September 24, 1974
The City Council of the City of Plainview met in regular session at 7:30 p.m.
in the Council Chambers of the City Hall with Mayor John D. Stoneham presiding and
the following Aldermen present: Keltz Garrison, Neal Williams, Medlin Carpenter,
Richard Cross, and Jeane Browning.
Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney, M. L.
Rea-City Clerk, Harold Gladman-Director of Planning, Norman Huggins-Director of
Finance, Billy Rogers-Park Supervisor, Mike McGregor-Administrative Assistant, and
Linda Fisch-Administrative Secretary. Visitors included Tom Almon, Dr. C. M.
Baldwin, Bill Bruder-KKYN Radio, Chuck Martin-KVOP Radio, Charles Bechtold-KGNC
Radio & TV, and LeWard Hood-Pla.inview Da..ily Herald.
Invocation was given by Jeane Browning.
It was moved by Alderman Carpenter, seconded by Alderman Garrison, to appoint
the following to the Community Improvement Coundi~-~to serve a term expiring
October 1976: Ed Thornton, Chairman-Area 3; Sue Webb and Jesse Sanchez-Area 4;
and Jack Kunz~ Chairman, and Gary Stark-Area 5. Motion carried unanimously.
It was moved by Alderman Williams, seconded by Alderman Cross, to appoint the
following to the Central Business District Improvement Committee: John Skaggs,
Joe Don Hancock, Jack Oswald, and Lester James, Sr. Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Browning, to appoint

Motion carried unanimously.
It was moved by Alderman Williams, seconded by Alderman Garrison, to appoint
Don McMillon (replacing Sid Reams) and Troy Carter (replacing Lon Cartwright) and
to reappoint Jim Kelly to the Board of Electrical Examiners to serve a term
expiring September 1976. Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Browning, to appoint
Bob Voelker (replacing B~b~-'~Boyd) and to reappoint E. N. Givens to the Planning Board
and Zoning Commission to serve a term expiring January 1, 1978. Motion carried
unanimously.
Dr. C. M. Baldwin received a certificate of appointment to the Ptainview/Hale
County Health Board to serve a term expiring May 1976.
Discussion was held on Zone Case No. 253, request of Robert E. McDonald for re-
zoning of Lots 15, 16, and 17, Block 2, Eoff-Green Addition, from R-2 to C-2 Zone
located at 209 Lindberg Street. It was moved by Alderman Williams, seconded by
Alderman Browning~ to adopt Ordinance No~. 74-1635, an ordinance amending Zoning
Ordinance No. 794 and the official map of the City of Plainview as requested in Zone
Case No. 253. Motion carried unanimously.
A public hearing was opened on the 1975 City of Plainview budget for the fiscal
year beginning October 1, 1974. Marshall Pharr, City Manager, readAthe letter of
transmittal. There being no discussion, the public hearing was closed.
It was moved by Alderman Garrison, seconded by Alderman Williams, to adopt
Ordinance No. 74-1633, an ordinance approving the budget submitted by the City
Manager of the City of Plainview, Texas, for the fiscal year 1974-75, and to commend

the City Manager and staff for preparing an excellent budget. Motion carried
unanimously.
It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt
Ordinance No. 74-1634, an ordinance levying taxes for the use and support of the
municipal government of the City of Plainview, Texas, providing for the interest and
sinking fund for the fiscal year 1974-75; providing for the time and manner of paying
the ad valorem taxes levied. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Williams, to adopt
Ordinance No. 74-1636, an ordinanee-~ fixing the water rate of the City of Plainview,
Texas; and repealing all ordinances or parts of ordinances in conflict herewith.
Motion carried unanimously.
It was moved by Alderman Cross, seconded by Alderman Garrison, to adopt
Ordinance No. 74-163~, an ordinance setting the rates to be charged for sewer ser-
vice and sewer disposal service in the City of Plainview, Texas; and repealing all
ordinances or parts of ordinances in conflict herewith. Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Williams, to adopt
Ordinance No. 74-1638, an ordinance fixing the water rates in the City of Plainview,
Texas, for water furnished swimming pools not owned by the City; and fixing bulk
water rates when water is taken from fire hydrants or coin operated meters or water
connections belonging to the City of Plainview. Motion carried unanimously.
It was moved by Alderman Browning, seconded by Alderman Cross, to adopt
Ordinance No. 74-1639, an ordinance providing for a uniform monthly service charge
for the collection of garbage and for furnishing water, sewer and vector control
services on singl~ family dwellings to residents of the City of Plainview. Motion
carried unanimously.

