Danny E. Owen to rezone W/2 of Lots 8 and 9, Block 5, Brandes Subdivis~,on, City of Plainview, Hale County, Texas, same being 2910 West 10th Street, from an R-1 Zone to a C-1 Zone for commercial use, with the stipulation that a deed restriction be put on it restricting it to an OD classification. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Ordinance No. 77-209~1, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 335. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Al]derman Almon, to deny the request July 26, 1977 Page 3 CITY COUNCIL MINUTES of John C. Renfro to rezone a tract of land 155.7' x 170' out of Block 13, Wayland Heights Addition to the City of Plainview, Hale County, Texas, same being 606 South BraodWay, for removal of fence restrictions. The Council requested that the City Attorney notify owners that they have 30 days in which to come into compliance. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to table Zone Case No. 346 until further study can be made. Motion carried unanimously. It was moved by Alderman Browning, seconded~by Alderman Carpenter, to table Zone Case No. 347 until further study can be made. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelte, to approve the minutes 6f the regular City Council Meeting held July 12, 1977. Motion carried unanimously. It was moved by Al,derman Carpenter, seconded by Alderman Browning, to approve the minutes of the special City Council meeting held July 14, 1977. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to approve the minutes of the special City Council meeting held July 15, 1977. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to approve the minutes of the special City Council meeting held July 19, 1977. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve the minutes of the special City Council meeting held July 20, 1977. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter,. to approve the minutes of the special Comprehensive~Pl~nning Work Session held July 21, 1977. Motion carried unanimously. It was moved by Alde~rman Browning, seconded by Alderman Carpenter, to approve the minutes of the Unger Memorial Library Advisory Committee held on June 6, 1977. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Almon, to approve the intro- duction of Ordinance No. 77-2095, an Ordinance approving the budget submitted by the City July 26, 1977 Page 4 CITY COUNCIL MINUTES Manager of the City of Plainview, Texas, for the Fiscal Year 1977-78. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by'Alderman Almon, to approve the intro- duction of Ordinance No. 77-2096, an Ordinance levying taxes for the use and support of the Municipal Government of the City of Plainvi~w, Te×as, and providing for the interest and sinking fund for the Fiscal Year 1977-78; providing for the time and manner of paying the ad valorem taxes levied. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to adopt Ordinance No. 77-2090, an ordinance by the provisions of Article lOlla, revised Civil Statutes of Texas, establishing zoning regulations and districts in accordance with a comprehensive plan and within such districts regulating the use of land, buildings and structures; the height, bulk and locations of buildings; establishing minimum requirements for off-street parking, regulating the erection, repair, and alteration of all buildings and structures; providing for specific use permits for certain uses; recognizing non-conforming uses and structures and rules for the regulations for its organization procedure, jurisdiction and powers; setting forth the requirements for building sites and the manner of their creation providing for a certificate of occupancy and compliance; defining certain terms; adopting a zoning district map and making it part of this ordinance; making all figures, letters, markings, symbols and charts containing in said ordinance or shown on the map a part of this ordinance; providing a penalty for violation of the provisions of such ordinance not to exceed $200 for each violation; also providing injunctive relief to persons affected by the provisions of-said ordinance and providing a saving claus-e. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Appropria- tion Ordinance No. GO 391-77 from GO Park Bond Fund Account 403-812 in the amount of $833.00 payable to Billy Mauldin Fencing for moving existing fence to install baseball park to new location, Running Water Draw Regional Park. Motion carried unanimously. July 26, 1977 Page 5 CITY COUNCIL MINUTES It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. 77-2097 from Revenue Sharing Fund Account 427-680 in the amount of $150.00 payable to Bill Grisham for debris clearance at 108 Beech Street. Motion carr~ed unani- mously. The Mayor read Proclamations to be presented to Jim Alexander, Mike Gilbreath, Jose San Miguel, Lamar Hayes and Albert Perez, expressing gratitude for their acting unselfishly and rendering service above and beyond the call of duty, while attempting to put out a house fire at 3:00 am, July 16~ 1977~and rescuing two persons. It was moved by Alderman Almon, seconded by. Ald~rm~an Browning, to approve the weed mowing assessments for the following: T. I. Parks 605 W. 19th $ 8.00 Hugh M. Bain 809 W~ 7th 30.00 A. F. The following status reports were discussed: 7. ERA, INCORPORATED Negotiations 20. Plainview/Hale County Airport Improvement Program 22. Priorities for the 70's Grant Approved. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the filing of the DePartmental Reports. Motion carried unanimously.
