The City Council of the City of Plainview met in regular session at 7:30 P. M.
in the City Council Chambers of the City Hall with J. Robert Wayland presiding and the
following Councilmen present: Jeane Browning-Place One; Medlin Carpenter-Place Two;
Lloyd Woods-Place Three; Tom Almon-Place Four; and A. William SoRelle-Place Five.
Also present were the following City Staff: Marshall Pharr-City Manager, Randy
Holly-Administrative Assistant, Tom Hamilton-City Attorney, Norman Huggins-Director of
Finance, Bill Hogge-Director of Public Works, Harold Gladman-Director of Planning,
Johnnie Ballew-Director of Safety and Environment, Woody Sevison-Director of Fire Services,
Alan Stewart-Director of Police Services, Bob Richards-Building Inspector, Buddy Dodson-
Tax Assessor-Collector, M. L. Rea-City Clerk, and Debbie Hall-Administrative Secretary.
Also present were the following visitors: Chuck Martin-KVOP Radio, Shari Campbell-
KKYN Radio, Doug McDonough-Plainview Daily Herald, Charles Bechtold, Vernon Clem-Pioneer
Natural Gas, John ,Ray-Pioneer Natural Gas, and Joe McKinnis-Plainview Cable TV.
Invocation was given by Randy Holly.
It was moved by Alderman Almon, seconded by Alderman Woods, to approve the
recommendation of Mayor Wayland to appoint Frank Phelan, Barbara Dorman and James
Wallace Davenport to the Board of City Development. Motion carried unanimously.
It was recommended by Mayor Wayland that the Civil Defense and Disaster Relief
Committee positions remain vacant.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to approve the
recommendation of the Mayor to appoint Mario Trevino to the Planning Board and Zoning
Commission to replace Richard Cross. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Browning, to accept the bid
for the purchase of side load packer bodies from Emco in the amount of $46,478.00 for
3 packer bodies at a cost of $15,490.00 each, with the stipulation that price be held
firm until award of truck can be made. Motion carried unanimously.

It was moved by Alderman Browning, seconded by Alderman Almon, to reject the bid
received on August 21, 1978 at 10:00 a.m. for quotation trucks, cabs and chassis
as advertised. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to approve the specifi-
cations and authorize advertising for the purchase of on sanitary landfill loader type
compacter with bids to be received on October 5, 1978 at 10:00 a.m. and award to be made
at the regular City Council meeting on October 10, 1978. Estimated cost $68,000. Motion
carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Woods, to hold action until
further study can be made on request for bids to,be received on purchase of three truck,
cab and chassis. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon~ to approve the minutes
of the City Council Special meeting held September 7, 1978 and the City Council Regular
meeting held August 22, 1978. Motion carried unanimously.
Minutes of the Board of Electrical Examiners meeting held August 15, 1978 was received
for filing.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to approve the
appointment of a study Committee to study Ordinance No. 78-2259, 78-2260 and 78-2261
and make recommendations to the Council within 30 days, October 19, 1978. The committee
will consist of the following members: Orville Atkinson-Chairman, Bobby James, Cary
Eaves, Jerry Wofford, Kip Pritchard, Troy Carter and Dwain Dodson. Motion carried
unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Ordinance No.
78-2256, an ordinance creating City of Plainview Environmental Advisory Committee,
providing for the composition, appointment, term of office, notice of meeting and
attendance requirements of all members appointed to the City of Plainview Environmental
Advisory Committee. Motion carried unanimously.

It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance
No. 78-2249, an ordinance of the City of Plainview entitled "Display of Sexually Explicit
Material to Minors", prohibiting the display of such material to minors; defining sexually
explicit material; defining the term display; providing a penalty; providing a savings
clause and providing for publication. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman SoRelle, to-adopt Appropriation
Ordinance No. 78-2257 from Revenue Sharing Fund Account 427-607 in the amount of $5,600
payable to Stancil-Hoffman Corp. for the purchase of multi-channel logging system. Motion
carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Appropriation
No. CD2-086 from Community Development Fund Account 429-822 in the amount of $29,063.22
payable to High Plains Pavers, Inc. for Construction Estimate No. 5; 1977 Assessment
Paving; contract dated November 22, 1977. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Appropriation
Ordinance No. CD1-087 from Community Development Fund Account 429-831 in the amount of
$1,791.74 payable to General Fund for debris clearance on Project #127 - 1006 Rock
Island - $993.96 and Project #371 1309 Frisco Road $797.78. Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman Almon, to reject the request
for special information services for the reasons outlined by the City Attorney. Motion
carried unanimously.
Marshall Pharr, City Manager, discussed the public hearing with the Texas Dept.
of Water Resources in Austin on September 11, 1978.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to authorize the
Mayor to sign the warranty deed on the sale of surplus property described as Lot 9,
Block 24, NSL Addition to Telesforo Pena in the amount of $1,500. Motion carried
unanimously.

