The City Council of the City of Plainview met in regular session at 7:30 P. M. in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Councilmen present: Jeane Browning, Place One; Medlin Carpenter, Place Two; Lloyd Woods, Place Three; Tom Almon, Place Four; and William SoRelle, Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Joe Sharp~ City Attorney, Wm. R. Hogge-Director of Public Works, Harold Gladman-Director of Planning, Johnnie Ballew-Director of Safety and Environment, Norman Huggins-Director of Finance, Alan Stewart-Director of Police Services, Woody Sevison:Director of Fire Services, Bob Richards-Building Inspector, M. L. Rea-City Clerk, Randy Holly-Section 8 HoUsing and Debbie Hall-Administrative Secretary. Also present were~the following visitors: Chuck Martin-KVOP Radio, Gary Ott-Plainview Daily Herald, Louise Groff, Richard E. Whitfield, LaVern Vinson, G. R. Billingsley, Charles Humphreys, Joe D. Mote, Rickey Davis, Brends Pierce, Charles Bassett, Brenda Holly, John Kirchoff, RObert Bellamy and B. B. Howle. Invocation was~given by Bill Hogge. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the reCOmmendation of Mayor Wayland to appointRandy Kidd,'John Stoneham, Jerry Guth~enz, B. B. RHo~le, Carey~Eaves. ~ and Lloyd Belk to.the ~dvisory Committee to study possible revisions to the Subdivision Ordinance. Motion carried unanimously. Charles Bassett was present to receive his Oertificate of Appointment to the Central Plains Higher Education Authority. (Estimated cost $ ) It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the specifications and authorize advertising for purchase of Police car consoles to be purchased with Revenue Sharing Fund and bids to be received on November 7, 1977 at 10:00 a.m. (To be awarded atithe regular City Council Meeting on November 8, 1977. Estimated cost $6,400.00) It was moved by Alderman Browning, seconded by Alderman Carpenter, to approve the specifications and authorize advertising for purchase of 20 emergency lighting and sound systems and 8 additional siren amplifiers and speakers, to be purchased with Revenue Sharing Funds and bids to be received on November 7, 1977 at 10:00 a.m. (To be awarded at the regular City Council Meeting on November 8, 1977. Estimated cost $16,500.00) It was moved by Alderman SoRelle, seconded by Alderman Woods, to approve Zone~Case No. 351, the request of Mr. C. M. Peterson for rezoning Lots 4, 5, 6, and S/5.66' of Lot 3, Block 1, Gardenville Subdivision to City of Plainview, Hale County, Texas, same being intersection of West 25th Street and Quincy, from an R-1 Zone to a CGB Zone for Commercial Use. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Ordinance No. 77-2119, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 351. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to approve Zone Case No. 352, the request of L. James Robison for rezoning an 8 acre tract 375' x 930' out of the NE corner of SE/4 of Section 28, Block JK-2, Hale County, Texas, from an R-1 Zone to a CRD Zone for Y.M.C.A. building, same being 313 Ennis Street. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon,"to adopt Ordinance No. 77-2120, an ordinance amending the zoning map of the City of Plainview for Zone Case No. October 25, 1977 CITY COUNCIL MINUTES Page 3 352. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve Zone Case No. 355, the request of Louise Groff for rezoning a tract of land 185' x 303.5' out of Section 34, Block JK-2, Hale County, Texas, from an R-1 Zone to an CGB Zone for Commercial Use, same being 2503 West 24th Street, with the stipulation that it be platted before being rezoned. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Ordinance No. 77-2121, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 355. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve Zone Case No. 356, the request of John Kirchhoff for rezoning a tract of land 60' x 520' out of the NW part of Section 26, Block JK-2, Hale County, Texas, from an R-1 Zone to an R-3 Zone for Multi-family dwellings, same being 4300 Block of Dimmitt Road and containing approximately .70 acres, ~.~Motion carried Unanimously. It was moved by Alderman Browning,'-seconded by Alderman Carpenter, to adopt Ordinance No. 77'2122, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 356. Mot$on carried unanimously. It was moved by Alderman Browning, seconded by Alderman Woods, to approve Zone Case No. 357, the request of B. B. Howle for rezoning the following described property: TRACT NO. 1: A 5.102 acre tract out of the North part of the NW/4 of Section 28 and the South part of the SW/4 of Section 27, Block JK-2, Hale County, Texas; TRACT NO. 2: A 6.086 acre tract out of the North part of Section 28, Block JK-2, Hale County, Texas; TRACT NO. 3: A 2.338 acre tract ou~ of the North part of the NW/4 of Section 28, and the South part of the SW/4 of Section 27, Block JK-2, Hale County, Texas. from R-1 and C-1 Zones to CGB Zone for Commercial Use, same being 4100 through 4500 Block Olton Road, with the stipulation that platting be done. Motion carried unanimously. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve Zone Case No. 358, the request of Charles Humphreys to rezone a 5 tract of land out of the East part of the SW/4 of SectiOn 40, Block JK-2, Hale County, Texas, from an R~I Zone to an L-1 Zone for assembl~y and sale of small steel buildings, same being 200 Block of Joliet, with stipulation that platting be done before zoning. