It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve the specifica-
tions and authorize the advertising for bids for the purchase of approximately 1,000
gallons of Aerial Ultra-Low Volume Mosquito Spray material as specified. Bids to be
received until 10:00 a.m., C.D.S.T., May 17, 1978 and to be awarded at the City Council
regular meeting on May 23, 1978 at 7:30 p.m., C.D.S.T. Mo'tion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to approve Zone Case No.
380, the request of James R. Odum for rezoning a~0.554 acre tract out of the SW part of
Section 35, Block JK-2, Hale County, Texas, described by metes and bounds, from an R-1
Zone to a CGB Zone for boat_~sales and service and fishing supply sales, located 3400 Block
1-27 North. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Ordinance No.
78-2219, an ordinance amending thezoning map of the City of Plainview for Zone Case No.
380. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve Zone Case
No. 381, the request of Bob McAninch for rezoning the North 111.65' of Lot 1, Holland
Addition, located on a part of R. Holland Homestead Survey and a part of Survey No. 2-1/2,
Block M and L, Hale County, Texas, from an R-2 Zone to a CGB Zone for farm and utility
trailer sales and repair, located 1406 and 1408 North Date, Pl.ainview, Texas. Motion
carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance No.
78-2220, an ordinance amending the z~ning map of the City of Plainview for Zone Case No.
381. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Zone Case
No. 382, the request of Eldon A. Milstead for rezoning Lots 11 through 16, Block 57,
Original Town Addition to the City of Plainview, Hale County, Texas, SAVEAND EXCEPT
that land lying and situated as specified, from an R-3 Zone to a CGB Zone for a hardware

and welding supply store, located SE corner East Third and Date Street, Plainview, Texas.
Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance No.
78-2221, an ordinance amending the zoning map of the City of Plainview for Zone Case No.
382. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to approve the minutes
of the regular City Council meeting held April 11, 1978. Motion carried unanimously.

It was moved by Alderman Almon, seconded by Alderman Woods, to introduce Ordinance
No. 78-22~12, an ordinance making available for sale to the public, the code of the Ci~ty
of Plainview, Texas; establishing the cost and providing for supplementing of all ordinances
codified for the five years beginning April 1, 1977 through March 31, 1982. Motion carried
unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Appropriation
Ordinance No. CD2-069 from Community Development Fund Account 429 in the amount of
$11,567.93 payable to H. B. Jordon & Co., Inc. for Construction Estimate No. 6, (Final)
Sanitary Sewer and Water Distribution Extensions, Project No. B-76-DN~48-O082. Motion
carri ed unanimously.
It was moved by Alderman Almon, ~ seconded by Alderman SoRelle, to adopt Appropriation
Ordinance No. CD2-070 from Community Development Fund Account 429 in the amount of
$21,140.35 payable to High Plains Pavers, Inc. for Construction Estimate No. 1; Park Site
Earthwork, Curry Lake Flood Management, Project No. B-75-DN-48-O015. Motion carried
unanimously.

It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Appropriation
Ordinance No. CD1-072 from Community Development Fund Account 429-817 in the amount of
$3,294.00 payable to High Plains Pavers, Inc. for Construction Estimate No. l; 1977
Assessment Paving Project; Street Work at Curry Lake. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Appropriation
Ordinance No. CD3-071 from Community Development Fund Account 429-830 in the amount of
$2,913.43 payable to Thomas E. Barber & Associates for Planning and Consultant Services
pursuant to March 22, 1977. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to approve the proposed
Citizens Organization Patrol, as recommended by Alan Stewart-Chief of Police. Motion
carried unanimously.
Received for filing, statement of final settlement on City of Plainview auction
held April 15, 1978.
A discussion was held concerning the letter from Harvey Davis with the Texas Water
Resource Commission concerning the extension of Enforcement Order No. 75-37. Marshall
Pharr-City Manager requested that the following letter be entered into the minutes in
its entirety:

This is to acknowledge receipt of your letter dated April 6, 1978 in which you requested
a 24-month extension of time to Item No. 4 of Enforcement Order 75-37 issued by the Texas
Water Quality Board on December 16, 1975. Item No. 4 required the City to attain the
treatment levels set out in the City's existing permit by June 1, 1978.

You advised this agency that the City retained an engineering firm to design and insure
construction of an innovative treatment facility capable of adequately treating the City's
effluent. However, the firm was unable to arrange financing for the project. Consequently,
the City has retained another engineering firm to evaluate alternate means by which the
City may attain compliance with the treatment levels set out in the City's existing permit.
The Executive Director agrees taht it would be impossible to complete an in-depth
engineering study and to implement the results of the study between now and June 1, 1978.
The City has apparently made good faith attempts to comply with the Enforcement Order
deadline. Consequently, although it is understood 'that the City will not be able to
attain the permitted treatment levels as required, the City is requested to advise this
agency by June 1, 1978 of the alternative selected.

It was moved by Alderman Woods, seconded by Alderman Almon, to authorize the curb~
and gutter paving project for the Thunderbird Park Site. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to authorize the City
Manager to proceed with the plan for installation of sprinklers in Thunderbird Park.
Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to authorize the Mayor
to sign contract between the City of Plainview and R. G. Watson to acquire land for a
Park Site. Motion carried unanimously.
A discussion was held concerning the request of Mr. J. D. Cobb concerning pro-rata
charges.
It was moved by Alderman Almon, seconded by Alderman Woods, to authorize the City
Attorney to prepare an Annual Street Use Permit for Mr. Jack Nicols for one year. Motion
carried unanimously.
A ~iscussion was held concerning a curfew in City Parks.
