HomeMy WebLinkAbout03-08-2016 Council Minutes16 The Plainview City Council met on March 8, 2016 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 5:00 p.m. on March 3, 2016. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Teressa King -District 4, and Eric Hastey-District 7. Councilmembers Norma Juarez - District 3, Susan Blackerby-District 5 and Lionel Garcia -District 6 were absent. Staff members present were: Jeffrey Snyder -City Manager, Leslie Spear Schmidt -City Attorney, Andrew Freeman -Assistant City Manager, Ken Coughlin -Police Chief, Tim Crosswhite-Interim Director of Public Works, Rusty Powers -Fire Chief, Sarianne Beversdorf-Director of Finance, Isauro Gutierrez -Information Technology Manager and Belinda Hinojosa-City Secretary. News Media Present: Homer Marquez -Plainview Herald Guests Present: Rebecca Hopkins Councilmember Lionel Garcia delivered the invocation and led in the pledge of allegiance. Councilmember Williams moved to approve the consent calendar. The motion was duly seconded by Councilmember Starnes and carried by unanimous vote. Items approved on the consent calendar included the granting of excused absences to Councilmembers Norma Juarez, Susan Blackerby and Lionel Garcia; and approval of the minutes of February 18, 2016 and February 23, 2016. Jeffrey Snyder, City Manager presented to consider Amendment to Reservation System Participant Agreement No. 2013-0070 with the Texas Department of Housing and Community Affairs HOME Investment Partnerships Program. In October 2012, the City approved an agreement to participate in the Homeowner Rehabilitation Assistance Program — Reservation System through the Texas Department of Housing and Community Affairs. The program has allowed the City to rehabilitate five single-family residences owned and occupied by low-income individuals. We received notice that we have received two more homes and were notified that there would be another release date on March 17th. It has been a successful program; one that we think we should continue. On December 7, 2015, the U.S. Department of Housing issued conforming amendments to Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards effective January 6, 2016, to incorporate the requirements of 2 CF Part 200. These requirements are applicable to all activities to which HOME funds are committed under this RSP Agreement on January 6, 2016 and thereafter. The most notable changes related to the conforming amendments include: • Replacement of terminology Data Universal Number System (DUNS Number) with Unique Entity Identifier Number (UEIN), and including the UEIN on the RSP Agreement City Council Minutes March 8, 2016 Page 1 of 3 • City of Plainview may elect to charge a de minimus rate of 10% of modified total direct costs as defined in 2 CFR §200.68 subject to the 4% administrative limitation of the HOME Program, provided that the expenses are eligible under the HOME Final Rule and that City of Plainview notifies the Department of the election to use the 10% modified total direct costs approach at the time of Household Commitment, costs are consistently charged as either indirect or direct costs, and costs are not double charged or inconsistently charged as both. • For Uniform Administrative Requirements, replacing references to 24 CFR Parts 84 and 85 with 2 CFR Part 200, except that Units of General Local Government must still follow Uniform Grant Management Standards, Chapter 783 of the Texas Government Code. The Department does not expect that these modifications will have a significant impact on how the HOME Program is administered for single family activities. Staff recommends approval of this amendment to continue participation in the TDHCA HOME Investment Partnership Program. Mayor Dunlap asked for public comment. Councilmember Starnes moved to approve signing the Amendment to Reservation System Participant Agreement No. 2013-0070 with the Texas Department of Housing and Community Affairs HOME Investment Partnerships Program. The motion was duly seconded by Councilmember Williams and carried by unanimous vote. Ken Coughlin, Police Chief presented for consideration on first reading, Ordinance No. 16-3632, an Ordinance of the City Council of the City of Plainview Continuing Chapter 8, Article 8.05, Juvenile Curfew of the Code of Ordinances of the City of Plainview, Texas Defining Terms; Providing Curfew Hours for Juveniles; Offenses and Defenses for Juveniles; Penalty for Violation of the Curfew Ordinance By Juveniles, Their Parents Or Guardians, And Owners, Operators And Employees Of Business Establishments Of A Fine Not To Exceed $500; Repealer; Severability Clause; Cumulativeness Clause; Conflicts Clause; Effective Date; And Providing For Publication And Enforcement Of Such Ordinance. The law is set up so that the curfew ordinance is brought back up every three years to see if it is still necessary. It has been an effective tool for the police department. For the past three years there has been a decline in crime. Staff is asking to continue to have this ordinance in effect. Mayor Dunlap asked for public comment. Mayor Pro Tem King moved to adopt Ordinance No. 16-3632 on first reading. The motion was duly seconded by Councilmember Starnes and carried by unanimous vote. Tim Crosswhite, Interim Director of Public Works presented for consideration to award bids for seal coat project. We went out for bids using Brandt Engineering. We had two companies submit bids. The lowest bidder was Lipham Asphalt. City Council Minutes March 8, 2016 Page 2 of 3 17 18 Brandt Engineering drove our streets to grade streets for need. They are recommending the city use coated rock. Funding is provided for in the 2015-2016 budget. Staff recommends to go with Alternate Bid #3 in the amount of $389,068. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to award Alternate Bid #3 in the amount of $389,068. The motion was duly seconded by Mayor Pro Tem King and carried by unanimous vote. Jeffrey Snyder, City Manager presented for consideration Resolution R16-356, A Resolution by the City of Plainview, Texas ("City") Suspending Southwestern Public Service Company's Proposed Effective Date in Connection With its Statement of Intent Submitted on about February 16, 2016; Authorizing the City to Join With Other Cities in the Alliance of Xcel Municipalities ("AXM") to Direct the Activities of Lawyers and Consultants; Authorizing the Hiring of Attorneys and Consultants; Requiring Reimbursement of Reasonable Legal and Consultant Expenses; Requiring Proof of Notice; Finding that the Meeting Complies with the Open Meetings Act; Making Other Findings and Provisions Related to the Subject; and Declaring an Effective Date. In February 2016, SPS filed their application to increase base rate by approximately $71.9 million in annual revenue effective March 22, 2016. The first step in this process is to come to Council to suspend the rate case at this point to allow our attorneys and consultants time to look at the numbers. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to adopt Resolution R16-356. The motion was duly seconded by Councilmember Hastey and carried by unanimous vote. Mr. Crosswhite presented for consideration the Agreement between the City of Plainview and Parkhill, Smith & Cooper, Inc. for Professional Services. City staff are asking to use Parkhill, Smith & Cooper for our Milwee Lift Station Project. This will replace the lift stations at Milwee and Juniper. The Milwee station is capable of handling both. This is part of our bond project. Staff is recommending using Parkhill, Smith & Cooper for the Milwee lift station project. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to approve Agreement between the City of Plainview and Parkhill, Smith & Cooper, Inc. for Professional Services. The motion was duly seconded by Councilmember Williams and carried by unanimous vote.
