December 23, 1975
The City Council of the City of Plainview met in special session
at 7:30 p.m. in the Council Chambers of the City Hall with Mayor John
D. Stoneham presiding and the following Aldermen present: Keltz Gar-
rison, Neal Williams, Medlin Carpenter, Jeane Browning-and Tom A!mon.
Also present were Marshall Pharr-City Manager, Joe Sharp-City At-
torney, M. L. Rea-City Clerk, Wm. R. Hogge-Director of Public Works,
Har61d Gladman-Director of Planning, John~ie Ba!!ew~Director of Public
Safety, Norman Huggins-Director of Finance, Bill Rogers-Park Supervisor,
Mike McGregor-Administrative Assistant and Emma Quintanilla-Administra-
tire Secretary. Also present were Richard Orr-Plainview Daily Herald,
Chuck Martin-KVOP Radio, Kathryn Browning, Karla Dunnan, J. Hoyt Bowers,
J. C. Driver, C. A. Robinson, Margaret Robinson, Frank O. Baker, William
Ebeling, Orville Stafford, Troy Birdsong, Ruby Birdsong, Jun~ Watson,
Nadine McMillon, Bennie E. Estes, Freddye King, Mrs. Joe Ruiz, Joe Ruiz,

Invocation was given by Jeane Browning.
It was moved by Alderman Williams, second by Alderman Browning, to
accept for appointments to the City of P!ainview's Board 9f City Develop-
ment, for a term of 3 years, Mr. Dick Cross and Mr. Ken Akin. A third
appointment will be made at the next City Council meeting on January 13,
1976. These appointments are for replacements of Mr. Whitelaw H~nt, Mr.
James Robison and Mr. Andy Taylor, Jr. The Board of City Development

by-laws prohibit any appointees~succeeding themselves on the board.
Open Public Hearing on Zone Case No. 278, request of J. A. Braden
to rezone 2.71 acres out of Northeast 1/4 of Section No. 28, Block JK-2,
Hale County, Texas, being located at 3601 Olton Road, from a R-1 Zone to
a C-2 Zone. After discussiqn, t~he Public Hearing~was closed.- It was
moved-by Alderman Garmison, second by Alderman Browning, to deny the Zone
Case change. Motion carried unanimously.
Open Public Hearing on Zone Case No. 279, request of Frank Baker to
rezone all of the W~st 1/2 of Lot 3 and all of the North 94.08 feet of
Lots 5 & 6, Block 3, Alabama~Addition, Hale County, Texas, being located
in 2900 Block of Joliet to be used for Multi-family use, from a R-1 Zone
to a R-3 Zone. After discussion, Public Hearing was closed. It was
moved by Alderman Almon, second by Alderman Williams, to adopt Ordinance
No. 75-1905, amending the Zoning Map of the City of Plainview. Motion
carried unanimously.
Open Public Hearing on Zone Case No. 274, request of R. Q. Silver-
thorne to rezone Lots I thru 26, Block 1, Lots i thru 11, Block 2, and
Lots 16 thru 26, Block 2, all in Howell Addition, Plainview, Hale County,
Texas, being located in the 1400 to 1600 Block of Yonkers Street, from
a R-3 Zone to a Specific Use. After discussion, Public Hearing was closed.
It was moved by Alderman Williams, second by Alderman Carpenter, to deny
the Zone Case change due to the traffic problems it would create and due
to the streets not being adaquate for all the traffic. Motion carried
unanimously.

A Public Hearing on 1975 Community Development Act for funding for
1976 will be held at ~he regular City Council meeting, January 13, 1976,
at 7:30 p.m..
It was moved by Alderman Carpenter, second by Alderman Garrison, to
authorize the advertising for bids to be received in approval of traffic
sign poles. Motion carried unanimously.
It was moved by Alderman Garrison, second by Alderman Browning, to
authorize the advertising for bids to be received in approval of water
womks materials for Community Development Grant. Motion carried unanimous-
It was moved by Alderman Browning, second by Alderman Carpenter, to
authorize the advertising for bids to be received in approval of aerial
spray contract for Vector~ Control for 1976 and options. Motion carried
unanimously~
It was moved by Alderman Carpenter, second by Alderman Williams, to
approve the minutes of the regular City Council meeting held on December
10, 1975. Motion carried unanimously.
Received for filing, copies of the minutes of the Planning & Zoning
Commission meetings held on November 20th & 25th, Unger Memorial Library
Advisory Board-~meeting held on December 1st, Community/Neighborhood Im-
provement Committees meeting held on December 9th, Plainview/Hale County
Airport Board meeting held on December 3rd and Housing Authority meeting
held on December 16th.

