The City Council of the City of Plainview met in regular session at 7:30 P. M. in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the fOllowing Councilmen present: Jeane Browning-Place One, Medlin Carpenter-Place Two, Lloyd Woods-Place Three, Tom Almon-Place Four, and William SoRelle~Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Tom Hamilton- City Attorney, Harold Gladman-Director of Planning, Bill Hogge-Director of Public Works, M. L~ Rea-City Clerk, Norman Huggins-Director of Finance, Alan Stewart-Director of Police Services, Woody Sevison-Director of Fire Services, Randy Holly-Director of Section 8 Housing, Buddy Dodson-Tax Assessor-Collector, Bob Richards-Building Inspector~ Tom Stephens-Municipal Court Judge, and Debbie Hall-Administrative Secretary. Also present were the following visitors: Doug McDonough-Plainview Daily Herald, Chuck Martin-KVOP Radio, Charles Bechtold, Bill McBride, Leo Phil-lips, LeRoy Henry, C. L. Abernathy, Earl Jackson, Austin Ragland~ Gary Traylor, Brenda Holly, Jack Skaggs, James Robison, Jimmy Bublis, Nancy Bublis, Morris Smith and John Ray. Invocation was given by Woody Sevison Those present to receive their Certificate of Appointment were as follows: 1. City Charter Study Committee - Morris Smith, Austin Ragland and Jack Skaggs 2. Plumbing Appeals Board - James Robison 3. Tax Equalization Board - Bill McBride 4. Civil Defense Committee - John Ray Jack Skaggs, Chairman of the City Charter Study Committee, appeared to mal~e a recommenda- tion Changing the present procedure of a run-off election from the Sixth Tuesday following the election to within 30 days following the election. It was moved by Alderman SoRelle, seconded by Alderman Almon, to accept the recommenda- tion as outlined by Jack Skaggs. Motion carried unanimously. ~ It was moved by.Alderman Woods, seconded by Alderman Carpenter, to authorize the City Attorney to prepare an ordinance allowing the Plainview Slow Pitch Softball Association to sell concessions at Running Water Draw Regional Park. Motion carried unanimously. February 14, 1978 Page 2 CITY COUNCIL MINUTES It was moved by Alderman Browning seconded by Alderman Woods, to open the Public Hearing on the Community Development Block Grant Program of the U.S. Department of Housing and Urban Development. Motion carried unanimously. Marshall Pharr-City Manager made presentation concerning Community Development Block Grant Programs for the years 1975, 1976 and 1977. Gary Traylor, with Tom Barber & Associates, made presentation on the guidelines the City of Plainview must follow in order to qualify for Community Development Block Grant Programs. It was moved by Alderman Woods, seconded by Alderman SoRelle, to close the Public Hearing. Motion carried unanimously. Zone Case No. 370 was tabled until the next meeting to be held on February 28, 1978. It was moved by Alderman Carpenter, seconeed by Alderman Woods, to approve the minutes of the regular City Council meeting held January 24, 1978. Motion carried unanimously. City Charter Study Committee February 7&9, 1978 It was moved by Alderman Woods, seconded by Alderman~Almon, to introduce Ordinance No. 78-2197, an ordinance ordeYing an election in the City of Plainview, Texas, for the purpose of submitting to the qualified voters of the City of Plainview, for adoption or rejection, proposed amendment to the existing charter of the City of Plainview; ordering said election to be held at the same time that the City of Plainview has its next regular Municipal Election, said date being the first Saturday in April of 1978; providing for publication of the election in the newspaper of general circulation to be published in the City of Plainview on the same day in each of two successive weeks, the date of the first publication to be not less than 14 days prior to the date set for February 14, 1978 CITY COUNCIL MINUTES Page 3 said; providing in the form of such notice; providing for ballots; designating the place that the said elections will be held; and appointing presiding officials. Motion carried unanimously. It was mow d by Alderman Woods, seconded by Alderman SoRelle, to introduce Ordinance No. 78-2198, an ordinance establishing the administrative procedure for the Flood Hazard Preventi(n Ordinance, _setting out the Statutory Authority, finding of fact, purpose and method; pro~'iding certain definitions; general provisions; designating the Director of Planning and Building Codes as the local administrator, authorizing him to issue permits; replacing various procedure and appeal procedure in that of the City of Plainview Board of Appeal.< and setting general standards for provision for Flood Hazard reduction; and providing a penalty. Motion carried unanimously. It was mow d by Alderman Carpenter, seconded by Alderman Browning, to introduce Ordinance No. 7~.