DECEMBER 3~ 1987
Those attending the Public Hearing and Board of Health meeting on
December 3, 1987 at the Plainview City Council Chambers were: Dorothy
Tilson; Dr. Anthony Lyons; Dr. Kit Kveton; Dr. Mary Bublis; Lewellen
Hooper; Donna Womble; Jim Jeffers; Tom Aday; Nina Morris; Mary Lou
Truesdale; Michelle Cammann; Scott Hallman; Cathy Donahue; Roy Resendez;
Jake Owens; Bessie Young; Richard Van Klu~ue; D.D. Gonzales; Mirible
Camacho; Juanita McElroy; Bob Tilson; and' Secretary, Elvia Montez.
Mrs. Tilson called the meeting to order. She turned the meeting over
to Dr. Anthony A. Lyons to preside over the open meeting. Dr. Lyons
opening remarls were, ~"This is a public hearing which is being conducted
by the Plainview-Hale County Health District pursuant to the requirements
of Hous~ Bill No. 2125 enacted by the Legislature of the State of Texas
relating to the authority of counties and public health districts to re-
gulate food service establishments and retail food stores. This hearing
is being held on December 3, 1987~ at 7:35 p.m. in the City Council
Chamber of the City of Plainview. ~This public haaring is being held as
required by Section 3(c) of House Bill No. 2125 prior to the adoption of
proposed orders by the Board of Directors of the Health District adopting
food service regulations, retail food store regulations, health card re-
gulations and policies on restaurant inspections as authorized by the act.
The board has previously adopted state food service regualtions and retail
food store regulation rules which, among other things, provided regulations
for permit fees~ health cards, and related regulations.
Th_is public hearing is being held after public notice of this hearing
was given by publication of notice as required by Section 3 (c) of House
Bill No. 2125 by notice of the public hearing being published in the Plainview
Daily Herald, a newspaper-of general circulation in Hale County on three
consecutive days beginning at least two weeks prior to the date of this
hearing. The notice, as published, was printed in ten point bold face type
as required by the act.
The purpose of this hearing is to obtain public opinion and input con-
cerning the adoption qf the proposed rules and regulations which I have pre-
viously mentioned. A/copy of the proposed rules and regulations has been
available at the offiqe of the Plainview-Hale County Health District and is
also abailable to'the~public at this hearing. At the close of this public
hearing, the public iq advised that the Board of Directors of the Plainview-
Hale County Health DiStrict will take action on adoption of a proposed order
adopting the food service regulations, retail food stores regulations, health
card regulations and policies on restaurant inspection. My name is Dr. Anthony
Ao Lyons. I am director of Plainview-Hale County Health District and I am the
moderator of this public hearing. Also present at this hearing is Mary Lou
Truesdale, Nursing Supervisor of the District and the following members of the
Board of Directors of the Plainview-Hale County Health District, Lewellen Hooper;
Donna Womble; Dorothy Tilson; Dr. Kit Kveton; Dr. Mary Bublis~ A tape record
of this meeting is being made by the Health District in order to make a permanent
record of the comments, opinions and input of the public at this meeting. Any
member of the public who is present will have the right to speak at this public

hearing. I will address each member of the public individually and ask
that as you come forward that you please state your name, residence address
and then make any comments which you wish to make concerning the adoption
of the proposed rules and regulations. To the extent that we are able to
do so, the members of the Board of Directors, Mrs. Truesdale, and I, will
attempt to answer questions which you may have about the adoption of the
proposed rules and regulations".
The first member of the public was Juanita McElroy, 2606 W. 19th St.,
Plainview, TX, her question was "are Health Cards really necessary?", due
to big turnover in her food establishment she felt that the cost and time
to obtain a health card unnecessary. Mrs. Truesdale commented that Health
Cards were necessary in Hale County due to the high risk of tuberculosis in
our county~ and this was one way of controlling the spread of the disease.
The second person to speak was Jake Owen, 1201N Columbia, Plainview, TX.
He also commented on Health Card expense. He pays for the health cards for
his employees, and feels that the expense is outragous~.at the end of the year.
Mrs. Truesdale advised Mr. Owen that he did not have to pay for the health
cards that shoud be the responsibility of the person who wishes to be hired.
The third person to speak was Bessie Young, 608 W. 23rd, Plainview, TX.
Her~concern was what can you do when your food establishment does not meet
regulations due to the conditions in your establishment. She can not change
the establishment due to the fact that she only leases and her inspections
score is affected by the conditions of the wooden boards she walks on.
According to food service sanitation rules floors~and floor coverings of
all food preparation, food storage, and utensil-washing areas, and the floors
of all walk-in refrigerating units, dressing rooms, locker rooms, toilet
rooms and vestibules Shall be constructed of smooth durable material such
as sealed oncrete, terrazzo, ceramic tile, and durable grandes of linoleum
or plastic, or tight wood impregnated with plastic, and shall be maintained
in good repair. Nothing in this rule shall prohibit the use of antislip
floor coveringin areas where necessary for safety reasons.
The fourth person to speak was D.D. Gonzales, 1015 Austin, Plainview, TX.
Mrs. Gonzales wanted to know what was the landlords responsibility in re-
pairing the building. HefT.landlord does not repair the building in order
for her to be in compliance with the regulations. She was advised by Ms.
Cammann, the Sanitarian, to find another building that does not have the
problems that the old building has.
Dr. Lyons continued p~esiding by asking "Does any member of the public
present at this hearing have any questions or futher comments? If not this
concludes thei~public hearing required by House Bill 2125. Thank you for
your~attendance and participation at the meeting and the members of the public
are now excused."
Dr. Lyons returned the meeting back to Mrs. Tilson.
There was a correction that needed to be made in the Policy on

moved. Dr. Mary Bublis seconded. Motion carried.
Mrs. Womble moved that the bills be paid. Dr. Kveton seconded. Motion
carried.

Dr. Kveton moved to accept Food Service Regulations as presented by
the State of Texas. Mrs. Womble seconded. Motion carried.
Donna Womble moved to accept the policy on Health Card Regulations as stated
in City .Ordinance No. 86-2681., Section 13-16. Dr. Mary Bublis seconded.
Motion carried.
Mr. Hooper moved to accept the policy on restaurant inspections as pre-
sented to the board and public on December 3, 1987. Mrs. Womble seconded.
Motion carried.
Item 5 on agenda Mrs. Womble moved to accept board of health meeting
dates but no place was designated where the meetings were to be held. Dr.
Bublis seconded on meeting dates. Motion carried.
Dr. Lyons reported an increase of brochitis and flu-like illness
was being reported. Dr. Lyons has written a letter to Dr. Dorman asking
for physician back-upffor the Prenatal Clinics no response had been
received.
Mrs. Truesdale reported that she has asked South Plains Community
Action from Levelland to lo0k into increasing our family planning funding.
We need another clinic, because of the increase in patients requesting
services. We still have no cooperation from Petersburg in renewing their
enviormental health contract. The City of Petersburg Council was to meet
on December 7, 1987, to discuss the contract.
Mr. Hooper moved to excuse Dr. C. Busby and Dr. G. Abercrombie and Lanny
Voss for for their absences, Dr. Kit Kveton seconded. Motion carried.
Donna Womble moved to adjourn. Meeting adjourn.