in the rates charged for the sale of natural gas services will continue.
No action was taken.
No action was taken at this time on an industrial park at the Plain-
view/Hale County Airport. Will continue the study.
No action was taken at this time for an industrial park as recommended
by the Plainview Industrial Foundation for the Gebo Company warehouse.
The study regulating the use, installation and standards for burgl&r
alarms and fire alarms systems in Plainview will continue. No action was
taken.
It was moved by Alderman Garrison, second by Alderman Almon, to author-
ize the City Engineer to complete the "City of P!ainview Industrial Waste
Ordinance" and to submit it to the Texas Water Quality Board for approval.
Motion carried unanimously.
It was moved by Alderman Browning, second by Alderman Garrison, to
introduce/Ordinance No. 75-1906, an ordinance amending Ordinance No~ 65-900
as amended by subsequent amendments; repealing Ordinance No. 65-904 which
limited the parking time of vehicles on the North side of Sixteenth Street
between Quincy Street and Smythe Street in the City of Plainview, Texas.
Motion carried unanimously.
It was moved by Alderman Carpenter, second by Alderman Williams, to
introdune~Ordinance No. 75-1907, an ordinance repealing Ordinance No. 70-1081
which Said ordinance provided for two hour parking on that portion of 14th
Street lying between Smythe Street and Travis Street in the City of Pi&inview,
Texas. Motion carried unanimously.

It was moved by Alderman Garrison, second by Alderman Browning, to
introduce Ordinance No. 75-1908, an ordinance repealing Ordinance No.
69-1035 which said ordinance provided for two hour parking on that por-
tion of Fifteenth Street between Portland Street and Quincy Street in
the City of Plainview, Texas. Motion carried unanimously.
It was moved by Alderman Williams, secQnd by Alderman Garrison, to
introduce Ordinance No. 75-1909, an ordinance repealing Ordinance NO~
74-1626 which said ordinance provided for two hour parking on the West
side of that portion of Smythe Street lying between West 13th Street and
West 16th Street in the City of Plainview, Texas. Motion carried unan-
imously.
A Zoning Ordinance, an ordinance by the provisions of Article 1011a
revised Civil Statutes of Texas establishing zoning regulations and dis-
tricts in accordance with a comprehensive plan and within such districts
regulating the use of land, building and structures; etc., is s~ill under
study~ No action was taken at this time.
An ordinance prescribing rules and regulations governing plats, plans
and sub-divisions of land within the incorporated area of Plainview, Texas,
her$in defined as the "City"; etc., is still under study. No action was
taken at this time.
It was moved by Alderman Williams, second by Alderman Carpenter, to
adopt~Appropriation Ordinance No. 75-1901 from Revenue Sharing Account 427-
680 in the amount of $350.00 payable to W. F. Moore for cleaning and re-
moving debris: Project #130, 207 Austin, Lot 8, Block 36, Original Town.
Motion carried unanimously.

It was moved by Alderman Williams, second by Alderman Almon, to
adopt Appropriation Ordinance No. 75-1902 from Revenue Sharing Account
427-680 in the amount of $350.00 payable to W. F. Moore f6r cleaning
and removing debris: Project ~ 278, 820 Ash, Lot 3, Block 23, Original
Town. Motion carried unanimously.
It was moved by Alderman Browning, second by Alderman Carpenter, to
adopt Appropriation Ordinance No. 75-1903 from Unappropriated Surplus
Account 611-666 in the amount of $11,835.00 payable to Plainview/Hale
County Airport Fund for Parkhill, Smith & Cooper professional services
on Airport Master Plan. Motion carried unanimously.
It was moved by Alderman Williams, second by Alderman Carpenter, to
adopt Appropriation Ordinance No. 75-1904 from General Fund Unappropriated
Surplus Account 611-666 in the amount of $1,230~00 payable to Plainview/
Hale County Airport Fund for 1/2 cost of seal coat cost to runway 13-31
at Airport. Motion carried unanimously.
It was moved by Alderman Garrison, second by Alderman Williams, to
adopt Resolution No. R75-059, a resolution authorizing the application
for grant funds for use on the park improvements at Curry Lak~. Motion

