The City Council of the City of Plainview met in regular session at 7:30 P. M., in the City Council Chambers of the City Hall with Mayor J~ Robert Wayland presiding and the following Councilmen present: JeaneBrowning,'Place One; Medlin Carpenter, Place Two; Lloyd Woods, Place Three; Tom Almon, Place Four; and William SoRelle, Place Five. Also present were the following City Staff: Marshall Pharr, City Manager, Bruce Byron-Administrative Assistant, Joe Sharp-City Attorney, Wm. R. Hogge-Director of Public Works, Harold Gladman-Director of Planning, Johnnie Ballew-Director of Safety and Environ- ment, NormanHuggins-Director of Finance, Bob Richards-Building Inspector, M. L. Rea- City Clerk, Walter Dodson-Tax Assessor/Collector, Alan Stewart-Director of Police Services, Woody Sevison-Director of Fire Services, Randy Holly-Section 8 Housing, and Debbie Hall- Administrative Secretary. Jenkins, Ozall Shaw, C. N. Robison and Mike Howell. Invocation was given by Tom Almon. The Mayor recommended Mr. Vic Mannin to serve on the Board of Electrical Examiners. Also, recommended to the Central Plains Higher Education Board was Richard Watson. Marlin Miller and John Ray was recommended to the Plainview Civil Defense Committee. The following person appeared to receive their Certificate of Appointment: Frankie Davenport - Park, Recreation and Open Space Advisory Committee Mike Howell - Planning Board and Zoning Commission Mike Sepeda - Plainview Housing Rehabilitation Advisory Committee Mack White and Pat Gonzales Board of Electrical Examiners Don Mouser and Robert Bellamy - Fire Code Board of Appeals September 27, 1977 CITY COUNCIL MINUTES Page 2 City Manager, Marshall Pharr, read the new Board, Commission, Committee and Authority POlicy for the City of Plainview. It was moved by Alderman Browning, seconded by Alderman Carpenter, to award the bid for the repair of the roof to the animal shelter building located at 1301 Austin Street, to Pierce Roofing, Plainview, Texas, in the amount of $4,283~70 (will not remove waste material). Motion carried unanimously. (Two bids were received by 10:00 a.m., September 20, 1977) It was moved by Alderman Carpenter, seconded by Alderman Almon, to return the bid from A & R Star Service, Inc., because it was not received on time. Motion carried unanimously. Reminder of bid letting for the 1977 Street Assessment Paving Program with bids to be received sometime in October, 1977 at 10:~00 a.m., to be paid for with Community Development Grant funds. It was moved by Alderman Woods, seconded by Alderman Browning, to remove Zone Case No. 346 and Zone Case No. 347 ~rom being tabled. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Zone Case No. 346, the request of J. Ray Pritchett to rezone a tract of land out of SW/4 of S~/4 of Section 35, Block JK-2, containing approximately 8 acres in Plainview, Hale County, Texas, same being 2800-2900 Block of West 24th Street, from an R-1 Zone to a C-1 Zone for commercial use. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Ordinance No. 77-2093, an ordinanCe amending the zoning map of the City of Plainview for Zone Case No. 346. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve Zone Case No. 347, the request of J. Ray Pritchett to rezone a tract of land out of SW/4 of SW/4 of Section 35, Block JK-2, City of Plainview, Hale County, Texas, same being 2400-2500 September 27, 1977 CITY COUNCIL MINUTES Page 3 Block of I~27 North, from an R-1 Zone to a C-1 Zone for commercial use. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2094, an ordinance amending the zoning map of the Cit~ of Plainview for Zone Case No. 347. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to table Zone Case No, 350, the request of Mrs. C. K. Shelton. Motion carried unanimously. Craig Silverthorne appeared before the Council in favor of Zone Case No..353, the request of R. Q~ Silverthorne for rezoning Lots 1 through 26, Block 1, Lots 1 through 11, Block 2, and Lots 16 through 26, Block 2, all in Howell Addition to the City of Plainview, Hat~ County, Texas, same being property at 16th and Yonkers Street, fr-om an R-3 Zone to a Specific Use Zone for neighborhood shopping center. Appearing against Zone Case No. 353 were: Mrs. Wm. H. Davis, Mr. Joseph Ruiz, Mrs. Fmeddy King, W. C. Boyd, Douglas OWen and Henry Watson. It was moved by Alderman Woods, seconded by Alderman Carpenter, to uphold the Planning and Zoning Commission decision to turn down the request of R. Q. Silverthorne. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the minutes for the regular City Council meeting held September 13, 1977. Motion carried unanimously. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No. 77-2108, amending the fees to be charged for Zoning Change Request. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance No. 77-2109, adopting the proposed amendment to the Pro-rata Ordinance for extension of water and sewer utilities. