MINUTES CITY COUNCIL REGULAR MEETING January 28, 1975 The City Council of the City of Plainview met in regular session at 7:30 p.m. in the Council Chambers of the City Hall with Mayor John D. Stoneham presiding and the following Aldermen present: Keltz Garrison, Medlin Carpenter, Neal Williams, and Jeane Browning. Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney, M. L. Rea-City Clerk, Wm. R. Hogge-Director of Public Works, Harold Gladman-Director of Planning, Johnnie Ballew-Director of Public Safety, Billy Rogers-Park and Recreation Supervisor, Nomman Huggins-Director of Finance, Mike McGregor-Administrative Assis- tant, and Linda Fisch-Administrative Secretary. Visitors included Mr. & Mrs. James Kruse, Jim Johnston, Mr. & Mrs. Ron Purtell, Lynnvel King, Wayne Moore, Gene Pearcy, Sherri Thomas, Robert Moore, Jana Hinricks, B. D. Perkins, E. M. Invocation was given by Jeane Browning. Discussion was held on Zone Case No. 255, request of Mrs. Bamnes and E. M. ©sborne for rezoning of Lots 11-12-13-14-15-16, Block 4, High School Addition, from a R-1 Zone to a R-3 Zone for multi-fami~7 use, located at 1901 N. Quincy. Mr. Osborne spoke in favor of the change and James Savage, Toy Tullis, Ron Roberts, and Carroll Johnston spoke in opposition. It was moved by Alderman Garrison~ seconded by Alderman Williams, to adopt Ordinance No. 75-1765, an ordinance amending the Zoning Map of the City of Plainview as proposed in Zone Case No. 255. Motion carried unanimously. Durward Jones spoke for the change. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Ordinance No. 75-1766, an ordinance amending the Zoning Map of the City of Plainview as proposed in Zone Case No. 258. Motion carried unanimously. Discussion was held on Zone Case No. 259, request of Mr. Gene Pearcy for rezoning of the Lots lw ~ and 14, Block 67, College Hill Addition, from a C-1 Zone to a C-2 Zone to be used for a theater, arcade, and snack bar; located at 2401 West 5th Street. GenePearey, B.'.D.' Perkins '(representative from Youth Committee of the Chamber of Commerce), and dames Kruse ~poke for the change and Lynnvel King spoke in opposition. A letter from Mrs. Will Fondren was read in opposition to the change. It was moved by Alderman Carpenter, seconded by Alderman Garrison, to adopt Ordinance No. 75-1767, an ordinance amending the Zoning Map of the City of Plainview as proposed in Zone Case No. 2'59. MINUTES CITY COUNCIL REGULAR MEETING January 28, 1975 Page 3 Received for filing were copies of minutes of the Paper Recycling Steering Committee meeting held January 10th, Housing Authority meeting held January 14th, Plumbing Appeals and Advisory Board meeting held January 20th, Electrical Board meeting held January 21st, and Planning Board and Zoning Commission meeting held January 23rd. It was moved by'Alderman Browning, seconded by Alderman Carpenter, to a~uthorize the City Attorney to prepare an amendment to the Plumbing Code to include the following. Motion carried unanimously. (1) Permitting the use of PLASTIC pipe for building drain, drainage branch, soil, stack, vent stack, and vent branches, in buildings not to exceed two stories in height and (2) Permitting the use of FIBERGLASS tub and shower units in residential construction not to exceed two stories in height. It was moved by Alderman Carpenter, seconded by Alderman Williams, to authorize the City Attorney to prepare an amendment to the Electrical Code to include the following~ Motion carried unanimously. (1) Adopt the 1975 National Electrical Code and (2) Permit the use of ROMEX in townhouses and rowhouses. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Carpenter, to adopt Resolution R75-028, a resolution authorizing publication and introduction of Ordinance 75-1735, an ordinance providing for the extension of certain boundary limits of the City of Plainview, Texas, andthe annexation of certain territory consisting of 376.3 acres of land, which said territory lies adjacent to and adjoins the present boundary limits of the City of Plainview, Texas. Motion carried unanimously. Motion carried unanimously. It was moved by Alderman Garrison, seconded by Alderman Carpenter, to adopt Resolution R75~033, a resolution authorizing publication and introduction of Ordinance 75-1740, an ordinance providing for the extension of certain boundary limits of the City of Plainview, Texas, and the annexation of certain territory consisting of 14.5 acres of land, which said territory lies adjacent to and adjoins the present boundary limits of the City of Plainview, Texas. Motion carried unanimously. MINUTES CITY COUNCIL REGULAR MEETING January 28, 1975 Page 6 It was moved by Alderman Garrison, seconded by Alderman Browning, to adopt Resolution R75-034, a resolution authorizing publication and introduction of Ordinance 75-1741, an ordinance providing for the extension of certain boundary limits of the City of Plainview, Texas, and ~the annexation.of cemtainterritory consisting of 80.3 acres of land, which said territory lies adjacent to and adjoins the present boundamy limits of the City of Plainview, Texas. Motion carried unanimously. Introductionwas made on Ordinance 75-1758, an ordinance making it unlawful for any person to start and accelerate a motor vehicle on a public street or highway from a stopped position or accelerate a vehicle while moving in such a manner as to cause the driving wheels to spin and thereby create a