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Ordinance No. 77-2124, an..ordinance amending the zoning map of the City of Plainview for Zone Case No. 358. It was moved by Alderman Browning, seconded by Alderman Woods, to approve Zone Case No. 359, the.request of Rickey Davis for rezoning Lots 7, 8 and S 11' Lot 9, Block 64, Alexander and Westmoreland Addition to the City of Plainview, Hale County, Texas, from an R-3 Zone to an-¢NS Zone for Commercial Use, loacted 412 West 9th Street. Motion carried unanimously. It was moved by Alderman Almon, secondedby Alderman SoRelle, to adopt Ordinance No. 77-2126, an ordinance adopting and enacting a new code of ordinances of the City of Plainview, Texas; establishing the same; providing for the repeal of certain ordinances not included therein; except as herein expressly provided; providing for the effective date of such code and a penalty for the violation thereof; providing for the manner of amending such code; and providing when this ordinance shall become effective. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Woods, to adopt "Ordinance No. 77-2127, an ordinance declaring public necessity for the improvement of certain designated portions of certain designated streets in the City of Plainview, Texas, specifying the nature and type of such improvement, establishing the manner of effectuation and method of procedure thereof, designating and separating units or work, allocating division of payment of cost, providing rule for apportionment of cost, fixing time, terms and conditions of payment of cost and providing and defining assessments therefor, specifying nature of assessment lines and personal liability, providing for ~ssuance and provisions of assignable certificates ~n evidence of assessment for costs, and directing the city engineer to prepare plans and specifications for the improvement of designated units and to publicly advertise for sealed competitive bids with specified clause. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. CD2-042 from Community Development Fund Account 429-820~n the amount of $209.40 payable to the General Fund Account 419-010 for advertising on September 22, 1977 October 25, 1977. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Appropriation Ordinance No. GO 399-77 from GO Park Bond Fund Account 603-701 in the amount of $228.35 payable to Hod§es Electric for Community Center electrical extra. Moti6n carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Browning, to adopt Appropriation Ordinance No. 77-2134 from Revenue Sharing Fund Account 427-701 in the amount ~f $1,417.50 payable to Peterson Construction Company for Construction Estimate No. 2, concrete material stOrage binns, contract dated May 11, 1977. Motion carried unani.mOusly. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. CD2-043 from Community Development Fund Account 429-820 in the amount of $943.05 payable to Thomas E. Barber for Planning and Management Consultant Services pursuant to March 22, 1977 for services performed from September 1, 1977 to September 30, 1977. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. 77-2135 from Revenue Sharing Fund Account 427-804 in the amount of $12,099.00 payable to McGovock Pontiac for the purchase of one (1) GMC Truck complete with dump bed. Motion carried unanimously. The correspondence concerning ERA from Ray Rampy, Jerome M. Gutheinz and Tom Sheppard was discussed. The Contract between Foxley Cattle Co. and the City of Plainview was discussed. Received for filing, final compiled list of sites authorized for debris clearance with use of Revenue Sharing Funds. It was moved by Alderman SoRelle, seconded by Alderman Almon, to authorize a public hearing to be held on November 22, 1977 at the regular City Council Meeting and notice to be given. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to approve the request October 25, 1977 CITY COUNCIL MINUTES Page 7 of Furr's Cafeteria, Inc. to pave alley between Lots 16 & 17, Grandvie~ Addition, subject to the City Engineers specifications. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to adopt the Fire Department Agility Test as a Standard Operating Procedure. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Carpenter, to approve the request of Andy Taylor Trucking Co. for solid waste collection. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to authorize the city engineer to make a study on water line extension as requested by Bob Farmer. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the naming of the new community center to Plainview Rotary Community Center. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Woods, to approve the new policy on use of recreational facilities. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to authorize the introduc- tion of Ordinance No. 77~2136, amending Ordinance No. 72-1254 providing for changes in the requirements for a Food Handlers Permit in the City of Plainview as recommended by the Plainview/Hale County Health Board. Mot~-on carried unanimously. Received for discussion and filing, Resolution adopted by the Canadian River Municipal Water Authority approving the proposed Rate Manual. It was moved by Alderman Woods, seconded by Alderman SoRelle, to authorize the Mayor to sign the contract between the City of Plainview and Angel Pena as discussed. Motion carried unanimously.
