HomeMy WebLinkAbout01-26-2016 Council MinutesThe Plainview City Council met on January 26, 2016 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:00 p.m. on January 22, 2016. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Norma Juarez -District 3, Susan Blackerby-District 5, and Eric Hastey-District 7. Mayor Pro Tem Teressa King -District 4 and Councilmember Lionel Garcia -District 6 were absent. Staff members present were: Jeffrey Snyder -City Manager, Leslie Spear Schmidt -City Attorney, Andrew Freeman -Assistant City Manager, Rusty Powers -Fire Chief, Derrick McPherson -Police Captain, Tim Crosswhite-Interim Director of Public Works, Sarianne Beversdorf-Director of Finance, lsauro Gutierrez -Information Technology Specialist and Belinda Hinojosa-City Secretary. News Media Present: Homer Marquez -Plainview Herald Guests Present: Hope Hastey Councilmember Norma Juarez delivered the invocation and led in the pledge of allegiance. Councilmember Starnes moved to approve the consent calendar. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Items approved on the consent calendar included the granting of excused absences to Councilmember Lionel Garcia and Mayor Pro Tem King, approval of minutes of January 7, 2016 and January 12, 2016; and approval of financial reports. Belinda Hinojosa, City Secretary presented for consideration Resolution R16-352, a Resolution of the City Council of the City Of Plainview, Texas, Calling and Setting the Date for the Regular Municipal Election; Designating the Election of a Mayor At -Large; Designating the Election of a Councilmember for Districts 5, 6, and 7 Respectively; Designating Districts and Polling Places for Mayor, Districts 5, 6, and 7; Designating Early Voting Dates and Setting Two Twelve Hour Days for Early Voting as Required by Section 85.005 (D) of the Texas Election Code; and Posting Notice of Election. This Resolution sets out the date for the election as May 7, 2016 and designates the election for Mayor, District 5, 6 and 7. It sets out the polling locations. Early voting will be held at City Hall April 25, 2016 through May 3, 2016. The two twelve hour early voting days will be Thursday, April 28, 2016 from 7:00 a.m. to 7:00 p.m. and Tuesday, May 3, 2016 from 7:00 a.m. to 7:00 p.m. Ms. Hinojosa added that the filing period for City Council has begun and will go through February 19, 2016. The write-in candidate filing period deadline is February 23, 2016 at 5:00 p.m. She also added that the deadline to register to vote for this election is April 7th Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Resolution R16-352. The motion was duly seconded by Councilmember Williams and carried by unanimous vote. Tim Crosswhite, Interim Director of Public Works presented for consideration the Agreement between the City of Plainview, Texas and Brandt Engineers Group Ltd for City Council Minutes January 26, 2016 Page 1 of 3 Professional Services. For seal coat this year, staff is asking to change to Brandt Engineering for three reasons: Council wanted staff to look at other firms; they start the bid process in January instead of April which will enable us to receive a better price; and Brandt Engineering takes a hand on approach with the work and is onsite at all times. The base bid is for 98,400 square yards at $2.40 a square yard for a total of $236,160 and the alternate bid is for 62,200 square yards at $2.40 a square yard for a total of $149,280. Staff is waiting on a certificate of interested parties document and this would be contingent upon receiving this. Staff is recommending approval to use Brandt Engineers for future seal coat needs. This is contingent upon Brandt Engineering signing certificate of interested parties. Councilmember Charles Starnes moved to authorize Mayor to sign between the City of Plainview, Texas and Brandt Engineers Group Ltd for Professional Services pending receipt of certificate of interested parties document. The motion was duly seconded by Councilmember Blackerby. Mayor Dunlap asked for public comment. There was no public comment. Mayor Dunlap asked for a vote on the matter. The motion carried by unanimous vote. Councilmember Williams moved to go into closed session for the following: 1) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. [Tex. Gov't. Code, Section 551.074]. City Manager Evaluation and Appointments to the following boards and commissions: Plainview Housing Authority, Building Trades/Fire Code Board of Appeals and Main Street Program/Tourism Coordinating Board; and 2) Closed Session — Sec. 551.071 — Consult with attorney on a matter in which the attorney's duty to the government body under the Texas Disciplinary Rules of Professional Conduct conflicts with the open meeting statutes and about pending or contemplated litigation or settlement of same relating to Police Department. The motion was duly seconded by Councilmember Hastey and carried by unanimous vote. Mayor Dunlap called the meeting back in open session at 8:07 p.m. Councilmember Starnes moved as follows: 1) appoint Henry Trevino as the Electric Provider to the Building Trades/Fire Code Board of Appeals with said term to expire on January 1, 2020; 2) reappoint Brandon Brownlee and Mario Landeros to the Plainview Hou g Authority Board with said terms to expire on January 1, 2018; 3) reappoint Nita Tovanche as the Resident Commissioner with said term to expire on January 1, 2018; City Council Minutes January 26, 2016 Page 2 of 3 8 The motion was duly seconded vote.
