Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was
posted in City Hall at 4:50 p.m. on February 19, 2016. Mayor Wendell Dunlap presided.
Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2,
Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, Lionel
Garcia -District 6 and Eric Hastey-District 7.
Staff members present were: Jeffrey Snyder -City Manager, Leslie Spear Schmidt -City
Attorney, Andrew Freeman -Assistant City Manager, Ken Coughlin -Police Chief, Dennis
Harkins -Police Captain, Tim Crosswhite-Interim Director of Public Works, Sarianne
Beversdorf-Director of Finance, lsauro Gutierrez -Information Technology Specialist and
Belinda Hinojosa-City Secretary.

Councilmember Lionel Garcia delivered the invocation and led in the pledge of allegiance.
Mayor Pro Tem King moved to approve the consent calendar. The motion was duly
seconded by Councilmember Juarez and carried by unanimous vote. Items approved on
the consent calendar included approval of the minutes of February 4, 2016 and February
9, 2016; and approval of the financial reports.
Ken Coughlin, Police Chief presented the Racial Profiling Report for 2015. He stated
there were no racial profiling complaints.
Tim Crosswhite, Interim Director of Public Works presented a report on the 2016 Park
Improvements.
Leslie Spear Schmidt, City Attorney presented for consideration Resolution R16-355, a
Resolution of the City Council of the City of Plainview, Texas, Authorizing the Prohibition
of Open Carrying Handguns Into Meeting Rooms During Certain Open Meetings and
Providing for an Effective Date. The legislature passed HB 910 which allows individuals
to open carry a handgun in a belt or shoulder holster. The City Council makes policy.
The Resolution authorizes the City Manager in accordance with State law to post signs
at the entrance to any meeting room for which an open meeting of a governmental entity
subject to Texas Government Code at Chapter 551 is being held.
Such signs posted shall give notice that any person licensed under Texas Government
Code at Chapter 411, Subchapter H, is prohibited from openly carrying a handgun into
the meeting room(s) while the meeting is being held. The signs will be printed in English
and Spanish and will read as follows:
"Pursuant to Section 30.07, Penal Code (trespass by license holder
with an openly carried handgun), a person licensed under
Subchapter H, Chapter 411, Government Code (handgun licensing
law), may not enter this property with a handgun that is carried
openly."

The possession of any firearm in any meeting room posted as stated above can subject
any person, including a person who holds a license to carry a handgun, to prosecution of
a misdemeanor offense pursuant to Texas Penal Code Ann., Section 30.07 (Vemon's
Supp. 2015).
Staff recommends passing this resolution.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Starnes moved to approve Resolution R16-355. The motion was duly
seconded by Councilmember Williams. Mayor Dunlap, Councilmembers Starnes,
Williams, Juarez, King, Blackerby and Garcia voted "for" the motion. Councilmember
Hastey voted "against" the motion. The motion carried by unanimous vote.
There being no further business, Mayor Dunlap adjourned the meeting at 8:26 p.m.