-2199, an ordinance declaring the policy of the City of Plainview, defining terms; prohibiting discrimination in the sale or rental housing; prohibiting discrimination in the financing of housing; prohibiting discrimination in the provisions of brokerage se~vices; providing for certain exemption and exclusions; providing for the position of fair housing administrator; providing for the receipt, investigation and conciliation of compliants alleging~discrimination in housing, authorizing the City Attorney to inslitute l~gal proceedings; forbidding intimidation; providing for cooperation wit~ the Secretary of Housing and Urban Development; providing for education and public information; providing a penalty; and providing a severability clause. Motion carried unanimoLsly. It was moved by Alderman Browning, seconded by Alderman Woods, to introduce Ordinance No. 78-2200, an ordinance amending ordinance No. 65-655 and providing for Texas Municipal Retirement System coverage to include all employees except those covered by the Texas Fireman's Relief and Retirement System except those as o~erwise precluded by Texas February 14, 1978 CITY COUNCIL MINUTES Page 4 Municipal Retirement System Regulations. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to adopt Ordinance No. 78-2190, an ordinance calling and setting the regular Municipal Election for the City of Plainview to be held on the first Saturday in April of 1978, the same being the first day of said month, for the election of (1) A Mayor for the City of Plainview; (2) For the election of one Alderman for Place Two on the Ci:~y Council O'f the City of Plainview; and (3) for the election of ~one Alderman for Place Four on the City Council of the City of Plainview; designating the place where said election is to be held; and appointing presiding officials thereof. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No. 78-2192, an ordinance' closing the public hearing on the 1977 Assessment Paving Program and authorizing the assessment to be filed of record. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 78-2201 from Revenue Sharing Fund Account 427-620 in the amount of $1,927.18 payable to General Fund for debris clearance on Projects #375, 347, 353, 320, 354, 297 and 314. Moti~on carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No..78-2202 from Revenue Sharing Fund Account 427-620 in the amount of $2,157.00 payable to Unistrut Texas, Arlington for purchase of one BR80 PIONJAR Pole Driver Unit and accessories. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to adopt Appropria- tion Ordinance No. CD3-059 from Community Development Fund Account 429-831 in the amount of $2,332.86 payable to General Fund for debris clearance on Projects #376, 103, 234, 113, 302, and 361. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Appropriation Ordinance No. CD2'060 from Community Development Fund Account 429 in the amount of February 14, 1978 CITY COUNCIL MINUTES Page 5 $20,601.89 payable to H. B. Jordon & Co., Inc. for Construction Estimate No. 3, Sanitary Sewer and Water Distribution Extensions, Project No. B76-DN-48-O082. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to adopt Appropria- tion Ordinance No. CD3-061 from Community Development Fund Account 4'29 i,n,'~tbe amount of $956.62 payable to Thomas E. Barber & Associates for Planning and Management Consultant Services pursuant to March 22, 1977. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Woods, to authorize the City of Plainview to pay half of the relocation cost for moving facilities located in the proposed right-of-way of Industrial Blvd., owned by Pioneer Natural Gas Co.. The County will pay the other half of the relocation costs. Motion carried unanimously. tt was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt the Texas Highway and Public Transportation Minute Order No. 79354 regarding reconstruction in the City of P!6inview on U.S. Highway 70 from Amarillo Street to Milwee Street. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman SoRelle, to take the proposed installation of street lighting on U.S. Highway 194, 24th Street to Interstate 27, Business Route 87, North Columbia to city limits, South Columbia to city limits, Highway 400, Campbell Street north to 24th street, under advisement subject to meeting with George C. Wall. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to reinstate the lease between the City of Plainview and Lloyd R. Mitchell for the lease and option to purchase City of Plainview property located in the 1200 Block of North Austin Street. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve the request of Carl P. Weidenbach to pave the alley behind 400 Navasota Dri~ve, subject to February 14, 1978 Page 6 CITY COUNCIL MINUTES the City Engineer's approval regarding design. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to call a public hearing to be held on February 28, 1978 regarding the Yellow Cab Franchise. Motion carried unanimously. A discussion was held concerning the green fees at the Plainview Municipal Country Club as indicated in the letter dated January 23, 1978. No action was taken at this t~me. Received for filing, the City of Plainview Annual Audit for the year end~ng September 30, 1977 as prepared Jimmy Holmes, CPA. It was moved by Alderman Browning, seconded by Alderman Woods, to authorize the Mayor to sign Weed ~wing Assessment. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle, to table di~cussion on Item #3 concerning the recommendations by the Parks Committee. Motion carried unanimously. It was moved by Alderman Carpenter, seconded-by Alderman Woods, to approve the request for sanitation collection for Jeane Browning. Motion carried unanimously. The City Council recognized and commended the City of Plainview Firemen for a job well done during a fire in Halfway, Texas. Reminder of Health Board Meeting to be held Thursday, February 16, 1978 at K-Bobs Restaurant. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adjourn the meeting.
