CITY COUNCIL MEETING
City of Plainview
The Plainview City Council held a meeting at 7:30 p.m., Tuesday, April 12, 1994, in the Council Chambers
of the Plainview City Hall at 901 Broadway, with Mayor E. V. Ridlehuber presiding. Councilmembers
present were: Mary Virginia Kirchhoff - Precinct 2, Don Dickson - Precinct 3, Mike Hutcherson - Precinct
4, Barbara Dorman - Precinct 5, Dwain Dodson - Precinct 6, and Irene Favila - Precinct 7. Alton JackSon -
Councilmember Precinct 1 was absent. The Council met in Pre-Session at 7:00 p.m.
Staff members present were: James P. Jeffers - City Manager, Roy L. Osborne - Directory of Public
Safety, Terry Powers - Director of Human Resources, Wally Hatch - City Attorney, Muff London - Director
for Community Development, Norman Huggins Director of Finance, John Castro - Health Department
Director, John Berry -Assistant Director of Public Works, and Karen McBeth - City Secretary.
Guests present were: Lloyd Woods, Rey Rosas, Plainview High School Boys Basketball Team, Coaches,
Managers and Trainers, Pedro Garcia, Charles Pomykal, Detective Pat Serrano and representatives from
Student Crime Stoppers and Neighborhood Watch program.
OPEN MEETING
1. Invocation - Barbara Dorman. Immediately following the invocation Dibi Ray, of the Plainview High
School Basketball Team sang the National Anthema.
2. Recognitions - Charles Pomykal - Superintendent Water Reclamation, introduced Pedro Garcia -
Maintenance Worker and presented him with a Certificate of Appreciation for the thirteen years he worked
for the city until ill health forced his retirement recently. Mr. Garcia was also presented with a Ten Year
Pin and a gift certificate.
3. Recognition of the Plainview Bulldog Basketball Team - Plainview High School Bulldog
Basketball Team, 1994 4-A State Champions. Mayor Ridlehuber presented Certificates of Recognition to
the boys on the boys on the basketball team, the coaches, trainers and managers.
4. Anti-Crime Legislation - Resolution No. R94-108. A Resolution of the City of Plainview, Texas,
supporting anti-crime legislation for the purpose of stopping crime and violence in our cities and towns.
Detective Pat Serrano presented a group from the Student Crime Stoppers, of which there are 74
members. The students each read aloud parts of the Resolution. Det. Seranno reported that the
Neighborhood Watch program had produced 4 arrests, all dealing with property damage or graffiti. She
reported that rewards paid out by Hale County Crime Stoppers and Student Crime Stoppers have led to
six arrests through School Resource Officer Daryl Kissell. Councilmember Dwain Dodson moved to adopt
Resolution No. R94-108, supporting anti-crime legislation; Barbara Dorman seconded the motion; the
motion passed unanimously among the six councilmembers present.
5. Department of Public Safety Reconstruction Team - Consider the request of Terry D.
McEachern, District Attorney, for the use of an old ambulance in the western district of the State of Texas
for a reconstruction team. Assistant District Attorney Penny Robe spoke on behalf of District Attorney
McEachern, and asked for an old ambulance that the city would normally sell or trade in, which is to be
used in creating an Accident Reconstruction Team for West Texas. She explained that this unit and the
trained people who will use can reconstruct an accident so as to ascertain certain details of what happened.
Sgt. Miller of the Department of Public Safety will be the head of this team. Once the team is in place and

