City Council Chambers 901 Broadway Plainview, Texas CITY COUNCIL MINUTES The City Council of the City of Plainview met in regular session at 7:30 P. M. in the City Council Chambers of the City Hall with Mayor J. Robert Wayland presiding and the following Councilmen present: Jeane Browning-Place ONe; Medlin Carpenter- Place Two; Lloyd Woods-Place Three; Tom Almon-Place Four; and A. William SoRelle-Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Randy Holly-Administrative Assistant, Larry McEachern-City Attorney Assistant, Tom Hamilton- City Attorney, Norman Huggins-Director of Finance, Bill Hogge-Director of Public Works, Harold Gladman-Director of Planning, Alan Stewart-Director of Police Services, Woody Sevison-Director of Fire Services, Johnnie Ballew-Director of Safety and Environment, M. L. Rea-City Clerk, Richard Cross-Municipal Court Judge, and Debbie Hall-Administrative Secretary. Also present were the following visitors: Chuck Martin-KVOP Radio, Doug'McDonough- Plainview Daily Herald, Shari Campbell-KKYN Radio, Charles Bechtold, Bob Worley, J. B. Wheeler, Bonita Graham, Willie Yonk, C. C. Chapman, Bud McCormick, Jack Skaggs, Rudy Martinez, Juan de Dios Baeza, Albaro Castillo, Irene Salas, Vistor Vargas, Bidal Aguero, Luis E. Ortez, Elodio DeLeon, E. Alcozer, Helen Alcozer,_Crisalda Isais, Tony Madrid, Carolina Madrid, Emilio Gonzales, Toni Madrid, Adam~Arellano and Doro Morales. Invocation was given by Lloyd Woods. Mayor Wayland presented Jack Skaggs with his Certificate of Appointment to the Canadian River Municipal Water Authority~and read Resolution R78-106~ as adopted On July 25, 1978. There was some discussion about parking on 5th Street (Highway 70), but no action was taken. It was moved by Alderman Carpenter, seconded by Alderman Woods, to approve the minutes of the regular City Council meeting held July 25, 1978. Motion carried unanimously. Motion carried unanimously. The ordinance establishing a Community Relation Policy is still being prepared at this time. It was moved by Alderman Browning, seconded by Alderman Carpenter, to introduce Ordinance No. 78-2253, an ordinance amending the Code of the City of Plainview, Texas, providing for a Board of Appeals, composition, appointment, term of office, notice of meetings and attendance requirement of all members appointed to the Board of Appeals of the Uniform Fire Code and the Uniform Building Code of the City of Plainview, Texas. Motion carried unanimously. I.t was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Ordinance No. 78-2246, an ordinance approving the Revenue Sharing Budget submitted by the City Manager of the City of Plainview, Texas, for the Fiscal Year 1978-79. Motion carried unanimously. It was movec by Alderman Woods, seconded by Alderman Almon, to adopt Ordinance No. 78-2247, an ordinance approving the budget submitted by the City Manager of the August 8, 1978 CITY COUNCIL MINUTES Page 3 the City of Plainview, Texas, for the Fiscal Year 1978-79. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Ordinance No. 77-2247, an ordinance approving the budget submitted by the City Manager of the City of Plainview, Texas, for the Fiscal Year 1978-79. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance No. 78-2248, an ordinance levying taxes for the use and support of the municipal govern- ment of the City of Plainview, Texas, and providing for the Interest and Sinking Fund for Fiscal Year 1978-79; providing for the time and manner of paying ad valorem taxes levied. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. 78-2251 from 1966 Revenue Bond Fund Account 426 in the amount of $1,458.87 payable to Parkhill, Smith & Cooper, Inc. for Engineering Services relative to appli- catiom to Texas Department of Water Resources for amended discharge permit for period of April 1, 1977 to June 30, 1978. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Appropriation Ordinance No. CD2_-08~ from Community Development Fund Account 429-822 in the amount! of $1,920.00 payable to Hoyt Curry for 1977 Assessment paving sign-up. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to adopt Appropria- tion Ordinance No. CD3-080 from Community Development Fund Account 429-831 in the amount of $4,079.37 payable to General Fund for debris clearance on #229 - 1409 N. Date ($414 99); #349 - 1209 Elm (~$2,777.80); and ~68 - 1209 Yoakum ($886.50). Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Appropria- tion (rd~nance No. CD2-081 from CommunSty DeYelopment Fund Account 429-822 in the ___ amoun of $16,550.oOpayable to H~§h Plains Pavers, Inc. for Construction [stimate No. August 8, 1978 CITY COUNCIL MINUTES Rage 4 4; 1977 Assessment Paving, contract dated November 22, 1977. