The City Council of the City of Plainview met in regular session at 7:30 P. M., in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Councilmen present: Jeane Browning, Place One; Medlin Carpenter, Place Two; Lloyd Woods, Place Three; Tom Almon, Place Four; and William SoRelle, Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Bruce Byron-Administrative AssiStant, Joe Sharp-City Attorney, Wm. R. Hogge-Director of Public Works, Harold Gladman-Director of Planning, Bob Richards-Building Inspector, Norman Huggins-Director of Finance, Johnnie Ballew-Director of Public Safety, Alan Stewart-Direc- tor of Police Services, Woody Sevison-Director of Fire Services, Randy Holly-Section 8 Housing and Debbie Hall-Administrative Secretary. Also present were the following visitors: Gary Ott-Plainview Daily Herald, Chuck Martin-KVOP Radio, Charles Bechtold, Jim Horton, Donald Carter, Bill LaFont, Mr. & Mrs. G. E. Allen, B. B. Howle, Jerry Guthienz and J. Kuchlich. Invocation was given by Bruce Byron. Mayor Wayland announced that Fred Garrison-~will take Bill Dillard's place on the Planning Board and Zoning Commission. Appointed to the City of Plainview Housing Rehabilitation Advisory Committee were Bill SoRelle, Medlin Carpenter, Marvin Peterson, Romey Fennell and Raphel Lopez with Randy Holly as Director. It was moved by Alderman Carpenter, seconded by Alderman Almon, to award the bid to Case Power & Equipment of Lubbock for the purchase of one 4-in-1 Front End Loader to be purchased with Revenue Sharing Funds 1978 for use in the Environmental Code Enforce- ment Function in the amount of $37,400.00. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to award the bid to McGavock Pontiac for the purchase of one 1977 2-1/2 Dump Truck (Minimum GVW Rating 27,500 lb.) toL~be purchased with Revenue Sharing Fund 1978 for use in Environmental Code Enforcement Function in the amount of $12,099.00. Motion carried unanimously. August 23, 1977 CITY COUNCIL MINUTES Page 2 Reminder.of bid letting for the purchase of 27 four-door sedan Police Specials to be purchased with Revenue Sharing Funds with a'total cost equipped in the amount of $189,000 to be financed by lease purchase or certificates of obligation for three annual payments. (Bids to be received on September 8, 1977 at 10:00 a.m. and to be awarded at the Regular City Council Meeting on September 13, 1977) Reminder of bid letting for Contract agreement for Water and Sewer Extension Project with an estimated cost of $102,270.00. (Bids to be received on September 8, 1977 at t.O:O0 a.m. and to be awarded at the R~gular City Council meeting on September 13, 1977) It was moved by Alderman Browning, seconded by Alderman SoRelle, to approve Zone Case No. 341, the request of G. E. Allen for rezoning the.E/2 of Block 2, all of Block 1, Alabama Addition to the City of Plainview, Hale County, Texas, same being intersection of Columbia Street and West 24th Street, from an R-2 Zone to a C-2 Zone for Commercial use. Motion carried unanimously, It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No. 77-2092, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 341. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve Zone Case No. 348, the request of Jim Horton for rezoning a tract of land 260' x 510' out of Section 26, Block JK-2, Hale County, Texas, same being 4300 Block Dimmitt Road, Plainview, Texas from an R-1 Zone to an R-3 ZOne for multi-family dwellings. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman SoRelle, to adopt Ordinance No. 77-2099, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 348. Motion carried unanimously. It was moved by Alderman Canp~enter, seconded by Alderman Browning, to table Zone Case No. 346. Motion carried unanimously. It w.as moved by Alderman SoRelle, seconded by Alderman Woods, to table Zone Case No. 347. Motion carried 'unanimously. August 23, 1977 Page 3 CITY COUNCIL MINUTES It was moved by Alderman Almon, seconded by Alderman Browning, to approve the minutes of the regular City Council meeting held August 9, 1977. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to authorize the City. Attorney to prepare an ordinance changing the Zoning Change Request Fees to be effective October 1, 1977. Motion carried unanimously. A discussion was held concerning the procedures for Public Service Appointments to City Council appointed Boards, Commissions, Committees and Authorities in establishing standards of attendance and responsibilities. A meeting is to be set up to discuss this in more detail. It was moved by Alderman Almon, seconded by Alderman SoRelle, to authorize the Ci~ty Attorney to prepare an ordinance for extension of Water and Sewer Utilities, Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the introduction of Ordinance No. 77-2100, an ordinance amending the Food Establishment Permit Fees. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to approve the introduc- tion of Ordinance No. 77-2101, an ordinance setting fees for various police reports. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to approve the introduction of Ordinance No. 77-2102, an ordinance amending the ordinance establishing the Water Rate Schedule Charges~as amended. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to approve the introduction of Ordinance No. 77-2103, an ordinance fixing rates for the sale and delivery of water to those churches, schools, and non-profit charitable or civic organizations that have been or may be hereafter approved for the rates by the City Council of the City of Plainview, Texas. Motion carried unanimously. August 23, 1977 Page 4 CITY COUNCIL MINUTES It was moved by Alderman SoRelle, seconded by Alderman Woods, to approve the intro- duction of Ordinance No. 77-2104, an ordinance providing for a uniform monthly service charge for the collection of garbage and for furnishing water, sewer and vector control services on single family dwellings to residents of the City of Plainview. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon to approve the introduc- tion of Ordinance No. 77-2105, an..ordinance declaring public necessity for the improvement of certain designated portions of certain designated streets in the City of Plainview, 'Texas, specifying the nature and type of such improvement, establishing the manner of effectuation and method of procedure thereof, designating and separating units of work, allocating division of payment of cost, providing rule for apportionment of cost, fixing time, terms and conditions of payment of cost and providing and defining assessments therefor, specifying nature of assessment liens and personal liability, providing for issuance and provisions of assignable certificates in evidence of assessment for cost, and directing the City Engineer to prepare plans and specifications for the improvement of designated units and to publicly advertise for sealed competitive bids with Specified clause. MOtion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Ordinance No. 77-2098, an ordinance approving the Revenue Sharing Budget as submitted by the City Manager of the City of Plainview, Texas, for the Fiscal Year 1977~78. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No, CD2-038. from-Community Development Fund Account 429 in the amount of $372.74 for Planning and Consultant Services pursuant to January 28, 1975 payable to Thomas E. Barber. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt APpro- August 23, 1977 Page 5 CITY COUNCIL MINUTES priation Ordinance No. 77-2106 from Revenue Sharing Fund Account 427-681 in the amount of $2,975.00 payable to Ebeling Manufacturing Co. for 17 containers for sanitation. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to notify Mrs. Marium Gutierrez that she has 14 days to remove the building located on the Fresco Park. Motion carried unanimously. A discussion was concerning the proposed land acquistion North of the City Hall and the tract of land 25' x 140' B.B. Howle appeared before the council asking them to consider acquistion of said land. Council agreed to notify Mr. Howle of their dec~s}on With~_~14 days. It was moved by Alderman SoRelle, seconded by Alderman Browning, to adopt a resolution for removal and replacement of concrete curb and gutter along the front of the building located at 313 West. 7th Street. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to accept the Solid Waste Collection Optimization Study for the City of Plainview as proposed by Mark Turnbough. Motion carried unanimously. It was moved'by Alderman SoRelle, seconded by Alderman Browning, to authorize Study to be made concerning traffic signal at the intersection of Yonkers and 24th Street. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Woods, to approve the debris clearances as discussed. Motion carried!unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the request, for installation of loading zones located at 617 Baltimore and 908 Ash. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Woods, to authorize adver- tising for roof repair to the proposed animal shelter located at 1301 North Austin Street. It was moved by Alderman Woods, seconded by Alderman Almon, to approve the lease of property located at 200 North Columbia to Ross Mitchell. Motion carried unanimously.