It was moved by Alderman Cross, seconded by Alderman Garrison, to adopt
Ordinance No. 74-1640, an ordinance fixing rates for the sale and delivery of
water to those churches, schools, and non-profit charitable or civic organizations
that have been or may be hereafter approved for the rates by the City Council of
the City of Plainview, Texas. Motion carried unanimously.
It was moved by Alderman Williams, seconded by Alderman Garrison, to adopt
Resolution No. R74-022, a resolution appointing Miss Linda Fisch as Deputy City
Clerk and Treasurer of the City of Plainview. Motion carried unanimously. Joe
Sharp, City Attorney, ~dm~nistered ~the 6at~-~Of.~office.
It was moved by Alderman Williams, seconded by Alderman Carpenter, to award the
contract to the low bidder, Mission Linen Supply of Amarillo, in the amount of $2.40
per week for furnishing, cleaning, and maintaining uniforms for the City of
Plainview. Motion carried umanimously.
It was moved by Alderman Garrison, seconded by Alderman Carpenter, to award the
bid for one (1) 1974 police special to Bob Gardner Chevrolet in the amount of $4,395
and to authorize readvertising for two additional police vehicles. Motion carried
unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Cross, to award the
bid for two (2) 1974 3/4-ton pidkups to Bob Gardner Chevrolet in the amount of
$7,249.34 and to authorize readvertising for one additional 3/4-ton pickdp. Motion
carried unanimously~
Reminder was made of the public hearing on the 1974 assessment paving program
to be held in the Council Chambers October 17th at 10:00 a.m.

It was moved by Alderman Williams~ seconded by Alderman Garrison, to approve
the minutes of the regular City Council meeting held September 10, 1974. Motion
carried unanimously.
Received for filing were copies of minutes of the COmmunity and Neighborhood
Improvement Committee meeting held September 9th; Parks, Open Space, and Recreation
Advisory Committee meeting held September 9th; Central Business District Improvement
Committee meeting held September 19th; and Electrical Board of Examiners meeting
held September 17th.
It was moved by Alderman Garrison, seconded by Alderman Williams, to approve
the recommendation of the Central Business District Improvement Committee to change
parking back to a 45~Q angle as was originally on the west side of Broadway from
Fifth to Fourth Streets and to advertise for the above change in parking. Motion
carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Browning, to adopt
Ordinance No. 74-1642, an ordinance setting a date, time and place for a public
hearing on the proposed annexation of certain property by the City of Plainview,
Texas: authorizing and directing the Mayor to publish notice of such public hearing;
and declaring an emergency (TRACT 1). Motion carried unanimously. Hearing set

It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt
Ordinance No. 74-1644, an ordinance setting a date, time and place for a public
hearing on the proposed annexation of certain property by the City of Plainview,
Texas, authorizing and directing the Mayor to publish notice of such public hearing;
and dedtaring an emergency (TRACT 3). Motion carried unanimously. Hearing set for
October 22nd at 7:30 p.m.
It was moved by Alderman Williams, seconded by Alderman Garrison, to adopt
Ordinance No. 74-1645, an ordinance setting a date, time and place for a public
hearing on the proposed annexation of certain property by the City of Plainview,
Texas, authorizing and directing the Mayor to publish notice of ~such public hearing;

