The City Council of the City of Plainview met in regular session at 7:30 P. M.
in the City Council Chambers of the City Hall with Medlin Carpenter presiding and the
following Councilmen present: Jeane Browning-Place One; Tom Almon-Place Four and Bill
SoRelle-Place Five.
Also present were the following City Staff: Marshall Pharr-City Manager, Randy
Holly-Administrative Assistant, Larry McEachern-City Attorney's Staff, Norman Huggins-
Director of Finance, Alan Stewart-Director of Police Services, Johnnie Ballew-Director
of Safety and Environment, Richard Cross-Municipal Court Judge, Bob Richards-Building
Inspector, M. L. Rea-City Clerk, and Debbie Hall-Administrative Secretary.
Also present were the following visitors: Chuck Martin-KVOP Radio, Doug McDonough-
Plainview Daily Herald, Shari Campbell-KKYN Radio, Charles Bechtold, Jesse Johnson,
Genny Johnson, Barbara BaniSter, Joy Driver, Winnie Huff, J. C. Driver, Winfred B~nister,

Invocation was given by Bill SoRelle.
Present to receive their Certificates of Appointment to the Board of City
Development were James W. Davenport and Frank Phelan.
It was moved by Alderman Browning, seconded by Alderman Almon, to approve the
specification and authorize advertising for bids for the purchase of three trucks, cab
and chassis, with bids to be received on October 17, 1978 at 10:00 a.m. and to be awarded
on October 24, 1978 at the regular City Council meeting. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Zone
Case No. 393, the request of Nancy McDowell for rezoning Lot 12, Block 10, Wye Addition

to Plainvi~ew, Hale County, Texas, from R-3 to CGB Zoning for commercial use as an
arcade and amusement center, located NE Corner Campbell and North Broadway. Motion
carried unanimously.
It was moved by Alderman Almon, seconded by Alderman Browning, to adopt Ordinance
No. 78-2262, an ordinance amending the zoning map of the City of Plainview for Zone Case
No. 393. ~,~tion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve Zone
Case No. 394, the request of Jerry Hodges for rezoning a 1.856 acre tract out of'SW/4
of Section 33, Block JK-2, Hale County, Texas, described by metes and bounds, from R-1
Zone to TH Zoning for construction of townhouses, located 2801 West 4th Street. Motion
carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance
No. 78-2263, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 394. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve Zone
Case No. 396, the request of Bonita Graham for rezoning a tract out of the NW Corner
of Section 26, Block JK-2, Hale County, Texas, described by metes and bounds, from an
R-1 Zone to a CGB Zone for commercial use for the sale of mobile homes, said property
located 4100 Block Dimmitt Road, Plainview, Hale County, Texas. Motion carried
unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Ordinance
No. 78-2264, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 396. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Zone
Case No. 397, the request of Bonita Graham for rezoning a tract out of the NW corner
of Section 26, Block JK-2, Hale County, Texas, described by metes and bounds, from an
R-1 Zone to M-H Zone for use as a mobile home park, said property located rear of

4100 Block Dimmitt Road, Plainview, Hale County, Texas. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Ordinance
No. 78-2265, an ordinance amending the zoning map of the City of Ptainview for Zone
Case No. 397. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve Zone
Case No. 398, the request of Orville Atkinson for rezoning Lots 40 and 41, Westridge
Park No. 2 from R-3 to TH Zoning for townhouses, located 201 and 203 Lometa Drive,
Plainview, Hale County, Texas. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Ordinance
No. 78-2266, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 398. Motion carried unanimously.
It'-was moved by Alderman Almon, seconded by Alderman SoRelle, to approve Zone
Case No. 400, the request of R. E. L. Farmer for rezoning a tract out of the South
half of the northeast 1/4 of Survey No. 38, Block JK-2, Hale County, Texas, being
5.72 acres, described by metes and bounds, from an R-1 to a CGB Zone for commercial
use, located North Columbia, Pla~nview, Texas. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance
No. 78-2267, an ordinance amending the zoning map of the City of Plainview for Zone
Case No. 400. Motion carried unanimously.
Appearing in favor of Zone Case No. 399 was Mrs. Gerald CootS. Appearing against
Zone Case No. 399 were the following: Bill Rice, Wink Banister, J. C. Driver, Gennie
Johnson, J. W. Himes, Raul Vera, Orville Stafford, and Willie Yonk.
It was moved by Alderman Browning, seconded by Alderman Almon, to uphold the
Planning and Zoning Commission decision to deny the request of Mrs. Gerald Coots to
rezone a tract out of the NW part of the S/2 of the NW/4 of Survey No. 38, Block JK-2,
Hale County, Texas, described by metes and bounds, from R-1 Zone to a M-H Zone for
mobile home park, said property located 3300 Block North Quincy, Plainview, Texas,

