CITY COUNCIL MINUTES City Council Chambers 901 Broadway Plainview, Texas The City Council of the City of Plainview met in regular session at 7:30 P. M. in the City Council Chambers of the City Hall with Medlin Carpenter presiding and the following Councilmen present: Jeane Browning-Place One; Lloyd Woods-Place Three; Tom Almon-Place Four; and A. William SoRelle~Place Five. Also present were the following City Staff: Marshall Pharr-City Manager, Randy Holly-Administrative Assistant, Tom Hamilton-City Attorney, M. L. Rea-City Clerk, Walter S. Dodson-Tax Assessor/Collector, Bill Hogge-Director of Public Works, Harold Gladman-Director of Planning, Bob Richards-Building Inspector, Norman Huggins-Director of Finance, Woody Sevison-Director of Fire Services, Alan Stewart-Director of Police Services and Debbie Hall-Administrative Secretary. Also present were the following visitors: Jim Davis-Plainview Reporter News, Gary Mack-KVOP Radio, Doug McDonough-Plainview Daily Herald, Mr. & Mrs. Lucian Morehead, Mr. & Mrs. Dalton Thompson, Bob Landry, John Andrews, Angus Ott, David M~lstead, Mario Trevino, Dale Mouser, Mr. & Mrs. A1 Morgan., Rick Van Hersh, Bill Smith, Lee Moberley and Claude Hutcherson.and Mr. Mike Howell. Invocation was given by Medli~ Carpenter. The following persons were present to receive their Certificate of Appointment: Carl Brust - Board of City Development Lee Moberley - Board of Equalization Angus Ott - Board of Equalization Dale Mouser - Building Code and Fire Code Board of Appeals A1 Morgan - Community Improvement Committee Mike Howell -Planning Board & Zoning Commission Dalton Thompson Planning Board & Zoning Commission David Milstead - Plumbing Appeals & Advisory Board It was moved by Alderman Browning, seconded by Alderman Almon, to award the bid for the furnishing of approximately 300 sets of work uniforms for approximately 60 employees of the City of Plainview, Texas to Dickie's in the amount of $14.00 per set or a total of $4,200.00. Motion carried unanimously. O0 0'n January 9, 1979 CITY COUNCIL MINUTES Page 2 It was moved by Alderman Almon, seconded by Alderman Woods, to open the Public Hearing to discuss the proposed rate increase request by Pioneer Natural Gas Company's West Texas System. Motion carried unanimously. Tom Almon, the City of Plainview representative on the Steering Committee studying the Pioneer Natural Gas Company's proposed rate increase, had no detailed information concerning the committee's actions. Marshall Pharr-City Manager read the minutes of the Steering Committee dated December 19, 1978. The committee made a motion to pursue and review the data that Pioneer Natural Gas Company submittee and report back to the Committee. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Resolution No. R79-114, a resolution of the City of Plainview, Texas, suspending the proposed rate schedules filed by Pioneer Natural Gas Company for an additional period of thirty (30) days beyond the One Hundred Twenty (120) days as set forth in Resolution No. R78-108~ the date on which such schedule would otherwise go into effect. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to recess the public hearing. No visitors were present to speak. Motion carried unanimously. Bob Richards gave an explanation to the City Council concerning Zone Case No. 407. There was only one letter of reply. It was moved by Alderman SoRelle, seconded by Alderman Almon, to approve Zone Case No. 407, the request of William D. Smith to rezone Lot 2, Block 27, College Hill Addition to the City of Plainview, Hale County, Texas, from R-2 to CNS Zoning for Real Estate Office, located at 1702 West 7th Street. Motion carried unanimously. The reasons for approval are as follows: (1) Requested land use is compatible with existing land uses in the area, and (2) Request land use would be an incentive for the improvement and orderly development of the neighborhood. It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Ordinance O0 003 January 9, 1979 Page 3 CITY COUNCIL MINUTES No. 79-2298, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 407'. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve Zone Case No. 410, the request of Jerry Hodges to rezone a tract of land out of the Northeast part of the Northwest 1/4 of Section 29, Block JK-2, containing approximately 1.375 acres more or less to the City of Plainview, Texas, from R-1 to Specific Use Zoning for Supper Club, located at 300 South 1-27. Motion carried unanimously. Reasons for approval are as follows (1) Request conforms to intent and land use regulations for a Specific Use Permit. (2) Request would not adversley affect property values or living conditions in the area. It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Ordinance No. 79-2299, an ordinance amending the zoning map of the City of Plainview for Zone Case No. 410. Motion carried unanimously. Appearing on behalf of Zone Case No. 409 were Byron Bennett, Rick Van Hersh, L. J. Green and Bobby James. Appearing against this zone request were Mrs. Claude Hutcherson, Mario Trevino behalf of the St. Alice Catholic Church, John Andrews, and Lucian Morehead. After a lengthly discussion, it was moved by Alderman SoRelle, seconded by Alderman Woods, to uphold the City of Plainview Planning Board & Zoning Commission's decision to deny the request of Mr. Byron Bennett to rezone Lots 5 and 6, Block 24, Highland Addition to City of Plainview, Hale County, Texas, from R-2 to M-F-1 Zoning for Multi-Family Dwelling, located 800 West llth Street. (Zone Case 409) Motion carried unanimously. Reasons for denial are as follows: (1) Requested land use would create excessive traffic congestion in the neighborhood. (2) Requested land would alter the population density of the neighborhood and thereby adversely affect living conditions in the area. Motion carried three for and one against (Almon). It was moved by Alderman Almon, seconded by Alderman Woods, to approve the minutes of the regular City Council meeting held December 12, 1978. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to approve the minutes of the special City Council Work Session held January 4, 1979. Motion carried unanimously. After a brief discussion, it was moved by Alderman Woods, seconded by Alderman Almon, to request that the City Attorney study the litter ordinance obtained from the City of Dallas and determine whether or not it would be easily enforced. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 79-2301 from General Fund-Account in the amount of $250.00 payable]to General Fund Account 612-308 for storage of gravel. Motion carried unanimously. It was moved by Alderman BrQwning, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 79-2302 from Pro-rata Construction Fund No. 434 in the amount of $9,490.27 payable to Irrigation, Inc. for Construction Estimate No. 3 for Sanitary Sewer and Water Distribution Extensions (Project No. WS-78-O1.) Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Woods, to adopt Appropriation Ordinance No. CD3-D96 from Community Development Fund Account 429-832 in the amount of $6,963.49 payable to High Plains Pavers, Inc. for Construction Estimate No. 9, 1977 Assessment Project, Contract dated 11-22-77. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to adopt Appropriation No.. 79-2303 from General Fund Account 611 in the amount of $2,833.95 payable to O© 003' January 9, 1979 Page 5 CITY COUNCIL MINUTES General Fund Account 503 for City's Share of Southwestern Public Service Rate Case Study. Motion carried unanimously. It was moved by Alderman, seconded by Alderman Woods, to confirm the names and terms of members on all the AuthOrities, Boards, Commissions, and Committees of the City of Plainview. Motion carried unanimously. Discussed request for back door sanitation pickup service. No action was taken. It was moved by. Alderman Woods, seconded by Alderman Browning, to table the request of Mr. Harry Igo for an alley use permit to install a water pipeline to interconnect Lots 11 & 12 with Lots 8, 9 & 10, Block 4, Highland Addition, for further study. Motion carried three for and 1 against (SoRelle). It was moved by Alderman Browning, seconded by Alderman Almon, to authorize the Mayor to sign weed assessments for month of December, 1978, in the amount of $90.00 as filed under Ordinance No. 66-939. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman Browning, to approve the request of Mr. Richard E. Whitfill for pavement of alleys on the east and south side of Lots 1 & 2, Groff Addition, subject to the City Engineer's specifications. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Almon, to go into Executive Session to discuss Appraisals of Parcels 15, 7, 18, 19 and 20 of the right-of-way acquisition on U. S. Highway 70. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropria- tion Ordinance No. CD3-097 from Community Development Fund Account 429 in the amount of $17,367.39 payable to City of Plainview General Fund for reimbursement for Housing Department 651 Expense and reimbursement for Community Development Coordinator Expense.