It was moved by Alderman Williams, seconded by Alderman Browning, to adopt
Ordinance No. 74-1648, an ordinance setting a date, time and place for a public
hearing on the proposed annexation of certain property by the City of Plainview,
Texas, authorizing and directing the Mayor to publish notice of such public hearing;
and declaring an emergency (TRACT 7). Motion carried unanimously. Hearing set for
October 22nd at 7:30 p.m.
It was moved by Alderman Browning, seconded by Alderman Williams, to adopt
Ordinance No. 74-16'49, an ordinance setting a date, time and place for a public
hearing on the proposed annexation of certain property by the City of Plainview,
Texas, authorizing and directing the Mayor to publish notice of such public hearing;
and declaring an emergency (TRACT 8). Motion carried unanimously. Hearing set for
October 22nd at 7:30 p.m.
It was moved by Alderman Carpenter, seconded by Aldemman Garrison, to adopt
Ordinance No. 74-1650, an ordinance setting a date, time and place for a public
hearing on the proposed annexation of certain property by the City of Plainview,
Texas, authorizing and directing the Mayor to publish notice of such public hearing;
and declaring an emergency (TRACT 9). Motion carried unanimously. Hearing set for
October 22nd at 7:30 p.m.
Plans were made for a noon luncheon with ERA September 30th to discuss a pro-
posal on treatment of effluent water.
Discussion was held on the proposed fire contract with Hale County. It was
moved by Alderman Garrison, seconded by Alderman Browning

2. to authorize the Mayor to negbti~te with the county on the following
change on the resolution: striking "further study" and setting an
expiration date of January 31, 1975, and
3. to authorize negotiations with industrial concerns surrounding Plainview
for private fire contracts.
Motion carried unanimously.
Discussion was held on the 911 emergency number.
It was moved by Alderman Browning, seconded by Alderman Garrison, to approve
a request for additional seal coat maintenance funds in the amount of $4,935.79.
Motion carried unanimously.
Discussion was held on the continuation of the Comprehensive Master Plan
(Phase IV).
Received for filing was a copy of the summary and current sales tax receipt
for the quarter ending June 30, 1974~ in the amount of $125,421.26.
It was moved by Alderman Carpenter, seconded by Alderman Garrison, to authorize
advertising for sale improvements on city owned property located at 912 Austin and
213 West 9th whenever appropriate. Motion carried unanimously.
It was moved by Alderman Cross, seconded by Alderman Williams, to authorize
the discontinuance of reminder notices on utility bills. Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Carpenter, to adopt
the following out-of-state travel policy. Motion carried unanimously.
1. Any request for out-of-state travel for attendance of conferences
and seminars must be requested no less than 30 days in advance of
the proposed meeting. Budgeted funds must be approved as available.
2. Request for payment shall be limited to the City employee only, and
shall include only registration, food, and lodging for the actual day
of the conference or seminar.

3. Travel expense to'and from will be at the employee expense, and one
day travel to and one day travel return will be the maximum permitted.
Any additional travel time shall be considered vacation.
4. If a City vehicle is authorized for out-of-state travel, reimbursement
shall be made to the City at the same rate as current travel allowance.
5. The Plainview City Council may request employee to attend out-of-state
conferences, conventions, and for special benefits to the City. The
City Council shall authorize and appropriate the necessary funds.
It was moved by Alderman Browning, seconded by Alderman Cross, to approve the
installation of two street lights in the vicinity of Running Water Draw and Joliet
Street~ Motion carried unanimously.
Received for filing was a copy of the City of Plain~iew newsletter, Volume
Issue 46.
It was moved by Alderman Carpenter, seconded by Alderman Williams, to adopt
Appropriation Ordinance No. 74-1628 from the Revenue Sharing Account 427-814 in the
amount of $1,061.30 payable to Nichols Machinemy Company for materials used in
asphalt tank installation. Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Browning, to adopt
Appropriation Ordinance No. 74-1629 from the Revenue Sharing Account 427-680 in the
amount of $47.30 payable to High Plains Concrete Company for concrete used by the
Water Production Department. Motion carried unanimously.
It was moved by Alderman Williams, seconded by Alderman Cross, to adopt
Appropriation Ordinance No. 74-1630 from the Unappropriated Surplus Account 611-620
in the amount of $1,341.66 payable to Account 620-816 for payment to Unistrut Texas,
Inc. for traffic sign poles. Motion carried unanimously.
It was moved by Alderman Cross, seconded by Alderman Carpenter, to adopt Appro-
priation Ordinance No. 74-1631 from the Revenue Sharing Account 427-814 in the amount

