HomeMy WebLinkAbout01 0208 min182 The Plainview City Council met on February 13, 2001, at 7:00 p.m. in the Council Chambers of Plainview City Hall, 901 Broadway. The Council met in pre-session at 6:30 p.m. The agenda for this meeting was posted at City Hall at 4:00 p.m. on February 3, 2001, with an addendum to that agenda posted at 5:30 p.m. on February 8, 2001. Mayor Lloyd C. Woods presided. Councilmembers present were: Sam Parker-District 1; Rey Rosas-District 3; Ross Owen-District 5; Buddy McGehee-District 6; and Irene Favila-District 7. Councilmembers absent were: Mary Jane Shanes-District 2 and Mike Hutcherson-District 4. Staff members present were: James P. Jeffers-City Manager; John Berry-Director of Public Works; John Castro-Director of Community Development; Wally Hatch-City Attorney; Will Mull- Police Chief; Gary Glass-Fire Chief; and Dale Simpson-Director of Civil Service. News media representatives present were: Richard Orr-Plainview Daily Herald. Guests present were: Rocky Favila, Irma Rosas, Vicki Flores, Ralph Langley, Jenice Langley, Pete Rodriguez, and Larry WOolsey-Wayland Baptist University. Councilmember Parker delivered the invocation. The Girl Scouts led in the Pledge of Allegiance. Councilmember Favila read a proclamation celebrating the League of United Latin American Citizens' 72na anniversary. Councilmember McGehee moved that the Consent Calendar be approved as presented. The motion, duly seconded by Councilmember Favila, carried by unanimous vote. Items approved on the Consent Calendar included: Approval of the Minutes of January 23, 2001, and February 8, 2001; receipt of departmental reports; approval of expenditures; granting of excused absences for this meeting for Councilmembers Shanes and Hutcherson; appointments of Freddy N. Willis, Max Browning (alternate), and Jennifer Wright to the Board of Adjustment; appointments of Vicki Flores, Gary A. Petras, and Mignon Williams to the Board of Minimum ltousing; appointments of Paul Drager and Bill Rollins (alternate) to the Planning & Zoning Commission; approval upon second reading of Ordinance No. 01-3277, an Ordinance amending Ordinance No. 00-3267 to appropriate funds in the 2000 2001 budget for the purchase of computer hardware and software; cumulativeness clause; severability clause; conflicts clause; and effective date; and approval upon first reading of Ordinance No. 01-3278, an Ordinance amending the City of Plainview Code of Ordinances, Chapter 11, Fire Protection and Prevention; cumulativeness clause; conflicts clause; severability clause; and effective date John Castro introduced for first reading Ordinance No. 01-3282, an Ordinance amending the zoning map of the City of Plainview, Texas, to rezone from single family residential (R-l) Lots 1-6 of Block 59, Lots 1-12 of Block 60, Lots 1-8 of Block 62, Lots 7-14 of Block 47, Lots 7-14 of Block 35 fi.om multi-family (MF-2); Lots 1-6 of Block 61; and fi.om duplex/patio home (2F) Lots 9-10 of Block 35 to University (U), said parcels being located in the College Hill Subdivision, Plainview, Texas; cumulativeness clause; conflicts clause; severability clause; and effective date (Wayland Baptist University). There was no public comment. Mayor Lloyd C. Woods moved to approve upon first reading Ordinance No. 01-3282. The motion, duly seconded by Councilmember Rosas, carried by unanimous vote. Mr. Castro introduced for first reading Ordinance No. 01-3283, an Ordinance amending the zoning map of the City of Plainview, Texas, for closing of the alley located between Lot 14 and Lots 1, 2, City of Plainview City Council Minutes February 13, 2001 Page I of 2 and 3 of Block 47, College Hill Addition to the Town of Plainview, Hale County, Texas (alley between Smythe & Travis Streets); cumulativeness clause; conflict clause; severability clause; and effective date. There was no public comment. Councilmember Owen moved to approve upon first reading Ordinance No. 01-3283. The motion, duly seconded by Councilmember Rosas, carried by unanimous vote. Mr. Castro introduced for first reading Ordinance No. 01-3279, an Ordinance amending the zoning map of the City of Plainview, Texas, for rezoning of a 2.74 acre tract out of AB 1688, Block D-6, Sec 16 out of SW/C of RR (1801 East 5t~' Street) from agricultural (A) to commercial general business (C-3) zoning district; cumulativeness clause; conflict clause; severability clause; and effective date. There was no public comment Councilmember Owen moved to approve upon first reading Ordinance No. 01-3279. The motion, duly seconded by Councilmember McGehee, carried by unanimous vote. Mr. Castro introduced for first reading Ordinance No. 01-3280, an Ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to a flea market in a commercial general business (C-3) district, said parcel of land being 1801 East 5th Street; cumulativeness clause; conflicts clause; severability clause; and effective date. Pete Rodriguez expressed concern with the requirement that there be 81 parking lots. He believed that he would need a maximum of only 15 to 20 parking places. Mr. Rodriguez noted that he would not use the building which he is considering turning into a flea market for parties, dances, or other events. The flea market will be open on Fridays, Saturdays, and Sundays, mostly in the summer months. Mr. Rodriguez requested one (1) year to install the parking lot. Ralph Langley suggested that Mr. Rodriguez consider using fly ash. Councilmember McGehee moved to approve upon first reading Ordinance No. 01-3280. Councilmember Owen duly seconded the motion. Those voting in favor of the motion were: Councilmembers Parker, Owen, McGehee, Favila, and Mayor Woods. Councilmember Rosas voted against the motion. The motion carried. Mr. Castro introduced for first reading Ordinance No. 01-3281, an Ordinance amending the zoning map of the City of Plainview, Texas, for rezoning of Lot 1, South half of Lot 2, Block 1, Highland Addition (1001 North Columbia) from retail (C-2) zoning district to commercial general (C-3) zoning district; cumulativeness clause; conflict clause; severability clause; and effective date. Ralph Langley, who intends to install a car lot at this site, answered several questions regarding the development of the property. Councilmember Rosas moved to approve upon first reading Ordinance No. 01-3281. The motion, duly seconded by Councilmember Owen, carried by unanimous vote. Doris Washington provided a report on Black History Month. The closed session to discuss the Texas Department of Criminal Justice economic development project was not conducted since the item was discussed in the pre-session. Councilmember Owen moved that the meeting be adjourned. The motion, duly seconded by Councilmember Rosas, carried by unanimous vote.