loud screeching noise, and making it unlawful to cause the rear portion of a motor vehicle to sway or swing from side to side. Consideration of the above ordinance will be February 1!, 1975. Reminder was made of a meeting to be held Friday, January 31s% with representives of Pioneer Natural Gas Company to discuss the esculation cost report. It was moved by ~lderman Carpenter, seconded by Alderman Garrison, to approve a request from Hubbard-Warrick'~Furniture for a freight curb loading zone to be twenty feet in length located at 624 Ash Street. Motion carried unanimously. Said permit is for a period of one year. A recommendation of the Park, Recreation, and Open Space Advisory Committee was read for the acceptance of property donated by Dr. Gerald Wagner and C. B. Cline, Jr. and the decling of'property offered by Ted Dement. Medlin Carpenter and Jeane Browning were appointed to view the property in question and return opinion to Council. Action was tabled on a request of the Plainview/Hale County Board of Health for permission to allow the change in the staffing pattern of the department and a request MINUTES CITY COUNCIL REGULAR MEETING January 28, 1975 Page 7 with regard to the Health Department budget for the current fiscal year. A meeting will be scheduled with the Commissioner's Court to discuss both requests. It was moved by 'Alderman Garrison, seconded by Alderman Browning, to adopt the flood warning plan agreement between the City of Plainview and the National Weather Service. Motion carried unanimously. A report was made on the receipt of the partial draft of the Hale County Airport Master Plan as submitted by Parkhill, Smith & Cooper, Inc. It was moved by A~derman Browning, seconded by Alderman Garrison, to suspend the rule requiring ord~inances to be read more than one time or at more than one meeting. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Garrison, to adopt Ordinance 75~1759, an ordinance establishing election precincts for municipal elections; enacting provisions incident and relating thereto; and declaring an emergency. Motion carried unanimously. It was movedby Alderman Carpenter, seconded by Alderman Williams, to adopt Ordinance 75-1760, an ordinance calling and setting the regular municipal election for the City of Plainview to be held on the first Tuesday in April of 1975, the same being the first day of said month, for the election of one Alderman for place two on the City Council of the City of Plainview, and for the election of one Alderman for place four on the City Council of the City of Plainview; designating the place where said election is to be held; and appointing presiding officials thereof. Motion carried unanimously. Discussion was held on the preparation of an application for block grant funds under Title T of the Housing and Community Development Act of 1974, Public Law 93-383. Motion carried unanimously. Mayor Stoneham introduced Mr. Thomas Barber, the proposed developer for the application under the Housing and Community ~evelopment Act of 1974. The contract agreement was read and discussed. It was moved by Alderman Browning, seconded by Alderman Garrison, to authorize the Mayor to sign an agreement generally along~the same lines as'the one discussed, but first having been approved by the City Attorney. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Garrison, to adopt Appropriation Ordinance 75'1742 from the Revenue Sharing Account 427-680 in the amount of $575 payable to Kenneth Bond for the removal of debris and clearance of a lot located at 1303-1305 Fresno, Project 172, Lots 3 thru 6, Blk 53, Highland Addition. Motion carried unanimously. It was moved by Alderman Williams, seconded by Alderman Carpenter, to adopt Appropriation Ordinance 75-1.74~ from the Revenue Sharing Account 427-680 in the amount of $250 payable to Kenneth Bond for the removal of debris and clearance of a lot located at 2801 Dimmitt Road, Project 181, Lot 6, Blk 2, Edgemere Heights Addition. Motion carried unanimously. It was moved by Alderman Garrison, seconded by Alderman Williams, to adopt Appropriation Ordinance 75-1744 from the Revenue Sharing Account 427-680 in the amount of $175 payable to Kenneth Bond for the removal of debris and clearance of a lot located at 1000 Davidson, Project 191, Lots 1-2-3-, Blk 10, Frisco Addition. Motion carried unanimously. My interpretation of "at least thirty days have elapsed" means that you do not count the day of publication nor the day that the ordinance is passed. Therefore, my suggestion is that we ask the paper to publish 'these notices on next Sunday's issue, which will be February 2nd. Then we begin counting 'with the 3rd day of February and the first regular meeting date of the City Council occurring 30 days after first publication will be March 11, 1975. It can be published on Monday February 3rd and accomplish the same thing. Therefore, my suggested dates for publication of the Ordinance are either Sunday, February 2nd or Monday, February 3rd. The above described territory and· the area so annexed shall be a part of the City of Plainview, Texas, and the property so added hereby shall bear its prorata part of the taxes levied by the City of Plainview, Texas, and the inhabitants thereof shall be entitled to all of~the rights and privileges of all the citizens and shall be bound by' the acts, ordinances, resolutions and regulations of the City of Plainview, Texas.