It was moved by Alderman Carpenter~ seconded by Aldemman Garrison, to adopt
Appropriation Ordinance No. 74-1632 from the Unappropriated Surplus Account 611-640
in the amount of $216.30 payable to Account 640-812 for payment tO L. James Robison
& Associates for final statement on supervision of tennis court project. Mo~±on

It was moved by Alderman Williams, seconded by Alderman Garrison, to adopt Appro-
priation Ordinance No. 74-1641 from the Revenue Sharing Account 427-814 in the amount
of $30.00 payable to Hastey Construction Co. for asphalt tank installation. Motion
carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Browning, to approve
payment on the balance of the tennis court project to Don Mas~erson and to require
guarantee of one year on all materials written on warranty. Motion carried unanimously.

Septembem 24, 1974
The City Council of theCity of Plainview met in megular session at 7:30 p.m.
in the Council Chambems of the City Hall with Mayom John D. Stoneham presiding and
the following Aldemmen pmesent: Keltz Gammison, Neal Williams, Medlin Campenter~
Richard Cmoss, and Jeane Browning.
Also pmesent were Mamshall Phamr-City Manage~ Joe Shamp-City Attor~ey~ M. L.
Rea-City Clerk, Hamold Gladman-Directom of Planning, Nor~nan Huggins-Director o~
Finance, Billy Rogers-Pamk Supemvisor, Mike McGregor-Administmative Assistant, and

Motion carried unanimously.
It was moved by Alderman Williams, seconded by Alderman Garrison, to appoint
Don McMillon (replacing Sid Reams) and Troy Carter (replacing Lon 'Cartwright) and
to reappoint Jim Kelly to the Board of Electrical Examiners to serve a term
expiring September 1976. Motion carried unanimously.
It was moved by Alderman Garrison, seconded by Alderman Browning, to appoint
Bob Voelker (replacing Bob~Boyd) and to reappoint E.~N. Givens to the Planning Board
and Zoning Commission to serve a term expiring January 1, 1978. Motion carried
unanimously.
Dr. C. M. Baldwin received a certificate of'appoihtment to thePlainview/Hale
County Health Board to serve a term expiring May 1976.
Discussion was held on Zone Case No. 253, request of Robert E.'McDonald for re-
zoning of Lots 15, 16, and 17, Block 2, Eoff-Green Addition, from. R-2 to C-2 Zone
located at 209Lindberg Street. It was moved by Alderman Witliams~ seconded'by
Alderman Browning, to adopt Ordinance Nog. 74-1635, an ordinance amending Zoning
Ordinance No. 794 and the official map of the City of plainview as requested in Zone
Case No. 253'. Motion carried unanimously.
A public hearing was opened on the 1975 City of Plainview budget for the fiscal
year beginning October 1, 1974. Marshall Pharr, City Manager, readlthe letter.of
transmittal. There being nodiscussion, the public heaping was closed.
It was moved by Aldemman Garrison, secOnded by Alderman Williams,'to adopt
:Ordinance No. 74-1633, an ordinance approving the budget submitted by the City
Manager of the City of Plainview, Texas, for the fiscal year 1974-75, and to commend