equipped, the unit will be funded by the Texas Department of Public Safety. Councilmember Barbara
Dorman made a motion the the City Manager be authorized to enter into an interlocal agreement allowing
the use of such an ambulance for the purpose of creating a West Texas Accident Reconstruction Team;
Irene Favila seconded the motion; the motion carned unanimously among the six councilmembers present.
6. Youth Activities Committee Consider a request for funding for summer activities.
Councilmember Irene Favila made a motion that this item be tabled until the next council meeting; Barbara
Dorman seconded the motion; the motion carriect unanimously.
7. Health Department Fees - Ordinance No. 94-2989. An Ordinance of the City of Plainview, Texas,
amending certain portions of Chapter 11, Food and Food Handlers, to allow for the increase in pemitting
fees; Severability clause; Cumulativeness clause; Conflicts clause; Effective date. John Castro, Health
Department Director, explained the need for increasing the fees charged for permits for food and food
handlers. He stated the fees presently charged did not cover the cost of inspecting and in some cases re-
inspecting food establishments. He also reported that raising the passing grade from 60 to 70 for food
establishments, this would cut down on the number of re-inspections which would be needed. He stated
he felt this ordinance and the changes outlined in it would raise the quality of the restaurants and food
service establishments in Plainview, Abernathy, and all the towns and cities in Hale County. Mr. Castro
stated that the fees in the ordinance were double those now charged. Councilmember Dwain Dodson
stated the he could not support this large an ~ncrease in the fees without further information.
Councilmember Don Dickson moved to table Ordinance No. 94-2989 and hold a public hearing on it; Dwain
Dodson seconded the motion; the motion carried unanImously by the six councilmembers present.
8. Community Survey - Results of survey. Councilmember Dwain dodson reporte(~ that Geoff Wells,
Professor at Wayland Baptist University, and his class at the University- conducted a telephone survey
during March, 1994, and the results of the report have been given to the Mayor and City Council. Dr. Wells
stated he believed there to be a 5% error factor in the survey. He reviewed the questions and answers
which were in regards to the performance of the Council in general.
9. Consent Calendar - Councilmember Barbara Dorman moved the Consent Calendar be approved;
Irene Favila seconded the motion; the motion passed unanimously with six councilmernbers present (Alton
Jackson was absent).

Bids - 1. Sanitation Department Motor Truck Cab and Chassis-Bids were received as
follows: Diamond Truck and Trailer for $38,885.00; White-GMC of Dallas for $39,303.00;
South Plains International for $39,775.43; Gene Messer Ford for $39,959.00; and Chaparral
White-GMC from Odessa for $50,850.00. The bid was awarded to South Plains
Intern ational for $39,775.43, as this was the bid which properly met the specifications and
was most advantageous to the city.
Trees - Award bids for trees per Resolution No. R93-107.
A Resolution of the City Council of the City of Plainview,
Texas, authorizing the City Manager to execute necessary
agreements related to grant request to the Texas Forest
Service for a Small Business Administration tree planting
grant for a project to be utilized at Kidsville in Running
Water Draw Regional Park in Plainview, Texas, and giving

necessary assurances regarding the local cost of said project.
Only one bid was received, it was from Robert's Tree House in the
amount of $9,984.00 for 40 trees. The bid was awarded to Robert's
Tree House.

Parks - TLI trash removal, Consider authorizing the Mayor to enter into an ag reement with
Tommy Lewis Industries for trash removal from city parks. The Mayor was so authorized.
Budget Amendment - Ordinance No. 94-2990. An Ordinance of the City Council of the
City of Plainview, Texas, amending the Parks Department (No. 40) Budget of the General
Fund of the 1992-1993 Budget. The ordinance was approved.

Housing - Emergency Shelter - Consider request of Caprock Community Action
Association in support of their Emergency Shelter Grant Program application for FY 1994.
Support for such was agreed to.
h)
Election Judge- Ordinance No. 94-2991. An Ordinance amending Section 5 of Ordinance
No. 94-2986 to change the election official for Precinct Four; Severability 'Clause;
Cumulativeness clause; Conflicts clause; Effective Date. Ordinance was passed.
Health Department - Immunization Contract Amendments - Consider authorizing the
Mayor to sign the amendments to TDH Contract #C4000140, Change 2, providing funding
for two additional personnel at the Health Department. The Mayor was authorized to
sign such.
10. Adjournment - Councilmember Dwain Dodson made a motion the meeting adjourn; seconded by
Irene Favila; the motion carried unanimously.
