CITY COUNCIL MINUTES
The City Council of the City of Plainview met in regular session at 7:30 P. M. in
the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and
the following Councilmen present: Jeane Browning-Place Ohe, Medlin Carpenter-Place
Two, Lloyd Woods-Place Three, Tom Almon-Place Four and William SoRelle-Place Five.
Also present were the following City Staff: Marshall Pharr-City Manager, Joe Sharp-
City Attorney, Wm. R~ Hogge-Director of Public Works, Harold Gladman-Director of Planning,
Johnnie Ballew-Director of Safety and Environment, Norman Huggins-Director of Finance,
Alan Stewart-Director. of Police Services, Woody Sevison-Director of Fire Services, Bob
R~,chards-Building Inspector, ~M. L. Rea-City Clerk, Charles Couch-Service Center Super-
visor, Randy Holly-Director of Section 8 Housing and Debbie Hall-Administrative Secretary.
Also present were the following visitors: Gary Ott-Plainview Daily Herald, Charles
Bechtold, Brenda Holly and Joe Baker.
Invocation was given by Joe Sharp.
Reminder of bid letting on purchase of two 5/8 ton pickups, two 3/4 ton pickups
and three dump trucks on December 8, 1977 at 10:00 a.m. and awarded at regular City
Council Meeting on December 13, 1977.
R~minder of bid letting on purchase of street sign poles and steel drive rivets
on December 8, 1977 at ~0:00 a.m. and awarded at the regular ~City Council meeting on
December 13, 1977.
Reminder of bid letting for improvements to the Plainview½Hale County Airport
to be received on December 13, 1977.
Reminder of public hearing to be held on December 13, 1977 at 7:30 P. M. at ~he
regular City Council Work Session concerning the request for Cable T-V Service by Dr.
Carl Weidenbach.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve the
minutes of the regular City Council meeting held on November 22, 1977. Motion carried

It was moved by Alderman Browning, seconded by Alderman Almon, to authorize the
City Attorney_to prepare an ordinance rev.iSing the Building Code of the City of Plainview.
Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Browning, to introduce
Ordinance No. 77-2169, an ordinance revising the Building Code; an ordinance of the City
of Plainview regulating the erection, construction, enlargement, alteration, repair;
moving, removal, demolition, conversion, occupancy, equipment use, height, area and
maintenance of all buildings and/or structures in the City of Plainview, Texas:
providing for the issuance of permits and collection of fees, therefor; providing
penalties for the violation thereof; declaring and establishing fire zones: repealing
Ordinance No. 74-1514 of the City of Plainview, and all other ordinances and parts of
ordinances in conflict herewith. Providing for the adoption of the 1976 edition of
the Uniform Building Code, Volume 1, as copyrighted in 1976 by the International
Conference of Building Officials, Whittier, California with certain amendments therto:
directing publication of the descriptive caption of this ordinance, with the penalty
provisions of the Uniform Building Code 1976 Edition and providing an effective date
of this ordinance. Motion carried unanimous, ly.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to authorize the
City Attorney to prepare an ordinance amending the Fire Code Ordinance. Motion carried
unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to introduce Ordinance
No. 77-2170, an ordinance amending the Fire Code Ordinance; an ordinance of the City of
Plainview regulating and Controlling the maintenance of buildings and premises; to safe-
guard life, health, property and public welfare by regulating the storage, use and ~