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Appropria- tion Ordinance No. CD1-082 from Community Development Fund Account 429-817 in the amount of $4,132.42 payable to High Plains Pavers, Inc. for Construction Estimate No. 4; 1977 Assessment Paving, contract dated November 22, 1977, streets adjacent to Curry Lake Flood Control Project. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Appropriation Ordinance No. 78-2252 from Revenue Sharing Fund Account 427-613 in the amount of $1,920.00 payable to Emco for purchase of 10 side load containers. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Appropriation Ordinance No. CD2-083 from Community Development Fund Account 429-825 in the amount of $216.23 payable to Southwestern Public Service Co. for removing utility pole for Beech Street right-of-way. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropria- tion Ordinance No. CD2-084 from Community Development Fund Account 429-820 in the amount of $430.00 payable to Jimmy L. Ho~mes for~CPA Audit of Community Development Fund 1975-76. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Appropriation Ordinance No. CD2-085 from Community Development Fund Account 429-822 in the amount of $194'.06 ~ayable to High Plains Concrete Co. for concrete used in moving fence at Date Street Housing, Austin Heights street project. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Resolution No. R78-t06 appointing Mr. Jack Skaggs to a two year term to the Canadian River Munici- August 8, 1978 Page 5 CITY COUNCIL MINUTES pal Water Authority. Motion carried unanimously. It was moved by Alderman WoodS, seconded by Alderman Almon, to adopt Resolution No. R78-107, a Resolution authorizing the City to submit a full application to the Department of Housing and Urban Development for Community Development Block Grant Funds in the amount of $600,000; and authorizing the Mayor to act as the Ci~ty's Chief Executive Officer and authorized representative in all matters pertaining to the City's parti- cipation in the Community Development Block Grant Program~ Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Carpenter, to deny the request for de,annexation by Mr. Elwin Gene Latham and request the City Attorney's Office to advise Mr. Latham of the City's position on the matter. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to authorize the continuation of Beech Street from 60 feet North of Bullock to 24th Street, subject to property owner's dedication of property in a voluntary agreement of curb and gutter assessment on his abutting property and not to be constructed until after final approval of the 1978 Community Development Block Grant Funds, at an~estimated cost :-~--~ of $12,000. Motion carried unanimously. The Pioneer Natural Gas Company Cost of-Gas Pass:through on its West Texas System for the month of June 1978 was received for filing. A discussion concerning their proposed rate increase was held. Reminder of the Texas Departn~nt of Water Resources Public Hearing to be held August 15, 1978 at 1:00 p.m. in the City Council Chambers. Reminder of the American Association of Small Cities Regional Meeting to be held in Plainvi'ew on August 24, 1978. Reminder of the meeting with the Plainview-Hale County Airport Board, County Commissioners and Plainview City Council on August 15, 1978 at 10:30 a.m. Received for filing, letter establishing Preliminary Cost Statement of partici- pating cities effected by Southwestern Public Service Rate Filing. August 8, 1978 Page 6 CITY COUNCIL MINUTES It was moved by Alderman SoRelle, secondedby Alderman Browning, to approve the request of the Mexican-American Chamber of Commerce to conduct a Fiesta at Broadway Park on September 16, 1978. Motion carried unanimously. They were reminded to obtain a parade permit from the Police Department. The request of Mrs. Ernest Driver to hold a block party in the 3000 Block of 19th Street was authorized at the City Council Work Session held August 3, 1978. It was moved by Alderman Carpenter, seconded by Alderman Woods, to authorize the Mayor to sign assessments on three debris clearance project. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to authorize the Mayor to sign assessments as provided for in Ordinance No. 69-939. Motion carried unanimously. Accounting/Collection 8. Animal Warden June July Mr. Bob Worley appeared to discuss 5th Street (Highway 70), but no action was taken.
