CITY COUNCIL MINUTES
The City Council of the City of Plainview met in regular session at 7:30 P. M.
in the City Council Chambers of the City Hall with Mayor Pro Tem Medlin Carpenter presiding
and the follQwing Councilmen present: . Jeane Browning-PlAce One; Lloyd Woods-Place Three;
Tom Almon-Place Four; and-Will.iam SoRelle-Place Five.
Also present were the following City Staff: Marshall Pharr-City Manager, Randy
Holly-Administrative Assistant, Larry McEachern-City Attorney Assistant, Tom Hamilton-
City Attorney, Norman Huggins-Director of Financed Bill Hogge-Director of Public Works,
Harold Gladman-Director of Planning, Alan Stewart-Director of Police Services, Woody
Sevison-Director of Fire Services, Johnnie Ball~ew-Director of Safety and Environment>
M. L. Rea-City Clerk, Buddy Dodson-Tax Assessor-Collector, and Debbie Hall-Administrative
Secretary.
Also present were the following visitors: James Bryant, Brenda Holly, Randy Brown,
Marvin Marshall, Roy and Marshall Mull, Franklin Ebeling, and J. M. Gutheinz.
Invocation was given by Tom Almon.
It was moved by Alderman Woods, seconded by Alderman to open bid from Jack Morris
Ford for quotation on purchase of trucks, cabs and chassis as advertised. Motion carried
unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to table action
on bid received from Jack Morris Ford in the amount of $24,069 each ($73,889.07 total)
for trucks, cabs and chassis, Motion carried unanimously.
It was'.~oved by Alderman SoRelle, seconded b~ Alderman Browning, to award the
bid for the purchase of side load packer bodies to Ebeling Mfg. in the amount of
$15,490.00, subject to truck being awarded. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to award the bid for
the purchase of 20 front load containers to be purchased with Revenue Sharing Funds

in the amount of $274.00 per unit to Duncan Mfg'. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Browning, to award the bid
for approximately 300 3/4 x 5/8 inch water meters (annual supply) in the amount of
$22.50 (unit price) to Neptune Meter Co. to include both bids. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to award the bid
for construction of water and sewer utility extensions in the'Ridgecrest No. 2 and Town
West No. 3 Subdivisions in the amount of $73,689.91 to I~rrigation, Inc. Estimated
completion time to be 150 days. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to amend the pro-rata
ordinance of the City of Plainview. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Zone Case
No. 391, the request of Jerome M. Gutheinz for rezoning a 2.798 acre tract out of the
SW part of Section 26, Block JK-2, Hale County, Texas, described by metes and bounds,
from R-2 to TH Zoning for townhouses, said property located 2600 Block Mesa Drive.
Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance
No. 78-2254, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 391. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve Zone Case
No. 392, the request of Jerome M. Gutheinz for rezoning Lots 79 and 80, Town West
Addition Unit No. 2, City of Plainview, Hale County, Texas, from R-2 to CNS zoning
for commerci~ use, said property located 2400 and 2402 Kermit Drive, with the stipulation
that a 6~foot solid, visual fence be built on the North and East side. Motion carried
unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No.
78-2255, an ordinance amending the zoning map of the City of Plainview for Zone Case

No. 392. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to approve the minutes
of the regular City Council meeting held August 8, 1978. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve the minutes
of the special City Council meeting held August 17, 1978. Motion carried unanimously.
Received for filing, minutes of the Unger Memorial Library Advisory Committee
held June 26, 1978.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to introdUce Ordinance
No. 78-2256, an ordinance creating City of Plainvi:ew Environmental Advisory Committee,
providing for the composition, appointment, term of office, notice of meeting and
attendance requirements of all members appointed to the City of Plainview Environmental
Advisory Committee. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Browning, to introduce Ordinance
No. 78-2249, an ordinance of the City of Plain~iew entitled "Display of sexually
explicit material to minors", prohibiting the display of such material to minors:
defining sexually explicit material: defining the term display: providing a penalty:
providing a savings clause and providing for publication. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Woods, to adopt Ordinance
No. 78-2253, an ordinance amending the Code of the City of Plainview, Texas, providing
for a Board of Appeals, composition, appointment, term of office, notice of meetings
and attendance requirements of all members appointed to the Board of Appeals of the
Uniform Fire Code and the Uniform Building Code of the City of Plainview, Texas. Motion
carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Woods, to, adopt Resolution No.
R78-108, a Resolution of the City of Plainview, Texas, suspending the proposed rate
schedules filed by Pioneer Natural Gas Company for a period of One Hundred Twenty (120)

days beyond the date on which such schedules would otherwise ge into effect. Motion
carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Woods, to authorize the
participation of the City of Plainview for 50% of the cost necessary for right-of-way
from Columbia West to City Limits (approximately 300 feet) on FM 176-7 and recommend
to the Commissioner's Court that they adopt a Resolution requesting extension of FM
1767 from Columbia West to Quincy. Also, that the first 300 feet be constructed on
an urban section and have curb and gutter at the cost of the City and be paved 65 feet
wide. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Resolution
R78-109, a resolution of the City of Plainview whereby the City has been given notice
by the West Texas Distribution System of Pioneer Natural Gas for a proposed rate
increase to be made with all the cities for an increase in the present gas rates. Motion
carried unanimously.
The Council discussed a letter from Bob Bullock, Comptroller of Public Accounts,
concerning proposed sales tax options. The Council concurred not to remove the lq
City sales tax.
It was moved by Alderman Woods, seconded by Alderman Almon, to approve the plans
and specifications and authorize the advertising for the second construction phase of
the Plainview-Hale County Airport and review the final cost and determination to be
made at the time of receipt of the bid. Discussion on this was held at a joint meeting
of the City Council, County Commissioners and Airport Board. Motion carried unanimously.
Johnnie Ballew, Director of Safety and Environment, presented the Animal Control
report. T'he~City Councit commended Johnnie for the enforcement of the Animal Control
Ordinance.