The Mayor read a graph, prepared by Glen BiCkel, in which he indicates
the Street lighting revenue to the Southwestern Public Service Company and
on the same graph, the gross receipts tax the Company pays to the City of
Plainview. It shows at the end of the year for 1975, estimates show that
the receipts would be some $5,000 to $6,000 above what the Street lighting
coats are in 1976, which it narrows to about $1,000 difference. Then in

1977, it widens again to a~out $11,000. The Mayor also read some infor-
mation that he had requested from Mr. Glen Bickel on the Amarillo Ordinance
No. 4444. Keltz Garrison made a motion for the City Manager to check into
this ordinance. The Mayor is to negotiate with S~uthwestern Public Service
Company on the bases of our big objection, the polls that are now in ser-
vice, keeping them on the old contract if possible~ The study is to con-
tinue.
Received for filing, Mayor Stoneham's statement to the Water Quality
Board Hearing held on December 16, 1975.
Received for filing, Pioneer Natural Gas Fuel Cost Adjustment for the
month of November 1975.
It was moved by Alderman Browning, second by Alderman Almon, to refuse
or deny the Community Action Program Grant Application and the City of
Plainview's participation. Motion carried three (3) for and two (2) against.
It was recommended by the City Manager to hold the annual audit on the
Canadian River Municipal Water Authority until our questions are answered.
It was moved by Alderman Carpenter, second by Alderman Williams, to
authorize the City Tax Department to appraise the metal clad community cen-
ter located on Frisco Park. Motion carried unanimously.
It was moved by Alderman Browning, second by Alderman Carpenter, to
commend each employee, department head or supervisor, and the City Manager
on a job well done as to the summary submitted of unused sick leave. Motion
carried unanimously.
It was moved by Alderman Williams, second by Alderman Garrison, to
approve the request of Mr. Ernest Rector and Ollie Fuller, for continuation

of employment beyond their 65th birthday. Motion carried unanimously.
It was moved by Alderman Bro~ing, second by Alderman Williams, to
authorize the Mayor to enter into contract with the Texas Department of
Community Affairs, Division of Governor's Office and to extend the con-
tract to Parkhill, Smith & Cooper for the completion of the 701 Plan.
Motion carried unanimously.
The Improvement Committee and Community Improvement Committee is .
still in the development and they are providing input. They held a hear-
ing on the Community Development Grant Phase 2. They will meet'.again
prior to the next City Council meeting and review some information sub-
mitted on the Community Development Grant.
Section 8 Housing Application is still in the process of being de-
veloped ~hrough H.U.D. in Dallas.
Economic Devel6pment District, the votes should have'been in to com-
plete this. There have been 9 replies and the dead line is December 31st.
Water Reclamation Plant Application was submitted in October, 1975.
This-is what we are asking them to review with regards to the requirements
by the Texas Water Quality Board.
State Highway 194 improvement and widening project is preceeding and
they are shooting for a February bid letting, which was scheduled for a
March bid letting.
Codification of Ordinances - waiting for the submissio~ to the City

Canadian River Municipal Water Authority - City Manager talked to John
~Williams and the City's intentions are to begin utilizing our credit towards

payments of our fixed expenses and ask that he forward us a statement each
month showing us a balance of credit which we have so we could take Council
action on the monthly bases. He advised there would be requirements of ad-
ditional funds with regards to our law suit because an accountant would need
to be employed to analyze the method of accounting to be presented to the
Court for their final decision and interpretation.
On our next status reports, the Flood I~surance Map will be included.

the holfday schedule. Motion carried unanimously~

adjourn the meeting. Motion carried unanimously. Meeting over at 10:20
