O0 City Counci 1 i~hambers 901 Broadway Pla-inview, Texas O6O CITY COUNCIL MINUTES The City Council of the City of Plainview met in regular session at 7:30 P. M. in the City Council Chamber of the City Hall with Mayor Bob Wayland presiding and the following Councilmen present: Jeane Browning-Place One, Medlin Carpenter-Place Two, Lloyd Woods-Place Three, Tom Almon-Place Four and A. William SoRelle-Place Five. Also present were the following City Staff: John Hatchel-City Manager, Randy Holly-Administrative Assistant, Larry McEachern-City Attorney, Walter S. Dodson-Tax Assessor/Collector-City Clerk, Norman Huggins-Director of Finance, Johnnie Ballew- Director of Safety and Environment, Bill Hogge-Director of Public Works, Alan Stewart- Director of Police Serivces, Joe Ferguson-Director of Fire Services, Harold Gladman- Director of Planning, Charles Couch-Service Center Supervisor, Dick Cross-Municipal Court Judge and Elaine Corn-Deputy Tax Assessor/Collector-City Clerk. It was moved by Alderman Woods, seconded by Alderman Almon~ to approve the minutes of the regular City Council meeting held June 14, 1979. Motion carried unanimously. Public Hearing on the request of W. E. Medlock was opened. Mr. Medlock appeared to discuss the proposed use of the property. After some discussion, it was moved by Alderman Carpenter, seconded by Alderman Almon, to approve Ordinance No. 79-23~8, an ordinance reclassifying from R-1 (Single family residential) to MF-2 (Mulitple family) being located in the 2800 Block between Fresno~and Houston. Request of W. EJ Medlock (Zone Case No. 418). Motion carried unanimously. Public Hearing was closed. Public Hearing on the request of Tim Johnson was opened. Mr. Johnson presented a letter, read by Gene Glaeser, to withdraw the request. The following people spoke against the request: J. W. Hamby, Danny Laws, Glen Lester, Andy Riley and Charles Massie. After discussion, it was moved by Alderman SoRelle, seconded by Alderman Browning, to accept the withdrawal of the request reclassifying from CRD (Commercial Retail District) specific use being located at 330101ton Road. (Zone Case No. 419). Motion carried unanimously. Public Hearing was closed. Public Hearing on the request of Bill Cartwright was opened. Mr. Cartwright appeared to explain the plans of the use of the property. Mrs. Hershal Carthel spoke in opposition to the request. The legal aspects of the application were discussed by Larry McEachern who suggested that the procedure was not done correctly and requested that reapplication be made. After discussion, it was moved by Alderman Woods, seconded by Alderman Almon, to table Ordinance No. 79-2330, an ordinance re- classifying from ~C-1 (Commercial) to L-1 (Light Industrial) being located at 2401 Quincy Street. Request of Bill Cartwright. (Zone Case No. 420). Motion carried unanimously. Public Hearing was closed. After discussion, it was moved by Alderman Almon, seconde~ by Alderman SoRelle, to adopt Ordinance No. 79-2327, an ordinance prohibiting the inhalation of certain materials and providing a penalty. Motion carried unanimously. It was moved by Alderman SoRelle, No. R79-128, a resolution authorizing a improvements in the amount of $1,466.37, around Hutcherson fuel island. It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Resolution No. R79-129,'a resolution authorizing the City of Plainview to participate in continuing the appeal of Southwestern Public Servi¢e rate case in District Court and authorizing contribution of Pro Rata share of the cost incurred at the rate of 16¢ per meter. Motion carried unanimously. It was moved by Alderman Carpenter, seconded by Alderman Woods, to adoPt Resolution No. R79-130, a resolution authorizing the City to accept an Environmental Protection Agency grant fOr Step I Project. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. 79-2331, an ordinance appropriating from Unappropriated Funds Account payable to Unappropriated Funds 614-301/in the amount of $7,308.70 as insurance payment for repair of'roof damage for City Hall~l Police Station and Library Buildings. Motion carried unanimously. O0 053 June 26, 1979 Page 4' CITY COUNCIL MINUTES It was moved by Alderman SoRelle, seconded by Alderman Woods, to adopt Appropriation Ordinance No. GO 417-79, an ordinance appropriating from G.O. Park Bond Fund payable to Account 640-418 in the amount of $174.50 for repair of Sewer Line of Girl Scout Hall damaged at time of sprinkler installation. Motion carried unanimously. It was moved by Alderman Woods, seconded by Alderman Browning, to adopt Appropriation Ordinance No. 79-2332, an ordinance appropriating from Unappropriated Funds payable to Unappropriated Funds Account 640-418 in the amount of $1,225.86 for rePlacement of light bulbs and repair of lights from vandalism damage in Broadway Park. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 79-2333, an ordinance appropriating from Pro Rata Escrow 0-21201-13 payable to B.A.V. Developers, Inc. in the amount of $717.50. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance No. 79-2334, an ordinance appropriating from Pro Rata Escrow 0-21201-11 payable to J. J. Kirchhoff in the amount of $1,741.25. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, 'to adopt Appropriation Ordinance No. 79-2335, an ordinance appropriating Revenue Sharing Account 27-060613 payable to General Fund Account 18-613-60803 in the amount of $2,844.00 for three new radios for the new Sanitation Trucks. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation Ordinance Not 79-2336, an ordinance appropriating Revenue Sharing Funds 27-0-60615 payable to Service Center Fund 25-060803 in the amount of $268.00. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 79-2337, an ordinance appropriating Pro Rata Escrow D-21201-9 payable to Cannon Brothers and Malone in the amount of $884.98. Motion carried unanimously. It was moved by Alderman Almon, seconded by Alderman SoRelle, to adopt Appropriation O0 0-54, June 26, 1979 Page 5 CITY COUNCIL MINUTES Ordinance No. CD2-110, an ordinance appropriating Community Development Fund payable to Kip Pritchard in the amount of .$225.00 rehabilitation payment of 80% of work on Case 78-12-27. Motion carried unanimously. It was moved by Alderman Browning, seconded by Alderman Almon, to adopt Appropriation Ordinance No. 79-2338, an ordinance appropriating Non Departmental Fund 603-60527 payable to SPS Steering Committee in the amount of $566.79 for additional charge for SPS Rate Case to cover total costs incurred throuth 6-11-79. Motion carried unanimously. It was moved by Alderman SoRelle, seconded by Alderman Browning, to approve Budgeted expenditures ending June 20th in the amo,unt of $83,820.48 and ending June 26th in the amount of $31,969.33. Motion carried unanimously. It was-moved by Alderman SoRelle, seconded by Alderman Almon, to accept recommendations and appointments to various boards, commissions and committees for the City of Plainview which are as follows: (Resolution No. R79-132) CANADIAN RIVER MUNICIPAL WATER AUTHORITY R. O0 June 26, 1979 Page 6 CITY COUNCIL MINUTES It was moved by Alderman SoRelle, seconded by Alderman Woods, to accept Resolution No. R79-131, a resolution accepting substitution of securities pledged by City National Bank as depository of City of Plainview Funds. Withdrawal of $500,000 with substitution of same amount. Motion carried unanimously. The Council recognized Joe Ferguson as the new Fire Chief.