Jeane Browning, Councilman~Place One, requested that a letter be written to Dr.
Wagner, Chairman of the Plainview-Hale County Health Board, expressing the City's
appreciation for his services on the Health Board.
It was moved by Alderman SoRelle, seconded by Alderman Woods, to go into Executive
Session to discuss the pay rates in regard to right-of-way appraisals on Parcels 2,
9 and 14 on U.S. Highway 70 right-of-way acquisitions and right-of-way agent. Motion
carried unanimously.
The parcels were approved in Executive Session but will not be made public
until approval from the State.
Received for filing, job performance evaluation and merit raise guidelines
effective Ocrober 1, 1978.
Received for filing, Pioneer Natural Gas Co. West Texas System Cost of Gas Pass-
Through for the month of July 1978.
Received notice for revised schedule of service charges with Pioneer Natural Gas
Co. instituted in Plainview on September 5, 1978. Vernon Clem and John Ray of Pioneer
Natural Gas Co. were present to answer questions.
Received ~or filing, progress report from Fred Poe, Chairman of Steering Committee
of Cities on Pioneer West Texas Distribution System's study.
Joe McKinnis appeared to discussed the reason for delay of extension of Cable TV
service to various areas in Plainview.
Received for filing, letters dated August 22 and 30, 1978 on the status on the
Southwestern Public Service rate case.
It was moved by Alderman Browning, seconded by Alderman Carpenter, to authorize the
Mayor to sign 15 assessment in the amount of $619.00 as filed under Ordinance No. 66-939.
Motion carried unanimously.
It was moved by Alderman Woods, seconded by Alderman, to approve the request of
Alan Stewart, Chief of Police of the City of Plainview, to allow out-of-state travel

authorization for Jerry Austin, Assistant Chief of Police, who has been nominated to
attend the FBI Academy, Quanico Marine Corp Base, Washington D.C., from October~l, 1978
to December 15, 1978. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Appropriation
Ordinance No. 78-2258 from Revenue Sharing Fund Account 427-613 in the amount of $1,920
payable to Ebeling Mfg. Co. for 10 side load refuse containers. Motion carried
unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Browning, to hold the
request of Plainview Savings and Loan Association for right of ingress and egress at
722 Broadway until further study can be made. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Woods, to introduce Ordinance
No. 78-2259, an ordinance defining the general rules and regulations governing plats and
subdivision of land falling within the jurisdiction of the City of Plainview for the
purpose of providing for the orderly, safe, and healthful development of the area
surrounding the City and to promote the health, safety, morals and general welfare of
the community; defining terms; setting forth purpose, authority and jurisdiciton,
requiring approval; establishing procedure for approval of preliminary and final plats;
providing general provisions; establishing general requirements and design standards
for streets, lots, blocks, building lines, alleys, easements, flood areas and playa
lakes; requiring improvements; providing.for City participation in improvements;
providing for reservations, variances, inspection of construction and a penalty;
establishing filing fees and charges; requiring maintenance bond; providing for the
withholding of improvements until subidivionm is approved, for conflict with other
ordinances, a saving clause, and an effective date; and providing for repeal of
Ordinance No. 65-864. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt
Ordinance No. 78-2260, an ordinance defining wet weather lake area and high water

level, regulating, the dumping of dirt, debris, or orther materials within the wet
weather lake area; providing a severability clause; prohibiting the issuance ~of building
permits or the approval of plats within a wet weather lake area; providing for certain
excavations, and appeals to the City Council. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance
No. 78-2261, an ordinance amending Ordinance No. 73-1383 of the City of Plainview
changing the charges known as "Pro-rata" and changing the rates to be paid by
developers as providing in,said Ordi~nance, and repealing Ordinance No. 77-2109. Motion
carried unanimously.
There being no further business, it was moved by Alderman Carpenter, seconded
by Alderman Browning, to adjourn. Motion carried unanimously.
Meeting adjourned at 12:05 a.m.