Zone Case No. 399, as s~ated in the Zoning Ordinance. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve the minutes
of the regular City Council meeting held September 12, 1978. Motion carried unanimously.
I.t was moved by Alderman Browning, seconded by Alderman SoRelle, to approve the
minutes of the special City Council meeting held September 5, 1978 concerning study
and prioritizing the Street, Highway and Major Thoroughfare Plan. Motion carried
unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve the
minutes of the special City Council meeting held September 6, 1978 concerning the
Subudivision Regulation. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman SoRelle, to approve the
minutes of the special City Council meeting held September 13, 1978 concerning review
of the proposed Street, Highway and Major Thoroughfare Priorities. Motion carried
unanimously.
It was moved by Alderman A~mon, seconded by Alderman SoRelle, to approve the
minutes of the special City Council| meeting held September 14, 1978 with George Wall,
District Engineer, State Highway~ DePartment. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to approve the
minutes of the special City Council meeting held September 21, 1978. 'Motion carried
unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to authorize the
introduction of Ordinance No. 78-2270, an ordinance approving the rate schedule to be
charged by Southwestern Public Service Co. and the City of Plainview, Texas; providing
for an effective date for such rate schedule and providing for conditions under which
such rate schedule may be charged, motified, amended or withdrawn. Motion carried
unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Appropria-

tion Ordinance No. 78-2271 from the City of Plainview GeneralFund Account'~n ~he
amount of $2,833.95 payable to SPS Steering Committee for consulting fee services
on the Southwestern Public Service Rate Case. Motion carried unan~mQusly.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Appropria-
tion Ordinance No. 78-2272 from Revenue Sharing Fund Account 427-613 in the amount of
$2,880.00 payable to Emco for 15 3 yard side load containers. Motion carried unanimously.
It was moved by .Alderman Almon, seconded by Alderman Browning, to adopt Appropria-
tion Ordinance No. 78-2273 from Revenue Sharing Fund Account 427-613 in the amount of
$5,480.00 for 20 - 4 yard front load containers payable to Duncan Equipment Co. of
Arlington. Motion carried unani.mously~
It was moved by Alderman Browning, seconded by Alderman SoRelle, to adopt Appro-
priation Ordinance No. 78-2274 from Revenue Sharing Fund Account 427-620 in the amount
of $2,261.46 payable to General Fund Account for debris clearance project #343 - 511-13
Ennis. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation
Ordinance No. 78-2275 from ReYenue Sharing Fund' Account 427-620 in the amount of $551.16
payable to General Fund Account 620-811 for installation of new signal base relocating
traffic signal pole at 6th and Austin Street. Motion carried unanimously.
It was moved by Aldemlan Browning, seconded by Alderman SoRelle, to adopt Appropria-
tion Ordinance No. CD3-088 from Community Development Fund Account 429-831 in the amount
of $5,685.95 payable to General Fund for Project #300 - 1516 Gray for $1,403.86 and
Project #295 - 303-305 Fir for $4,281.53. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Resolution
No. R78-110, upon the recommendation of the~Plainview-Hale County Airport Board and
approval of the FAA of %he_ appraised price and a bid from Cloverlake D6iry Products
equal to or in excess of the appraised value, it is hereby resolved that the Mayor be
authorized to sign said agreement with FAA and authorize delivery of the warranty deed

subject to conditions and specified use of funds, as stipulated in the letter dated
September 7, 1978 from FAA; and that the Mayor be authorized to sign Lease No. DOT-
FA79-SW-lO13 VASI-RW4/REIL-RW22. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve the
right of ingress at 722 Broadway, as explained by Bobby James. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle,-to approve the request
of the Plainview Public Schools to establish no-parking zones at 1800 Block Joliet and
1800 Block Independence. Motion carried unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve the
request of W. M. Tyler to the City of Plainview requesting curb~and gutter replacement
and a secondand a street use permit for the property located at 917-921 Ash Street,
subject to his replacing the sidewalk and a Hold Harmless agreement be obtained. Motion
carried unanimously.
Received for filing, copies of information on the Southwestern Public Service Rate
Case and a copy of the Examiner's Report of the Texas Public Utility Comission, Docket
1861.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve and
authorize the Mayor to sign assessments as filed under Ordinance No. 66-939. Motion
carried unanimously.
Received for filing, Pioneer Natural Gas Co. Cost of Gas Pass-through for its
West Texas System for the month of August 1978.
It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Zone
Case No. 401, the request of Jimmie Sherman for rezoning Lot 5 and the East 35' of Lot
6 of the W 15' of the South 60' of Lot 6, Block 12, Highland Addition to the City Of
Plainview, Hale County, Texas, from R-2 to MF-I Zone for rental units, located 1501
West llth, Plainview, Texas. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Ordinance

No. 78-2268, an ordinance amending the zoning map of the City of Plainview for Zone Case
No. 401. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Almon, to approve the
request for authorization for out-of-state travel for the City Manager to attend the
International City Manager's Association Conference to be held October 15-17, 1978 in
Cincinnati, Ohio. Motion carried unanimously.
The City Council Work Session to be held October 5, 1978 has been changed to
October 9, 1978.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to go into Executive
Session to discuss appraisals on Parcels 23, 24 and 25 on'U.S. Highway right-of-way
appraisals. Motion carried unanimously.
It was moved by Alderman Almon, seconded by Alderman SoRelle, to come out of
Executive Session and approve the appraisal on Parcels 23, 24 and 25. Motion carried
unanimously.
It was moved by Alderman SoRelle, seconded by Alderman Almon, to adjourn.
Meeting was adjourned at 9:54 P.M.
