Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was
posted in City Hall at 4:25 p.m. on June 10, 2016. Mayor Wendell Dunlap presided.
Councilmembers present were: Larry Williams -District 2, Norma Juarez -District 3,
Teressa King -District 4, Susan Blackerby-District 5, and Oliver Aldape-District 7. Mayor
Pro Tem Charles Starnes -District 1 and Councilmember John Gatica-District 6 were
absent.
Staff members present were: Jeffrey Snyder -City Manager, Leslie Spear Schmidt -City
Attorney, Tim Crosswhite-Director of Public Works, Rusty Powers -Fire Chief, Isauro
Gutierrez -Information Technology Manager, Sarianne Beversdorf-Director of Finance,
Ken Coughlin -Police Chief, Cris Valverde -Community Development Manager and
Belinda Hinojosa-City Secretary.

Councilmember Oliver Aldape delivered the invocation and led in the pledge of allegiance.
Councilmember Williams moved to approve the consent calendar. The motion was duly
seconded by Councilmember Blackerby and carried by unanimous vote. Items approved
on the consent calendar included the approval of the minutes for May 19, 2016, May 24,
2016, June 3, 2016 and June 4, 2016; and the granting of an excused absence to Mayor
Pro Tem Starnes and Councilmember Gatica.
Tim Crosswhite, Director of Public Works presented for consideration to award bids for
elevated storage tank demolition project. In June 2007, the City had a study done for our
distribution system. At that time we were providing 1.9 million gallons a day to Cargill and
it said we needed 3 million gallons of overhead storage to meet the future demand of our
system pressure and our industrial growth. Staff went out for bid using Parkhill Smith &
Cooper for the tank demolition project. This includes the removal of Smythe, Beech,
Baltimore, South Date overhead storage tank and Yucca Terrace.
In 2012, two new tanks were built to take the place of these and add additional storage.
On May 24 the City opened bids. We had three bidders. Staff recommends awarding
bid to the lowest bidder, Whitaker Lane in the amount of $73,175.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember King moved to award of bids for the elevated storage tank project to
Whitaker Lane Contracting in the amount of $73,175. The motion was duly seconded by
Councilmember Juarez and carried by unanimous vote.
Mr. Crosswhite presented for consideration Resolution R16-364, a Resolution of the City
Council of the City of Plainview, Texas, Approving Bill Wells Chevrolet for a Refund of a
Pro Rata Share Due to a Future Connection of Bradley Texas Realty, L.L.L.P. to a Water
Main Previously Collected on Their Behalf In Accordance With the City of Plainview Code
of Ordinances, Chapter 13, Article 13.03, Water And Sewer Extensions and Connections;
and the Public Purpose Served Is to Encourage and Promote Economic Development
Within the City of Plainview, Texas. This is for prorata for Bills Wells paid by the new
Plainview Dodge Dealership. They installed 1,075 feet of an eight inch line when they
built their original Bill Wells. It was extended from Southwest Third down to the end of
their platted property. The cost of that construction was $76,000. Staff recommends

using a true recalculated construction cost of $22,784 paid from Plainview Auto Bradley
Texas Realty LLP to Bill Wells.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Blackerby moved to adopt Resolution R16-364. The motion was duly
seconded by Councilmember Williams and carried by unanimous vote.
Cris Valverde, Community Development Manager presented for consideration the
request for Combination Plat approval for La Mesa Addition, Unit No. 12, an addition to
the City of Plainview being an Unplatted Tract of Land in Section 29, Block JK -2 Survey,
Hale County, Texas. This plat is for creating a commercial building site for Plainview
Dodge Dealership. Construction is currently underway. Staff has issued a foundation
only permit. The plat has been reviewed by city department and utility companies. The
Planning and Zoning Commission has recommended approval contingent upon passage
of previous resolution.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Williams moved to approve the Combination Plat approval for La Mesa
Addition, Unit No. 12, an addition to the City of Plainview being an Unplatted Tract of Land
in Section 29, Block JK -2 Survey, Hale County, Texas. The motion was duly seconded
by Councilmember King and carried by unanimous vote.
Jeffrey Snyder, City Manager presented for consideration on first reading Ordinance No.
16-3634, an Ordinance of the City of Plainview Authorizing the Transfer and Acceptance
of Ownership For Lots 30-32, Block 7, Frisco Addition, an Addition to the City of Plainview,
Hale County, Texas to the City of Plainview, Texas, in Accordance With Section
272.001(L) of the Texas Local Government Code; Authorizing the Mayor to Execute all
Documents, if any, Necessary to Transfer Ownership; and Declaring a Public Purpose;
Cumulativeness Clause; Severability Clause; Conflicts Clause; and Effective Date. This
ordinance relates to the basketball court project the City has been working on for the last
6-12 months in various stages. This is located in Frisco Park area. The slab on the court
has failed. We have been working on a solution to replace that court. We were trying to
decide whether to go back to its original place or the new site. We pulled soil samples on
the current property and some tax sale property. It came back and we are looking at
about $70,000 to build on current property versus a cost of $20,000 to $25,000 for the
property across the street. All of the taxing entities are in agreement and they have signed
the necessary documents. Staff recommends approval.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember King moved to adopt Ordinance No. 16-3634 on first reading. The motion
was duly seconded by Councilmember Blackerby and carried by unanimous vote.
Councilmember Blackerby moved to go into closed session to consult with attorney on a
matter in which the attorney's duty to the government body under the Texas Disciplinary
Rules of Professional Conduct conflicts with the open meeting statutes and about pending
or contemplated litigation or settlement of same relating to Police Department. The
motion was duly seconded by Councilmember Juarez and carried by unanimous vote.
Mayor Dunlap recessed the meeting at 7:20 p.m.
Mayor Dunlap called the meeting back in open session at 7:45 p.m.

Mayor Dunlap announced that no action would be taken.
There being no further business, Mayor Dunlap adjourned the meeting at 7:45 p.m.