handling of dangerous and hazardous materials, substances and processes, and by
regulating the maintenance of adequate egress facilities, providing for the repealing
of Ordinance No. 75-1833 of the City of Plainview, providing for adoption of the
Uniform Fire Code, 1976 Edition, as copyrighted in 1976; the International Cohference
of Building Officials of Whittier, California, providing for certain amendments thereto;
providing a severability clause; directing publication of the descriptive caption of
this ordinance, together with the penalty provisions, and providing an effective date of
this ordinance. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Browning, to introduce Ordinance
No. 77~21i74, an ordinance allowing certain employees of the City who have terminated
previous membership in Texas Municipal Retirement System, to deposit the sums so
withdrawn, plus annual Withdrawal charges, and allowing and undertaking the cost of
allowing any such employee credit in such system for all services to which such
employee had been entitled at date of such withdrawal, with like effect as if all such
service had been performed as an employee of this city. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman C.arpenter, to introduce
Ordinance No. ~~ an ordinance fixing the fees to Charged and collected for
Building Permits. Motion carried unanimously.
It was movedLby Alderman Woods, seconded by Alderman Carpenter, to introduce
Ordinancei~No. 77-2172, an ordinance amending Sections 5.17 and 5.18 of Ordinance No.
75-1835 of the City of Plainview, Texas, and known as the Electrical Code. Motion
carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to introduce Ordinance
No. 77-2173, an ordinance amending Subsection 9.2'.1. and Subsection 9.2.2. of Section
9.2 of Ordinance No. 73-1366, known as the Plumbing Code of the City of Plainview, Texas.
Motion carried unanimously.

It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Ordinance
No. 77-2152, an ordinance changing the regular meeting of the City Council from Tuesday,
December 27, 1977, to Tuesday, December 6, 1977, and providing that said regular meeting
shall be held at 7:30 o'clock p.m. on said date, December 6, 1977. Motion carried
unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No.
77-2153, an ordinance fixing the fee for the usage of the Shelter House and the Rotary
Center and fixing and requiring a clean-up deposit, and providing requirements pertaining
to the use of said buildings. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Ordinance
No. 77-2154, an ordinance making it unlawful to drive or operate, on or over any street
in the City of Plainview, Texas, a vehicle transporting ready-mix concrete of a weight
exceeding 12,000 pounds on a~single axle, or exceeding 36,000 pounds on a tandem axle,
or exCeeding 48,000 pounds gross vehicle weight. Motion carried unanimously.
It~.~was moved by Alderman Carpenter, seconded by Alderman Woods, t~o'adopt Ordinance
No. 77-2155, an ordinance amending Section 39 of Ordinance No. 77-2090 of the City of
Plainview generally referred to as the "Zoning Ordinance" of the City of Plainview.
Motion carried unanimously.
It was moved by Alderman Brow~i~ng, seconded by Alderman Carpenter, to adopt Ordinance
No. 77-2160, an ordinance asserting correctness of preamble and directing the Mayor of
the City of Plainview, Texas, to execute contract with High Plains Pavers, Inc.., a
Corporation, an specifying and terms thereof. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Ordinance No.
77-2161, an ordinance approving the form and substance of contract and contract documents
executed by High Plains Pavers, Inc. providing for construction of improvements to be
made to certain streets in the City of Plainview; authorizing and directing the Mayor
to execute same; accepting the pabanent bond and performance bond; directing the City

Engineer to prepare and file with the City Clerk estimates and rollS as required by
law for each street unit to be so improved. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Carpenter, to adopt Appropria-
tion Ordinance No. 77-2162 from Revenue Sharing Fund Account 427-804 in the amount of
$38,300 payable to Case Power & Equipment Co. for purchase of one (1) articulated four-
wheel drive loader complete with'four-in-one bucket. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Aimon, to adopt Appropriation
Ordinance No. 77-2163 from Revenue Sharing Fund Accoint 427-680 in the amount of $186.52
payable to General Fund for Code Enforcement - Debris Clearance, Project #151 at 903 West
14th Street. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropria-
tion Ordinance No. CD2~045 from Community Development Fund Account 429-821 in the amount
of $7,929.82 payable to City of Plainview General Fund for debris clearance on the
following projects: #359, #322, #368, #330, #374 and #356. ~'Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Appropriation
Ordinance No. CD3-046 from Community Development Fund Account 429-831 in the amount of
$2,471.18 payable to City of Plainview General Fund for debris clearance on the
following projects: #365, #293, #329, #277 and #316. Motion carried unanimously.
It was moved by]Alderman Browning, seconded by Alderman Carpenter, to adopt
Appropriation Ordinance No. ¢D3-047 from Community Development Fund Account 429-831
in the amount of $333.60 payable to General Fund Account 620-225 for Code Enforcement
supplies and repairs used on project #374 - alley North of West 26th Street in
Gardenville. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Appropria-
tion Ordinance No. CD2-048 from Community Development Fund Account 429 in the amount
of 12,1~09.07 payable to H. B. Jordon & Co., Inc. for Construction Estimate No. 1,