the City Manager and staff for preparing an excellent budget. Motion carried
unanimously. ,~
It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt
Ordinance No. 74-1634, an ordinance levying taxes for the use and support of the
municipal government of the City of Plainview, Texas, providing for the interest and
sinking fund for the fiscal year 1974-75; providing for the time and manner of paying
the~ad valorem taxes levied. Motion carried unanimously.
It was moved by Alderman Carpenter, seconded by Alderman Williams, to adopt
Ordinance' No. 74-1836, an ordinance fixing the water rate of the City of Plainview,
Texas; and repealing all ordinances or parts of ordinances in conflict herewith.
Motion carried unanimously.
It was moved by Alderman Cross, seconded by Alderman Garris~?n~ to adopt ~
Ordinance No. 74-1637, an ordinance setting the rates to be charged for sewer ser-
vice and sewer disposal service in the City of Plainview, Texas; and repealing all
ordinances or parts of ordinances in conflict herewith. Motion carried unanimously.
Ii was moved by Alder~nan Garrison, seconded by Alderman Williams, to adopt
Ordinance'No. 74-1638,'an ordinance fixing the water rates in the City of Plainview,
TexaS, for water furnished swimming pools not owned by the City; and fixing bulk
'water rates when water is taken from fire hydrants or coin operated meters or water
connections belonging to the City of Plainview. Motion carried unanimously..
It was moved by Alderman Browning~ seconded by Alderman Cross, to adopt
Ordinance No. 74-1639, an ordinance providing for a uniform monthly service charge
for the collection of garbage and for furnishing water, sewer and vector control
services dn single family dwelllngs to residents of the City of Plainview. Motion

It was moved by Alderman C~oss, seconded by Alderman Garrison, to adopt
Ordinance No. 74-1640, an ordinance fixing rates for the sale and delivemyof
water to those churches, schools, and non-profit charitable or civic organizations
that have been or may be hereafter approved for the rates by the City Council of
the City of Plainview, Texas. Motion carried unanimously.
It was moved by Alderman Williams, seconded by Alderman Garrison, to adop~
Resolution No. R74-022, a resolution appointing Miss Linda Fisch as Deputy City
Clerk and Treasumer of the City of Plainview~ Motion'carmied unanimously. Joe
Sharp, City Attorney, administered the oatK ~of office.
It was moved by Alderman Williams, seconded by Alderman Carpenter, to award the
contract to the low bidder, Mission Linen Supply of Amarillo, in the amount Of $2.4D
per week for fumnishing~cleaning, and m~i~%~niRg uniforms .for the~City~.Qf .- -~j,~?~i.~
Plainview. Motion carried unanimously.
It was~ moved by Alderman Garrison, seconded by Alderman Carpenter, to award the
bid for one (1)197~ police special to Bob Gardner Chevrolet in the amount.of'S4,395
and to authorize readvertising for two additional police vehicles. Motion carmied

bid for two (2) 1974 3/4-ton pickups to Bob Gardner Chevroletin the amount of
$7,249,34 and to authorize readvertising for one additional 3/4-ton pickup. Motion
carried unanimously,
Reginder was made of the public hearing on the 1974 assessment paving program
to be held in the Council Chambers October 17th at 10:00 a.m.

It was moved by Alderman Williams, seconded by Alderman Garrison, to approve
the minutes of the regular City Council meeting held September 10, 1974. Motion
carried unanimously.
Received for filing were copies of minutes of the Community and Neighborhood
Improvement Committee meeting held September 9th; Parks, Open Space, and Recreation
Advisory Committee meeting held September 9th; Central Business District Improvement
Committee meeting held September 19th; and Electrical Board of Examiners meeting
held September 17th.
It was moved by Alderman Garrison, seconde~by Alderman Williams, to approve
the recommendation of the C~ntral-B~siness District~mprovement Committee to
parking back to a 45° angle as was originally on the west side of Broadway from
Fifth to FoUrth Streets and to advertise for the above change in parking. Motion

Ordinance No. 74-1642, an ordinance setting a date, time and place for a public
hearing on the proposedannexation of eertainproperty by the City of Plainview,
Texas, authorizing and directing the Mayor to publish notice of such public hearing;
and declaring an emergency (TRACT 1). Motion carried unanimously'. Hearing set
