CITY COUNCIL MINUTES
The City Council of the City of Plainview met in regular session at 7:30 P. M. in
the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and
the following Councilmen present: Jeane Browning-Place One, Medlin Carpenter-Place Two,
Lloyd Woods-Place Three, Tom Almon-Place Four, and Bill SoRelle-Place Five.

It was moved by Alderman Almon, seconded by Alderman Woods, to accept the appoint-
ments as recommended by the Mayor. Motion carried unanimously.

It was moved by Alderman Carpenter, seconded by Alderman Browning, to award the
bid for the purchase of two 5/8 ton pickups, two 3/4 ton pickups and three dump trucks
to the low bidder of Steve McGavock in the amount of $41,553.59. Motion carried
unanimously.
It was moved by Alderman Woods, seconded by Alderman Atmon, to award the bid for
the purchase of street sign poles and steel drive rivets to Unistruck of Arlington in
the amount of $7,549.00. Motion carried unanimously.
~arshall Pharr-City Manager discussed the bids received for improvements to the
Plainview/Hale County Airport. He explained that final approval and award of the bid
would have to follow a joint meeting ~i~h the City Council, Hale County Commissioners,
A~rport Board, representative from the Texas Aeronatics~Commission and representative
from the Albuquerque Office of the~'Federal Aviation Administration, which is to be held
on December 20, 1977.
Reminder of bid letting on the purchase of a multi-channel system on January 5,
1978 and to be awarded at the regular City Council meeting on January 10, 1978.
Mayor Wayland opened a public hearing concerning the request of Cable TV service
by Dr. Carl Weidenbach.
City Attorney, Joe Sharp, discussed the franchise. Appearing for the request was
Dr. Carl Weidenbach~ Jim Lancaster appeared on behalf of Cable TV. Also appearing
was Lon Cartwright and Raymond Prather.
The Council requested the Cable TV Engineer's Report and will make a decision after
studying this report.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Zone
Case No. 361, the request of Jerry Wofford for rezoning a 5.58 acre tract out of the

NW part of Section 28 and the SW part, of Section 27, Block JK~2, Hale County, Texas and
containing 5.57 acres of which 5.051 acres is in Section 27 and 0.525 acre is in Section
28, located 4500 Block Olton Road, from C-2 Zone to a CGB Zone for warehouses and offices.
Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Woods, to adopt Ordinance
No. 77-2165, an ordinance amending the zoning map of the City of Plainview for Zone Case
No. 361. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to approve Zone Case
No. 363, the request of Rex Ramsower for rezoning a tract 400.00' x 292.97' out Of the
West part of the E/2 of Section 27, Block JK-2, Hale County, Texas, containing approxi-
mately 2.69 acres, located 1000 Block 1-27 North from R-1 and R-3 Zoning to a CRD Zoning
for Commercial Use. Motion carried 4-For and 1-abstaining.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance
No. 77-2166, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 363. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Almon, to table Zone Case
No. 364 until Council receives~further information. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve Zone Case
No. 365, the request of Charles Humphreys for rezoning a 5 acre tract of land out of
the SW/4 of Section 40, Block JK-2, Hale County, Texas, located 200 Bl~ock South Joliet
Street, from an R-1 Zone to an L-1 Zone for assembly and sale of small steel buildings.
Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alde~rman Browning, to adopt Ordinance
No. 77F216~, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 366. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Browning, to approve the

minutes of the regular City Council meeting held December 6, 1977. Motion carried
unanimously.
Received for filing, minutes of the Unger Memorial Library Advisory Committee held
November 7, 1977.
It was moved by Alderman Browning, seconded by Alderman Woods, to adopt Ordinance
No. 77-2171, an ordinance fixing the fees to be charged and collected for Building Permits.
Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Ordinance
No. 77-2172, an ordinance amending Sections 5.17 and 5.18 of Ordinance No. 75-1835 of
the City of Plainview, Texas, and known as the Electrical Code. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Ordinance
No. 77-2173, an ordinance amending SubSection 9.2.2. and Subsection 9.2.2. of Section
9.2 of Ordinance No. 73-1366, known as the Plumbing Code of the City of Plainvi~ew, Texas.
Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Ordinance
No. 77-2169, an ordinance of the City of Plainview, regulating the erection, construction
enlargement, alteration, repai'P, moving, removal, demolition, conversion, occupancy,
equipment use, height, area and maintenance of all buildings and/or structures in the
City of Plainview, Texas; Providing for the issuance of permits and collection of fees,
therefor; providing penalties for the violation thereof; declaring and establishing
fire zones: repealing Ordinance No. 74-1614 of the C~ty of Pl~inv~ew, and all other
ordinances and parts"of ordinances in conflict herewith. Providing for the adoption
of the 1976 edition of the Uniform Building Code, Volume 1, as copyrighted in 1976
by the International Conference of Building Officials, Whittier, California, with certain
amendments thereto: directing publication of the descriptive caption of this ordinance,
with the penalty provisions of the Uniform Building Code 1976 Edition and providing

