The City Council-of the City of Plainview met in regular session at 7:30 P. M., in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Councilmen present: Jeane Browning, Place One; Medlin Carpenter, Place Two; Lloyd~Woods, Place Three; and Tom Almon, Place Four. Also present were the following City Staff: Marshall Pharr-City Manager, Bruce Byron-Administrative Assistant, Joe Sharp-City Attorney, Wm. Hogge-Director of Public Works, Norman Huggins-Director of Finance, Johnnie Ballew-Director of Public Safety, Alan Stewart-Police Chief, Woody Sevison:Fire Chief, Tom Stephens-Municipal Judge, M. L, Rea-City Clerk, Bob RichardS-Building Inspector and Debbie Hall-Administrative Secretary. Also present were the following visitors: Doug McDonough-Plainview Daily Herald, Chuck Martin-KVOP Radio, Carol Ann Sample-Thomas E. Barber & Associates, Charles O. Couch, Martha Couchand Hitomi Itani-Japan, Lions Youth Exchange. Invocation was given by Jeane Browning. The Mayor announced that Bill Dillard, Chairman of Planning and Zoning Commission, was resigning and recommended Carl Tillerson as the new Chairman. It was moved by Alderman Carpenter, seconded by Alderman Woods to accept the recommendation of the Mayor to appoint Carl Tillerson as the new Chairman of the Planning Board and Zoning Commission. Motion carried unanimously. Reminder of bid letting for the purchase of one 1977 2-1/2 Ton Dump Truck (Minimum GVW Rating 27,500 lb.) to be purchased with Revenue Sha~?ng Funds 1978 for use in the Environmental Code Enforcement Function with an estimated cost of $14,500. Bids to be received at 10:00 am, Thursday, August 11, 1977 with bids to be awarded on August 23, 1977 at 7:30 pm at the Regular City Council Meeting. Reminder of bid letting for the purchase of one 4-in-1 Front End Loader to be purchased with Revenue Sharing Funds 1978 for use in the Environmental Code Enforcement August 9, 1977 Page 2 CITY COUNCIL MINUTES Function with an estimated cost of $48,900. Bids to be received until lO:O0 am, Thursday, August 11, 1977 with bids to be awarded on August 23, 1977 at 7:30 pm at the Regular City Council Meeting. It was moved by Alderman Woods, seconded by Alderman Almon, to approve the specifi- cations and authorize advertising for bids on the purchase of 27 Four-door Sedan Police Specials to be purchased with Revneue Sharing Funds with a ~total cost equi_p_p_~d in the amount of $189,000 to be financed by lease purchase or certificate of obligation for 3- year payment. Bids to be received on September 8, 1977 at 10:00 am; to be awarded at the Regular City Council Meeting on September 13, 1977. The Mayor presented Hitomi Itani, from Japan, with an Honorary Citizenship Award and a key to the City. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the minutes of the regular City Council meeting held July 2.6, 1977. Motion carried unani- mously. Received for filing the following minutes of commission, committee, board and authority meetings: Board of Adjustment Hearing July 25, 1977 Parks, Recreation and Opne Space Advisory August 1, 1977 Planning Board and Zoning Commission July 28, 1977 It was moved by Alderman Almon, seconded 'by Alderman Carpenter, to approve the revision of the Food Establishment Permit Fee from $5.00 to $15.00 effective October 1, 1977~and recommend to the City/County Health Board that the VDRL exam not be required as mandatory in receiving a Health Certificate. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to revise the present ordinance establishing the fee for~ Police reports from $2.00 to $5.00. Motion carried unanimously. The request for revision in Zoning Change Request Fees is a hold item at this time. August 9, 1977 Page 3 CITY COUNCIL MINUTES It was moved by Alderman Almon, seconded by Alderman Carpenter, to authorize the City Attorney to prepare an ordinance changSng the Water Rate Schedule as outlined by the City Manager. Motion carried uanimousl~. The procedure for Public Service Appointments to City Council appointed Boards, Commission, etc. in establishing standards of attendance and charges is being held until further study can be made. It was moved by Alderman Woods, seconded by Alderman Browning, to authorize the City Attorney to prepare an amendment to pro-rata Ordinance for extension of Water and Sewer Utilities. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to approve the introduction of Ordinance No. 77-20'98, an ordinance approving the Revenue Sharing Budget as submitted by the City Manager of the City of Plainview, Texas, for the Fiscal Year 1977-78. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Ordinance No. 77-2095, an Ordinance approving the Budget submitted by the City Manager of the City of Plainview, Texas, for the fiscal Year 1977-78. Motion carried unanimouSly. It was moved by Alderman Almon, seconded by Alderman Browning, to adopt Ordinance No. 77-2096, an Ordinance levying taxes for the use and support of the Municipal Government of the City of Plainview, Texas, and providing for the Interest and Sinking Fund for the Fiscal Year 1977-78; providing for.the time and manner of paying the Ad Volorem Taxes levied. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Appropriation Ordinance No. CD2-037 from Community Development Fund Account 429 in the amount of $548.14 payable to Thomas E. Barber for Planning and Consultant Services pursuant to January 28, 1975. Motion carried unanimously. August 9, 1977 Page 4 CITY COUNCIL MINUTES It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Appropriation Ordinance No. GO 392-77 from GO Park Bond Fund Account No. 403-701 in the amount of $9,553.12 payable to Jerry Wofford, Builder for 1st estimate on Community Building at Running Water Draw Regional Park (Bond, extra footing, floor, brick and plumbing). Motion carried unanimously. The matter concerning the letter from James H. Milam in behalf of the Clements property and J. C. Penny putting the City on notice was discussed. The City AttOrney is to write a letter to James H. Milam. It was moved by Alderman Woods, seconded by Alderman Almon, to approve the request of the Plainview Jaycees for a street-use permit to install a concession stand in the vicinity of Perry's Store located on Broadway on Saturday, August 13, 20, and 27, 1977, with the stipulation that they obtain a Liability Insurance Policy for $100,000.00. The following weed mowing assessments were approved: Blas Gomez, Jr. $75.00 Francis Johnson 25.00 Raymundo Villapando 25.00 Petra Rodriquez 15.00 Billy Martinez 25.00 It was moved by Alderman Woods, seconded]by Alderman Almon, to approve the follow- ing debris clearance requests: 1506 Kokomo 1214 Yoakum SE Corner of North Austin & Brazier The request of Lloyd R. Mitchell in behalf of Tri State Sandblasting to lease City of Plainview Surplus Property located in the 200 Block South Columbia is a hold at this time until further study can be made. Received for filing, copy of Cost of Gas Adjustment as submitted by Pioneer Natural Gas Co. for the Vest Texas Transmission System. Received for filing, letter from Mr. George C. Wall, Jr., District Engineer, August 9, 1977 Page 5 CITY COUNCIL MINUTES District Five, concerning speed zoning on State Highway 194 (Quincy Street). Also, received for filing, copy of letter of appreciation from Joe B. Mayo on behalf o' the Plainview Fire Department for their handling of a fire at the Llano Apartmen' s. It vas moved by Alderman Woods, seconded by Alderman Browning, to authorize the City Attorney to prepare an Ordinance declaring the paving of streets, as described by the City Manager, a public necessity. Motion carried unanimously. It vas moved by Alderman Browning, seconded by Alderman Carpenter, to authorize the City Eng neer to complete plan and specifications and advertise for bids to be received on 1976 ~BDG Water & Sewer Extensions in Gardenville Addition and vacinity of 27th and Denver; ~stimated cost of $91,290 including engineering. Bids to be received on Septem- ber 8, 1 ~77 and to be awarded September 13, 1977. Motion carried unanimously. It las moved by Alderman Almon, seconded by.
