CITY COUNCIL MINUTES City Council Chambers 901 Broadway Plainview, Texas The City Council of the City of Plainview met in regular session at 7:30 P. M. in the City CoundiI Chambers of the City Hall with J. Robert Wayland~presiding and the fllowing Councilmen present: Jeane Browning-Place One; Medlin Carpenter-Place Two; Lloyd Woods-Place Three; Tom Almon-Place Four; and William SoRelle-Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Randy Holly-Administrative Assistant, Tom Hamilton-City Attorney, M. L. Rea-City Clerk, Norman Hugglns~Director of Finance, Bill Hogge-Director of Public Works, Johnnie Ballew- Director of Safety and Environment, Harold Gladman-Director of Planning, Alan Stewart- Director of Police Services, Woody Sevison-Director of Fire Services, Walter Dodson- Tax Assessor/Collector, Bob Richards-Building Inspector, and Debbie Hall-Administrative Secretary. Also present were the following visitors: Shari Campbell-Plainview Daily Herald, Chuck Martin-Plainview Reporter News, Charles Bechtold, J. D. Taylor, Allen Taylor, Lon D. Cartwright, Orville Atkinson, Brenda Holly, Bill A. McBride, James R. Odom. Invocation was give by Tom Hamilton. Mr. Taylor and Mr. James Odom were present to discuss their water bills. No action was taken. It was moved by Alderman Woods, seconded by Alderman Carpenter, to remove the item concerning a 75' Telescopic Water Tower and Aerial Ladder from the agenda until further study can be made. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to approve the specifications and authorize the advertising for bids on six motor vechicles consisting of three 3/4 ton pickups, one 5/8 ton pickup, one 1 ton dump truck and one panel truck. Two pickups, l~.ton dump ~truck and panel truck to be purchased with Budgeted Capitol Reserve Funds and two pickups to be purchased with Water and Sewer funds. Motion carried unanimously. November 14, 1978 Page 2 CITY COUNCIL MINUTES It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve the specification and authorize the advertising for bids for the purchase of four service bodies for use on above pickups and one ton dump body to be used on the 1 ton dump truck above. Two service bodies to be purchased by Capitol Reserve Funds, two to be purchased by the Water & Sewer Fund and the 1 ton dump body to be purchased by Capitol Reserve Funds. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to approve the specifications and authorize the advertising for bids on the purchase of one traffic signal controller and 1,000 ft. of cable and 8 traffic signal heads, to be purchased with Revenue Sharing Funds as budgeted for installation at Yonkers and 24th Street. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to approve the specifications and authorize the advertising for bids on the purchase of four mast arms, poles and hardware for traffic signals to be purchase with budgeted Revenue Sharing funds and to be installed at 24th Street and Yonkers. Motion carried unanimously. It was moved by Alderman Carpenter, senonded by Alderman Almon, to table Zone Case No. 404 until the next City Council meeting. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to approve the minutes of the regular City Council meeting held October 24, 1978. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Carpenter, to approve the minutes of the special City Council meeting held November 13, 1978. Motion carried unanimously. The following minutes were received for filing: (1) Parks, Recreation and Open Space Advisory Committee (2) Board of Electrical Examiners (3) Board of Adjustment Hearing (4) Planning and Zoning Hearing (5) Unger Memorial Library Advisory Committee October 6, 1978 October 17, 1978 October 23, 1978 October 26, 1978 October 9, 1978 November 14, 1978 Page 3 CITY COUNCIL MINUTES It was moved by Alderman Woods, seconded by Alderman Carpenter, to authorize the City Attorney to prepare an ordinance filing on persons not returning borrowed library books from the Unger Memorial Library. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to not hold Authority, Board, Commission and Committee Banquet this year. Motion carried unanimously. Orville Atkinson, Chairman of the study CommitteeLappointed to study Ordinance No. 78-2259, 78-2260 and 78-2261, appeared to make recommendations to the City Council on the above mentioned ordinances. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Ordinance No. 78-2259, an ordinance defining the general rules and regulations governing plats and subdivision of land falling within the jurisdiction of the City of Plainview for the purpose of providing for the orderly, safe, and healthful development of the area within the City and within the area surrounding the City and to promote the health, safety, morals and general welfare of the community; defining terms; setting forth purpose, authority and jurisdiction, requiring approval; establishing procedure for approval of preliminary and final plats; providing general provisions; establishing general requirements and design standards for streets, lots, blocks, building lines, alleys, easements, flood areas, and playa lakes; requiring improvements; providing for City participation in improvements; providing for reservations, variances, inspection of construction and a penalty; establishing filing fees and charges; requiring performance bond; providing for conflict with other ordinances, a saving clause, and an effective date; and providing for repeal of Ordinance No. 65-864. Subject to the recommendation of the study committee. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Ordinance No. 78-226q, an ordinance defining wet weather lake area and h~gh water level, November 14, 1978 Page 4 CITY COUNCIL MINUTES regulating the dumping of dirt, debris, or other materials within the wet weather lake area; providing a severability clause; prohibiting the issuance of building permits or the approval of plats within a wet weather lake area; providing for certain excavations, and appeals to the City Council. Subject to the recommendations of the study committee. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Ordinance No. 78-2261, an ordinance amending Ordinance No. 73-1383 of the City of Plainview changing the charges known as "Pro-Rata" and changing the rates to be paid by developers as providing insaid ordinance, and repealing Ordinance No. 77-2109. Subject to the recommendations of the study committee. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. 78-2284 from Revenue Sharing Fund Account 427-607 in the amount of $72,630.00 payable to General Fund for second of three installments on police fleet and liability and physical damage insurance. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to adopt Appropriation Ordinance No. 78-2285 from General Fund Unappropriated Surplus 611-601 in the amount of $5,494.00 payable to General Fund 605-536 to amend non-departmental insurance budget to provide funds for purchase of Public Officials and Employees . liability coverage. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almo. n, to adopt Appropriation Ordinance No. 78-2286 from Pro-Rata Construction Fund 434 in the amount of $12,882.20 payable to Irrigation, Inc. for Construction Estimate No. 1, Sanitary Sewer and Water Distribution Extensions, Project No. SW-78-01. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Ordinance No. 78-2287 from 1978 Revenue Sharing Fund 427-613 in the amount of $1,828.~75 payable to South Plains Concrete Construction for removal and replacement of curb and gutter at 4th and Broadway and at 6th and Austin. Motion carried unanimously. November 14, 1978 CITY COUNCIL MINUTES Page 5 It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropria- tion Ordinance No. 78-2288-from 1966 Revenue Bond Fund 426-116 in the amount of $293.86 payable to Parkhill, Smith & Cooper, Inc. for Engineering Services rendered in connection with disposal of sewage effluent - for period July 1 through September 30, 1978. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt Appropriation Ordinance No. CD1-091 from Community Development Fund Account 429 in the amount of $15,288.86 payable to High Plains Pavers, Inc. for Construction Estimate No. 7, 1977 Assessment Paving, contract dated November 22, 1977. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Appropriation Ordinance No. CD1-093 from Community Development Fund Account 429-817 in the amount~of $3,537.13 payable to High Plains'Pavers, Inc. for City's cost for additional paving width on Kermit Drive in Rose Addition and Town West Addition, Unit No. 2. Contract dated November 22, 1977. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Appropria- tion Ordinance No. GO 409-78 from G.O. Bond Fund 1966 424-807 in the amount of $3,047.38 payable to High Plains Pavers, Inc. for City's cost for additional paving width on Kermit Drive in Rose Addition and Town West Addition, Unit No. 2. Contract dated November 22, 1977. Motion carried unanimously. The City Attorney is to study and make recommendation on the request of Frontier Savings Association requesting inclusion as a future depositor for the City of Plainview Public funds. It was moved by Alderman Carpenter, seconded by Alderman Almon, to authorize a no-parking zone in the 2500 Block on West 8th Street as requested by Wayland Baptist College. Motion carried unanimously. Letter from the Canadian River Municipal Water Authority advising the City of Plainview of its water allocation during calendar 1979 was discussed. November 14, 1978 Page 6 CITY COUNCIL MINUTES Received for filing, the average cost of gas for the month of September 1978 as submitted by Pioneer Natural Gas Co. West Texas Transmission System. It was moved by Alderman Almon, seconded by Alderman Woods, to go into executive session to discuss appraisal on tracts of land located on U.S. Highway 70. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to come out of executive session. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to approve the parcels 1, 8 and 21 on U.S. Highway 70. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Woods, to approve the request for an ordinance changing the pa~king limits in the 700 Block of Broadway from 45 minute parking to 2 hour parking on both sides of the street. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman SoRelle,.~to approve the request of Mr. Lon Cartwright for the City to pave a 29' width street with curb and gutter along the north side of West 24th Street from Garland'.to~i/2 block West of Kermit Drive. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Almon, to authorize Bill McBride to erect the post now holding the awning in front of Plainview-Hardware Col at 500 Ash Street, subject to his complying With City regulations by submitting a hold harmless agreement and getting a city street~ use permit. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to approve the dates of future City Council meetings as outlined by the City Manager.
