HomeMy WebLinkAbout09-17-2015 Council minutes468 The City Council met on September 17, 2015 at 11:45 a.m., at the Plainview Convention Center, 2902 W. 4th Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 11:25 a.m. on September 14, 2015. Mayor Wendell Dunlap presided. Councilmembers present were: Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, Lionel Garcia -District 6 and Eric Hastey-District 7. Councilmember Charles Starnes -District 1 was absent. Staff members present were: Jeffrey Snyder -City Manager, Andrew Freeman -Assistant City Manager, Leslie Spear Schmidt -City Attorney, Ken Coughlin -Police Chief, Sarianne Beversdorf-Director of Finance, Rusty Powers -Fire Chief, Tim Crosswhite-lnterim Director of Public Works, Isauro Gutierrez -Information Technology Specialist and Belinda Hinojosa-City Secretary. News Media Present: Homer Marquez -Plainview Herald and Caleb Hatch -Plainview Radio Guests present were: Clayton Scales and Mike Fox Councilmember Larry Williams led in the Invocation. Jeffrey Snyder, City Manager presented information on authorizing Mayor to sign Texas Department of Transportation Grant for Routine Airport Maintenance Program, TxDOT CSJ No. M1605PLNV. This is for basic maintenance at the airport. It is a 50/50 grant. The grant is for a total of up to $20,000 with the City's and County's potential share being up to $10,000. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to authorize Mayor to sign Texas Department of Transportation Grant for Routine Airport Maintenance Program, TxDOT CSJ No. M1605PLNV. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Mr. Snyder presented for consideration Resolution R15-345, a Resolution Of The City Of Plainview, Texas Designating An Authorized Official As Being Responsible For, Acting For And On Behalf Of The City In Dealing With The Texas Parks & Wildlife Department For The Purpose Of Participating In The Local Park Grant Programi Certifying That The City Is Eligible To Receive Program Assistance; Certifying That The City's_Matching Share Is Readily Available; And Dedicating The Proposed Site For Public Park And Recreational Uses. This Resolution authorizes the City of Plainview to submit a grant application to the Texas Parks and Wildlife Department Local Parks Grant Program and designates the City Manager to act as the authorized official. The project being submitted is the Travis Trussell Duck Pond Enhancement Project. There will be $32.8 million available for grants to create or enhance city and county parks across Texas. The Texas Parks and Wildlife staff are encouraging us to submit an application for the Priority Improvement Project Travis Trussell Duck Pond. The project was included as a priority in the Parks Recreation and Open Space Master Plan approved by the City Council last year. The total estimated cost will be $625K for this project with Parks and Wildlife paying up to 50% of the total project cost. The City will receive some financial donations towards City Council Minutes September 17, 2015 Page 1 of 4 this project in the range of $75K. In addition, the City is going to be able to do some of the demo work on the concrete and fence in house and the City receives credit for this work. The total project cost to the City will be less than $250K. The Parks Advisory Board does recommend approval of this project. There will be a public hearing at 6:00 p.m. at City Hall to include any comments from the public in the application. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to approve Resolution R15-345. The motion was duly seconded by Mayor Pro Tem King and carried by unanimous vote. Mayor Dunlap presented for consideration on second reading Ordinance No. 15-3623, an Ordinance Of The City Of Plainview, Texas, Adopting And Approving The Budget For The Fiscal Year Beginning October 1, 2015 And Terminating September 30, 2016, And Making Such Appropriations For Each Department, Project And Account; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 15-3623 on second reading. The motion was duly seconded by Councilmember Hastey. Belinda Hinojosa, City Secretary asked for a record vote of the Council with the Council voting as follows: Mayor Dunlap — Yes Councilmember Starnes — Absent Councilmember Williams — Yes Councilmember Juarez — Yes Mayor Pro Tem King — Yes Councilmember Blackerby- Yes Councilmember Garcia — Yes Councilmember Hastey — Yes The motion carried with a vote of 7 "for" the motion. Mr. Snyder presented for consideration an action to ratify the Property Tax Increase reflected in the FY 2015-2016 Budget. Under Texas Local Government Code Section 102.007(c), a City adopting a budget that raises more revenue from property taxes than the previous year is required to take a separate vote to ratify the property tax increase. The proposed budget includes a property tax rate of $0.6288 per $100 valuation. This is over the effective tax rate of $0.5868 per $100 valuation. Mayor Dunlap asked for public comment. There was no public comment. Mayor Pro Tem King moved to ratify the property tax increase reflected in the budget for Fiscal Year 2015- 2016 Budget. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Since this was the second of two readings, the Council chose to forego staff briefing. There was no public comment. Councilmember Hastey moved that the property tax rate be increased by the adoption of a tax rate of sixty-two and eighty-eight hundredths cents ($.6288), which is effectively a 7.16 percent increase in the tax rate — Ordinance 15-3624 on second reading. The motion was duly seconded by Councilmember Juarez. Since this was the second of two readings, the Council chose to forego staff briefing. There was no public comment. Councilmember Williams moved to adopt Ordinance No. 15-3625 on second reading. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Mayor Dunlap presented for consideration on second reading Ordinance No. 15-3626, an Ordinance Of The City Of Plainview Amending Ordinance No. 14-3614 To Appropriate Funds In The General Fund And Various Revenue And Capital Funds Pursuant To Section 5.07 (A) And (D) Of The Plainview City Charter Allowing For Supplemental Appropriations In The 2014-2015 Budget; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Mayor Dunlap presented for consideration on second reading Ordinance No. 15-3627, an Ordinance Of The City Of Plainview, Texas Amending The Comprehensive Zoning Ordinance And Map And Showing The Location, Boundary And Use Of Certain Property For The Rezoning Of Lots From A Single Family Residential 1 ("R-1") Zoning District To City Council Minutes September 17, 2015 Page 3 of 4 A Planned Development ("PD") Zoning District., Said Parcels Being Approximately 20.26 Acres, Abstract 2000, BLK JK -2, Sec 26, out of E/2 S. Of Hwy, City Of Plainview, Hale County, Texas; And Being More Particularly Described In The Attached And Incorporated Concept Plan For Multifamily Residential 2 ("MF -2") Zoning District And Office ("0") Zoning District Land Uses; Providing That The Property Shall Be Developed In Accordance With The "PD" Regulations; Providing That The Property Shall Be Developed In Accordance With Special Conditions Required Of Planned Developments; Repealer; Cumulativeness Clause; Severability Clause; And Effective Date.