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to adopt. Ordinance No. 77-2114, an ordinance establishing and setting the fee to be paid by applicant when filing an application with the Board of Adjustment. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to adopt Appropriation Ordinance No. CD2-040 from Community Development Fund Account 429 in the amount of $268.39 for Planning and Consultant Services pursuant to Jan. 29, 1975 payable to Thomas E. Barber. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. 77-2116 from Revenue Sharing Fund Account 427 in the amount of $1,385.94 payable to White Pump Service for modification to the gasoline pump for the Police Fleet. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt ApprOpriation Ordinance No. 77-2117 from Sewer Revenue Bond Fund of 1966 426-809 in the amount of $200.00 payable to Holloway Contracting Co. for Construction Estimate No. 4 and final payment for North Quincy Street Water and Sewer Extensions, contract dated November 19, 1973. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Appropriation Ordinance No. GO 396-77 from GO Park Bond Fund Account 403 in the amount September 27, 1977 CITY COUNCIL MINUTES Page 5 of $? . payable to Howard Mechanical for material and labor on sprinkler installation at 7th Street Park and 16th Street Park. (Penalty to be figured and substracted from final payment) Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Woods, to adopt Appropriation Ordinance No. CD2-041 from Community Development Fund Account 429-821 in the amount of $912.62 payable to the General Fund for demolition on 9-17-77. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Resolution identifying tracts of land suitable for obtaining an option for location of the Sub-Fire Station and authorizing acceptance of an option subject to the State Fire Insurance Commission and the City Council approval. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt a Resolution requesting SPAG to order radios for the Plainview Police Department Fleet. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to authorize the Mayor to sign the contract as per letter from Mr. Howard Chilton from Texas A&M Univen~ si ty. Motion carried unanimously. Reminder of 12th Annual Conference of Inter-governmental Relations and Regional Planning sponsored by the Texas Association of Regional Councils to be held in Lubbock, Texas, September 25-27, 1977. It was moved by Alderman Woods, seconded by Alderman SoRelle, to reconfirm action taken at the Regular City Council Work Session on September 22, 1977 concerning the contract between the City of Plainview and Foxley Cattl~e Co. (Minimum of 200,000 and a maximum of 500,000 gallons of water per day) Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman ~Browning, to approve the recommendations of Priorities of the Parks, R~creat~on and Open Space Recreation Advisory Committee. Motion carried unanimously. Motion carried unanimously. Received for filing, letter of the Texas Department of Health dated September 12th concerning the Sanitary Landfill on Joliet. Receive for filing, letter from the Texas State Department of Health dated September 13th concerning the Sanitary Landfill located at Quincy and SW 3rd Street. Received for filing, letter from the Texas State Department of Health dated September 14th concerning method of testing of turbidity on Canadian River Municipal Water. Received for filing, letter from Dr. Carl Weidenbach dated September 6, 1977 concerning the request for T.V. Cable Service. Receive for filing, the letter from group of merchants in the vicinity of llth Street and Highway 194 (Quincy Street) concerning the request of removal]'of the medians in the block west of Highway 194. It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve the request of Chief of Police, Alan Stewart, to attend out-of-state conference of the International Association of Chief of Police to be held in Los Angeles, California, from Friday, September 30, 1977 to Friday, October 7, 1977. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve and authorize the Mayor to sign an amendment to the contract between the State Department of Highways and Public Transportation and ~he City of Plainview on improvement to U.S. Highway 70 from Amarillo to Milwee Street. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Carpenter, to approve additional sites for debris clearance as discussed. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to authorize the Mayor to sign weed assessments to be filed for record. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve the September 27, 1977 CITY COUNCIL MINUTES Page 7 request of City Manager to amend the Position Classification Plan to provide for a Utility Meter Supervisor.
