CITY COUNCIL MINUTES The City Council of the City of Plainview met in regular session at 7:30 P. M., in the Ctiy Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Councilmen present: Medlin Carpenter, Place Two; Lloyd Woods, Place Three; Tom Almon, Place Four; and William SoRelle, Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Bruce Byron-Administrative Assistant, Joe Sharp-City Attorney, Wm. R. Hogge-Director of Public Works, Harold Gladman-Director of Planning, Norman Huggins-Director of Finance, Johnnie Ballew-Director of Environment & Safety, Alan Stewart-Director of Police Services, Randy Holley-Section 8 Housing and Debbie Hall-Administrative Secretary. Also present were the following visitors: Gary Ott-Plainview Daily Herald, Charles Bechtold, Joe Aleman, Sergio L. Goniz, Roy Fennell, Romey Fennell, C. M. Peterson, Bill Hogan, Judson McManigul and Jim Bublis. Invocation was given by Alan Stewart. Mayor presented Mr. Marvin Peter~son, Mr. Romey Fennell, A~derman Carpenter and Alderman SoRelle with Certificates of Appointment to the Plainvi~ew Housing Rehabilita- tion Advisory Committee. Mr. Roy Fennell was presented with a Certificate of Appointment to the Park, Recreation and Open Space Advisory Committee. Recommended to various committes by the Mayor are as follows: (1) Park, Recreation and Open Space Advisory Committee: Frankie Davenport Jesse Sanchez (2) Planning Board and Zoning Commission: Mike Howell (3) Plainview Housing Rehabilitation Advisory Committee: Mike Sepeda (4) Plumbing Appeals & Advisory Board: James Robison and Richard Willborn (5) Board of Electrical Examiners: Mack White, Waldo Wesley, John Hughs and Pat Gonzales (6) Fire Code Board of Appeals: Don Mouser and Robert Bellamy It was moved by Alderman SoRelle, seconded by Alderman Carpenter, to approve the addendum to the specifications, for~the purchase of 27 four-door sedan Police Vehicles, as read by the City Manager. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to award the bid September 13, 1977 CITY COUNCIL MINUTES Page 2 for the purchase of 27 four-door Sedan Police Sepcials as specified~to Maggard-Nall of Plainview to be purchased with Revenue Sharing Funds in the amount of $5,225.00 each. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to approve the purchase of 28 Police Vehicles with carpet with a total cost of $146,590.00. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to approve the offer of First National Bank of Plainview for 3.5% per annum for a twenty-four month period on approximately $100,000.00 for the purchase of 27 Police vehicles. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to award the bid for the construction and installation of water and sewer improvements to H. B. Jordan in the amount of $107,183.00 to be paid for with Revenue Sharing Funds. Motion carried unanimously. Reminder of bid letting for repair and reconstruction of the roof to the animal shelter building located at 1301 Austin Street. Bids to be received at 10:00 a.m. September 20, 1977 with an estimated cost of $4,500.00. Reminder of bid letting for 1977 Street Assessment Paving Program to be purchases with Revenue Sharing Funds. Zone Case No. 346 and 347 are hold items at this time. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve the minutes of the regular City Council meeting held August 23, 1977. Motion carried unanimously. Received for filing, copies of the following minutes: Plumbing Appeals and Advisory Board Meeting Planning and Zoning Hearing Board of Adjustment Hearing Mayor's Environmental Study Committee Joe Aleman, President of the Plainview Mexican-American Chamber of Commerce, appeared September 13, 1977 CITY COUNCIL MINUTES Page 3 before the City Council to discuss the purpose and goals of the Mexican-American Chamber of Commerce of Plainview and to ask that they recognized them publicly. The procedure for public service appointments to the City Council was discussed by the City Manager. The City Attorney is to look over the ordinance, prepared by the Municipal Code Corporation, adopting the new code of ordinances for the City of Plainview. It was moved by Alderman Carpenter, seconded by Alderman Almon, to authorize the introduction of Ordinance No. 77-2108 amending the fees to be charged for Zoning Change Requests. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to authorize the introduction of Ordinance No. 77-2109 adopting the proposed amendment to the Pro-rata ordinance for extension of water and sewer utilities. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to amend the water and sewer tapping charges. Motion carried unanimously'. It was moved by Alderman Woods, seconded by Alderman SoRelle, to a~thorize the introduction o~Ordinance No. 77-2114, an ordinance establishing and setting the fee to be paid by applicant when filing an application with the Board of Adjustment~ It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No. 77-2100, an ordinance fixing the fee for the issuance of food service establishment permits. Motion carried unanimously. It was moved by Alderman Almon, seconded by. Alderman Woods, to adopt Ordinance No. 77-2101, an ordinance fixing and establishing the fee to be charged for furnishing copies of reports of any kind made and kept in the Police Department of the City of Plainview. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2102, an ordinance fixing the Water rates of the City of Plainview, Texas; and September 13, 1977 CITY COUNCIL MINUTES Page 4 repealing all ordinances or parts of ordinances in conflict herewith. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to adopt Ordinance No. 77-2103, an ordinance fixing rates for the sale and delivery of water to those churches, schools, and non-profit charitable or civic organizations that have been or may be hereafter approved for the rates by the City Council of the City of Plainview, Texas. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance No. 77-2104, an ordinance providing for a uniform monthly service charge for the collection of garbage and for furnishing water, sewer and vector control services on single famile dwellings to residents of the City of Plainview. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2105, an ordinance declaring public necessity for the improvement of certain designated portions of certain designated streets in the City of Plainview, Texas, specifying the nature and type of such improvement, establishing the manner of effectuation and method of procedure thereof, designating and separating units of work, allocating division of payment of cost, providing rule for apportionment of cost, fixing time, terms and conditions of payment of cost and providing and defining assessments therefor, specifying nature of assessment liens and personal liability, providing for issuance and provisions of assignable certificates in evidence of assessment for costs, and directing the city engineer to prepare plans and specifications for the improvement of designated units and to publicly advertise for ~ealed competitive bids with specified clause. It was! moved by Alderman Almon, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2110 from Revenue Sharing Fund Account 427-814 in the amount of $32,957 payable to West Texas Equipment Company for street sweeper - Serial No. 803-250. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to adopt Ordinance No. CD2-039 from Community Development Fund Account 429-821 in the amount of $130.54 payable to General Fund for debris clearance on 112 West 8th $65.27 and 813 Broadway.- $65.27. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No. 77-2111 from Revenue Sharing Fund Account 427-680 in the amount of $1,427.00 payable to General Fund for debris clearance on 213 Baltimore - $819.2.8, 1503 Fresco - $331.36 and 104 Date - $306.36. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2112 from Pro-rata Fund Account 434-813 in the amount of $19,135.00 payable to H. W. Taylor Construction Co. for 1977 Water & Sewer Extension Project, Construction Estimate #5. Motion carried unanimously, It was moved by Alderman Almon, seconded by Alderman Carpenter, to adopt Ordinance No. 77~2113 from Revenue Sharing Fund Account 427-681 in the amount of $1,000 payable to Mark Turnbough for partial payment for solid waste collection study. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Ordinance No. GO 393-77 from GO Park Bond Fund Account 403 in the amount of $5,525.40 payable to Jerry Wofford for partial payment on Community Center at Regional Park. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Carpenter, to adopt'Ordinance No. GO 394-77 from GO Park Bond Fund Account 403 in the amount of $17,629.00 payable to Wesley Electric for multi-purpose court lighting system at Regional Park and 16th Street Park. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Ordinance September 13, 1977 CITY COUNCIL MINUTES Page 6 No. GO 395-77 from GO Park Bond Fund Account 403 in the amount of $11,054.33 payable to Yaokum Enterprises for final payment on 4 restrooms installed in 7th Street~Park and Broadway Park, subject to Harold Gladman's, Director of Planning & Zoning, inspection. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to call the Bonding Co. to notify them that Howard Mechanical is not in compliance with the contract with the City of Plainview. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Resolution No. 77-089, a resolution identifying tracts of land necessary for acquisition of fee simple purchases and/or easements for park purposes, street right-of-way, water and sewer and/or utility easement's as described. Motion carried unanimously. It 'was decided not to acquire the tract of land North of the City Hall - 25' x 140'. It was moved by Alderman Carpenter, seconded by Alderman Almon, to approve the assignment of secruities for pledge to the City of Plainview to secure deposits by the City National Bank. Motion carried unanimously. A-.discussion was held concerning the proposed Plainview Industrial Development Seminar to be held November 1, 1977. Reminder of the South Plains Association of Governments Ninth Annual Meeting to be held in Lubbock September 15, 1977. Reminder of the 12th Annual Conference of Inter-governmental Relations and Regional Planning to be held in Lubbock September 25-27, 1977. Received for filing, Pioneer Natural Gas Co. Cost of Gas Adjustment on the West Texas Transmission System for the month of July, 1977. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve the addition of 12 sites for debris clearance. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Carpenter, to authori~ze the September 13, 1977 Page CITY COUNCIL MINUTES Mayor to sign weed assessments to be filed for record. Motion carried unanimously. A discussion was held concerning the Foxley Cattle ComPany's request for purchase of surplus of Canadian River Water. A study is to be made by the City Manager and a decision made at a later date. Received for filing, letter dated September 2, 1977, from the law offices of Mark Smith and Associates, Lubbock, Texas, concerning an accident on Saturday, August 27, 1977 at Joliet Street and West 24th Street. It was moved by Alderman Woods, seconded by Alderman SoRelle, to authorize the preparation of specifications for construction ~f sprinkler system, restroom'facilities and multi-purpose courts for Thunderbird Park aS requested by the Park, Recreation and Open Space Advisory Committee.