an effective date of this ordinance. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Ordinance No.
77-2170, an ordinance of the City of Plainview regulating and controlling the maintenance
of buildings and premises; to safeguard life, health, property and public welfare by
regulating the storage, use and hahdling of dangerous and hazardous materials, substances
and processes, and by regulating the maintenances of adequate egress facilities,
providing for the repealing of Ordinance No. 75-1833 of the City of Plainview, providing
for adoption of the Uniform Fire Code, 1976 Edition, as copyrighted in 1976; the
International Conference of Building Officials of Whittier, California, providing~for
certain amendments thereto; providing penalties for the violation thereof; providing a
severability clause; directing publication of the descriptive caption of this ordinance,
together with the penalty provisions, and providing an effective date of this ordinance.
Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance No.
77-2174, an o~dinance allowing certain employees of the~.C$%y~ho have terminated previous
memberships in Texas Municipal Retirement System, to deposit~:~the sums so withdrawn, plus
annual withdrawal charges, and allowing and undertaking the cost of allowing any such
emplOyee credit in such system for all services to which such employee had been entitled
at date of such withdrawal, with like effect as if all such service had been performed
as an employee of this City. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance No.
77-2175, an ordinance approving and adopting the written statement and report of the
City Engineer. Motion carried unanimously.
David' JUlien was approved as the appraiser by concurrance for the improvements to
streets as described in Ordinance No. 77-2175.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve

specifications and authorize the advertising for refuse containers. Bids to be received
on January 5, 1978 and awarded on January 10, 1978. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to table Zone Case No.
366, Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to adopt Appropria-
tion Ordinance No. CD2-O49~from Community Development Fund Account 429-830 in the amount
of $2,038.38 payable to Thomas E. Barber & Associates for Planning and Management Consultant
Services pursuant to March 22, 1977. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Appropriation
Ordinance No. 77~2176 from Revenue Sharing Fund Account 427-620 in the amount $907.~0
payable to General Fund 620-701 for materials and service used on the proposed new
animal shelter at 12th and North Austin. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to adopt Appropria-
tion Ordinance No. 77-2177 from Revenue Sharing Fund Account 427-607 in the amount of
$1,538.45 payable to South Plains Association of Governments for high-speed teletype
network upgrade, subject to the Police Chief's satisfaction of operation. Motion carried
uannimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Resolution No.
R77-099, a resolution of the City Council of the City of Plainview establishing just
compensation for the parcels of property listed herein and located in the Community
Development Project area'. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to accept the
proposal from Parkhill, Smith and Cooper and authorize the Mayor to sign said proposal
concerning sanitary sewage effluent. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Woods, to accept recommendation
of the State Highway Department for a Speed Zone Ordinance on Quincy Street (SH 194)

from 5th Street (U.S. Highway 70), North to City Limits on SH 194. Motion carried
unanimously.
After some discussion, it was moved by Alderman Carpenter, seconded by Alderman Woods,
to accept the rezoning of land use classifications in the City of Plainview so as to
ultimately eliminate the land use classifications in the previously revised ordinance,
w~th,~the Austin He~ghts area to be rezoned first. Motion carried 4 yes (Carpenter, Woods,
Almon & SoRelle) and 1 no (Browning).
Joe Sharp made a ~et~mement speech, this being his last City Council meeting as
City Attorney.
Meeting to be held January 3, 1977 in the City Council Chambers to swear in the
new City Attorney, Tom Hamilton.
There being no further business, the meeting was adjourned at 11:17 p.m.