Sanitary Sewer and Water Distribution Extensions Project No. B-76-DN-48-O082. Motion
carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Appropriation
Ordinance'No. 77-2164 from Pro-rata Construction Fund Account 434-813 in the amount of
$29,375.27 payable to H. W. Taylor Construction Co. for construction Estimate No. 7,
Water and Sewer Extensions. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Resolution
No. R77-097, a Resolution recognizing Joe Sharp's devoted service to the City of
Plainview for the past 23 years. Motion carried unanimously.
It was moved by Alderman Browning~ seconded by Alderman Woods, to approve the
Merit Raise guidelines as discussed in the Inter-office Memo sen~ out by the City
Manager. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to authorize the
Mayor to sign contract between the City of Plainview and West Texas Paper Co. for the
purchase of recycleable newspaper in Plainv~w, subject to the City AttOrney's approval,
and authorize the purchase of containers. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Woods, to authorize the
Mayor to sign an agreement between the City of Plainview and the State of Texas acting
by and through the State Department of Highways and Public Transportation for an
agreement for the installation of improved or modernized signals at Columbia and
24th Street, Olton Road and Yonkers Street, U.S. 70 and Milwaukee at an estimated
cost of $45,500.00 of wh~ch the City of Plainview agrees to pay an estimated cost
of $4,5B0.00 to include primarily engineering, construction engineering and contin-
gencies. MOtion carried unanimously.
Receive for filing, letter from Mr. Elton D. Rhodes for the sale Of Lot 1,
Block 2, Allbrick Addition as a proposed portion of the Fire Station Site.

A discussion was held concerning the rezoning of land use classifications in the
City, of Plainview so as to ultimately eliminate the land' use Classifications in the
previously revised ordinance. The discussion was tabled.
It was moved by Alderman Carpenter, seconded by Alderman Browning, to authorize the
City Attorney to prepare a contract and authorize the Mayor to sign said contract for
the sale of a lot located at the SE Corner of West 10th Street~and Austin Street adjoining
the Plainview Parking Lot Facility. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Browning, to authorize the
Mayor to sign Lease No. DOT-FA78SW-lO18 for the Rotating Beam Ceilometer (RBC). Motion
carried unanimously.
Received for filing, code enforcement projects. (25 ~projects completed and 71
projects incomplete.)
It was moved by Alderman Browning, seconded by Alderman SoRelle, to authorize the
City Manager to request the Texas Department of Highways and Public Transportation to
conduct a recommended speed zone study on U.S. Highway 194 from the Intersection of
Interstate 27 NW to Westridge Road. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded'by Alderman Browning, to file letter
from Texas Department of Health concerning city/,county Health Department as submitted
by Hal L. Nelson. Motion carried unanimously..-
Discussion was held concerning the memorandum from the Texas Department of
Community Affairs and it was decided to decline their offer-and writea letter of
thanks to them.
Received for filing, letter from the Office of the Governor of the State of Texas
concerning grant applications for Innovative Grants for Energy Conservation.
Received-ifor filing, Pioneer Natural Gas Company Cost of Gas Pass-through for
the month of October, 1977.

It was moved by Alderman SoRelle, seconded by Alderman Almon, to recess the City
Council Meeting until 10:00 a.m., December 7, 1977. Motion carried unanimously~ Meeting
was recessed at 10:40 p.m.
Meeting Reconvened 12-9-77
It was moved by Alderman Carpenter, seconded by Alderman, to reconvene the City
Council Meeting which was recessed at 10:40 p.m. on December 6, 1977. Motion carried
unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Almon, to appoint Tom
Hamilton as the new City Attorney of the City of Plainview, to become effective on
January 1, 1978. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to adjourn the
meeting. Meeting adjourned at 3:15 P.M.
